Commissioner Balalis stated that he would vote in opposition to this motion because 13-2 years ago when the Coastal Commission decided to delete r the horthern part of the highway from the Coastal' Commission Guidelines,.that there was a reason for it; they felt that the northern part of the ighway area has less impact on the Coastal area than south of the highway and that the northern part of the Coast Highway is mostly a duplex area end should be looked at as separate issues rather than as one combined issue. He further explained that what has historica ly happened and what is provided in the P -C t xt is that the property owner can build the buil ings that compl with the requirements of the P -C ext and then subdivide the property at a later date to make a, footprint lot for a building that has either been completed or is under construction, so that the property on which a building exists will become Parcel 1, and all the rest of the property on which there is:no building is Par el 2, and that in the future when another buildi g is built; Par cel 2 will be divided again to pr vide another footprint lot, and the other foot rint lots which already exist there are not a par of the sub- division in question. Commissioner Allen inquired whether this procedur is used by anyone else, to which tames Hewicker, Assistant Director- Planning, replied that this is used with Emkay to a degree. he then inquire whether this limits the Planning ommission's right o.f review of the subdivision, to which Mr. Hogan replied that if the subdivision meets all the requirements of the ordinance , the P -C text and the subdivision code., then to deny, there mus be justification, and that whethe or not there is construction undertaken does n t depend upon the subdivision. He ex- lained that removal of the trees and berms ne- essary to installing the sidewalk would cost pproximately $120,000.
