opposition to this motion because 13-2 years ago
when the Coastal Commission decided to delete r the
horthern part of the highway from the Coastal'
Commission Guidelines,.that there was a reason
for it; they felt that the northern part of the
ighway area has less impact on the Coastal area
than south of the highway and that the northern
part of the Coast Highway is mostly a duplex area
end should be looked at as separate issues rather
than as one combined issue.

pointed out that on this particular application,
there is some concern of the applicant and of
the Public.Works Department speci ically as to
the location and installation of the sidewalks
required under the conditions that have been re-
commended by the Staff; one of thE major problems
is not only whether or not.there hould be side-
walks, but whether or not they wo ld affect the
aesthetic development of the cent r. He further
explained that what has historica ly happened
and what is provided in the P -C t xt is that the
property owner can build the buil ings that compl
with the requirements of the P -C ext and then
subdivide the property at a later date to make a,
footprint lot for a building that has either been
completed or is under construction, so that the
property on which a building exists will become
Parcel 1, and all the rest of the property on
which there is:no building is Par el 2, and that
in the future when another buildi g is built; Par
cel 2 will be divided again to pr vide another
footprint lot, and the other foot rint lots which
already exist there are not a par of the sub-
division in question.
Commissioner Allen inquired whether this procedur
is used by anyone else, to which tames Hewicker,
Assistant Director- Planning, replied that this
is used with Emkay to a degree. he then inquire
whether this limits the Planning ommission's
right o.f review of the subdivision, to which Mr.
Hogan replied that if the subdivision meets all
the requirements of the ordinance , the P -C text
and the subdivision code., then to deny, there mus
be justification, and that whethe or not there
is construction undertaken does n t depend upon
the subdivision.
The Public Hearing was opened reg rding this item
and Tim Strader, Applicant and Ow er, appeared
before the Planning Commission ani explained that
this is a phased master plan subu ban office park
approved by the City in 1972 and that at the time
the project was approved, this wa a Planned Com-
munity.

nstalled, with the exception of one parcel owned
y the owner of the Lakeside Restaurant. He ex-
lained that removal of the trees and berms ne-
essary to installing the sidewalk would cost
pproximately $120,000. He suggested the alter-
ative that they modify an existing link in the
edestrian sidewalk adjacent to the Coldwell
anker building, which bicycle trail and sidewalk
s too high, and that it was their opinion that
s an alternate to doing what has been suggested
n this Staff Report, that they would be willing
o lower that particular bicycle trail down to
treet level so that persons who wish to cross
he street to use the sidewalk, would have direct
ccess to that intersection.
