MINUTES OF THE PLANNING COMMISSION MEETING, THURSDAY,. AUGUST-16th,..
1951. AT 7:30 P.M. IN THE EOUNCIL CHAMBERS.. .CITY - .HALL.... NEWPORT BEACH
ROLL CALL: Commissioners Present: Copelin, Ellerbroek, Longmoor, Reed, ,
Rudd, and Smith.
Commissioners Absent: Briggs, Pleger, and Wightman.
MINUTES: Upon motion of Commissioner Rudd, Seconded by Commissioner Reed,
the minutes for the last regular meeting of July 19th, 1951 and the
Special meeting of August 6th, 1951 were approved as submitted to
the Commission. •
PUBLIC HEARINGS:
Use Permit application of W. H. Brown on portion lot 12, all
14, Block 231, Corona del Mar, (312 Carnation Ave) to convert gar-
age into bachelor apartment and add a car port. This was set over
from last month's meeting to allow time for Mr:. Brown to submit a
complete set of plans showing easement and also to find out whether
or not the. deed permits building over the easement.
The Chairman declared the hearing open and asked if anyone
wished to speak for or against..
Harvey Pease, owner of the property at 314 Carnation, adjoin-
ing the applicant, spoke in opposition of the application. (1)
Make it very difficult for ingress and egress to his property.
.(2) Anyone approaching is home on foot would be compelled to go
out in the street. (3) Consideration being given to paving the
street. If it is paved, it would be on condition that that par- '
ticular street would be dedicated to the City, and it would seem
unlikely to accept the street for dedication purposes if the car
port is in it. (4) Would seem to create a dangerous precedent.
Commissioner Copelin moved the hearing be closed, seconded by
Commissioner Reed and carried.
Commissioner Copelin then.made a motion that the application
for Variance be denied, seconded by Commissioner Reed and carried
by the following roll call vote, to -wits
AYES:. Commissioners: Copelin, Ellerbroek, Longmoor, Reed,
Rudd, and Smith.
NOES: None
ABSENT: Commissioners: Briggs, Pleger, and Wightman.
Variance mpplication of Guy Matics on Lot 1, Block 9, Sec-
tion One, (500 S Bay Ft, Balboa Island) for a thirty inch overhang
on second story. Chairman Longmoor declared the hearing open.
Mr. Matics was present and said that it would mean alot to have
the extra space and didn't believe the overhang would interfere
with trucks eta., going through the alley. The Commission could
not see how it could be considered a hardship case. '
Commissioner•Copelin moved the hearing be closed, seconded
by Commissioner Reed and carried. Commissioner Copelin then moved

that the application for a 300 overhang be denied, seconded by
Commissioner Rudd and carried by the following roll call vote,
to -wit:
AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed,
Rudd, and Smith.
NOES: None
ABSENT: Commissioners: Briggs, Pleger, and Wightman.
Variance application of the Newport Bay Company, 1600.Coast
Highway, (Balboa Bay Club) for relief from the setbacks in Ordi-
nance #635. It is zoned R -4 which provides for 10 foot setbaek --
wants to put the garages up against the fence along the property
line. Mr. Wise, the planning consultant, saw no objection, bv$
suggested they leave the planting in along there.
Commissioner Copelin moved the hearing be closed, seconded
by Commissioner Reed and carried.
Commissioner Copelin then made a motion that the Variance in
setback to the West of the main entrance of club as per plans sub-
mitted be granted, seconded by Commissioner Reed and carried by
the following roll call vote, to -wit:
AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed,
Rudd, and Smith.
NOES: None
ABSENT: Commissioners: Briggs, Pleger, and Wightman.
In connection with the above Variance the Use Permit appli-
cation of the Newport Bay Company to construct 42 adjoining garages
at 1600 Coast Highway was considered and upon motion of Commissioner
Rudd, seconded by Commissioner Ellerbroek, and carried by the fol-
lowing roll call vote, application was granted.
AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed,"
Rudd, and Smith.
NOES: None
ABSENT: Commissioners: Briggs, Pleger, and Wightman.
Variance application of G. F. Martin, Lot 22, Block 6, Sec-
tion 3, (116 Apolena Ave, Balboa Island) on the front and side yard
setbacks.
Mr. Martin was present and there was considerable discussion
with the Commission. Mr. Martin was asked where the hardship ex-
isted and he said that the room upstairs would be smaller than
they wanted and /on the first floor it would be desirable to in-
crease the size of room for grand pianol
'Mr. McNamara (,neighbor) had submitted a written protest to
Commission on sideyard setback where they wanted to put stairway;
however since that plan had been withdrawn by Mr. Martin, there .
was no iongeer any objection there. First he had heard of lower
floor extension and could not say whether he objected or not until

he had a chance to look at his.property again..
Secretary Copelin also read a letter from Mrs. R. H. Deaver, I
117 Apolena objecting to the granting of the Variance. ..
Commissioner Smith moved the hearing be closed, seconded by
Commissioner Rudd and carried.
Commissioner Gopelin made a motion that the sideyard setback,
variance be denied, seconded by Commissioner Reed and carried by
the following roll call vote, to -wit:
AYES; Commissioners: Copelin, Longmoor, Reed, Rudd, & Smith.
NOES: Commissioner Ellerbroek
ABSENT: Commissioners: Briggs, Pleger, and Wightman.
Commissioner Reed made a motion that application be modified
to grant variance of one foot instead of three feet as,asked Port
Motion seconded by Gommissioner Rudd and carried by the following
roll call vote, to -wit:
AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed,
Rudd, and Smith.
NOES: None
ABSENT: Commissioners: Briggs, Pleger, and Wightman.
Use Permit application of Francis J. Horvath for a sign at
1501 West Balboa Blvd, was not acted upon as it was in C -1 district
and no Use Permit need be applied for.
Use Permit applications #19, 200 & 21 of Gene Monroe to
erect signs on:
Lot. 7, Block 159, River Section, 5900 Pacif is
Coast Highway
Lot 41 Block 4, Seashore Colony, 6490 Pacific
Coast highway
Property opposite 6490 Baeific Coast Highway.
on P. E. Right of way.
Mr. Monroe had secured the permission of the property owners
to put the signs up and upon motion of Commissioner Copelin,
seconded by Commissioner Smith and carried by the following roll
call vote, the Use Permits (#19, 20, and 21) were granted.
AYES: Commissioners: Copelin, Ellerbroek, Longmoor, Reed,
Rudd, and Smith.
NOES: None '
ABSENTIA Commissioners: Briggs, Pleger, and Wightman.

COMMUNICATIONS: None
NEW BUSINESS:
Commissioner Ellerbroek brought before the Commission the
need for a more explicit definition of "Single- family dwellingO.
(See Page 118, Section 9107.22) Latest definition:-
DWELLING, ONE SINGLE FAMILY. A building containing only
one kitchen, designed for or used to house not - more than one
family, including all necessary employees of such family. The
building may consist of the main family building and separate
accessory guest houses- -said guest houses shall not contain
kitchens.
ADJOLWMENT:
There being no further business Commissioner Reed made a
motion to adjourn, seconded by 6ommissioner Smith and carried.
