Motion X Following discussion, motion was made that Planni All Ayes Commission recommend to the City Council the approval of Issue Identification for Local Coasta Planning as revised above. Request to consider amendments to Chapters 20.11 and 20.15 of the Newport Beach Municipal Code relating to Residential Development Standards anc development standards in the R -2 District. Initiated by. The City of Newport Beach Public hearing was opened in connection with this matter. Gordon Glass, Architect, appeared before the Commission and felt the proposed amendment was a reasonable upgrading of the R -2 portion of the zoning ordinance. He also commended the Planninc Commission for removing the two -story limitation since the height limitation already imposes restrictions pertaining to height and this would allow more flexibility in planning and developmer There being no others desiring to.appear and be heard, the public hearing was closed. • Planning Commission discussed the Open Space Opt' and the various effects any changes thereto woulc have on building design. Marie Thornell, 403 Fernleaf Avenue; Bertram A. Rowe, 406 Fernley Avenue; Roberta C. Pomery and Alice M. Pomery, 405 Fernleaf Avenue; Theodore Harrington, 404 Dahlia Avenue; and Sylvia S. Harrington, owner of 402 Dahlia Avenue; was distributed and reviewed by the Commission. Public hearing was opened in connection with this matter. Ken McFarland, applicant, appeared before the Commission and concurred with the staff report ar recommendations. He answered questions of the Commission relative to the Coastal Commission requirements, need for a retaining wall, utiliza- tion of the view in planning the structure, topo- graphy of the land, and alternative development plans which would eliminate the need for a variar Mr. McFarland presented a picture of the area showing the elevation of the proposed development and its relationship to adjacent development. HE also reviewed the various view angles from the adjacent properties effected by this development, Staff reveiwed the plans and elevations in connec tion with this request and pointed out that the development could be redesigned to eliminate the need for a variance, however, the possibility existed that the building could be higher on the rear portion of the property than that proposed. Alice Pomeroy, 405 Fernleaf, appeared before the Commission and advised that the portion of the building requiring the height variance was locatc in such a manner as to obstruct their view and voiced concern over this loss. She felt that alternative plans could be prepared which would be satisfactory to the developer an,d at the same time not eliminate views from neighboring proper- ties. She also voiced concern with the ability of fire equipment to obtain access through the alley. Page 6. Edna Rowe, 407 Fernleaf, appeared before the Commission and voiced concern with the los of view that the proposed structure would produce and felt that a compromise could be reached through alternative plans which would provide a step -down configuration. Ken McFarland, applicant, appeared before the Commission and advised of their desire to constri units which would contain reasonable living space for the occupants. He felt that the proposed design would accomplish this while at the same time still provide for views on neighboring properties as indicated by the elevation previou! reviewed. • Planning Commission felt the need for further information as to the effects that the requested variance would have on neighboring properties an requested that the applicant obtain additional pictures showing the other elevations of the property and the effects those angles would have on neighboring properties. Richard Higbie appeared before the Commission on behalf of the applicant and advised he was the on in need of the extra space being requested. He commented on the existing parking and felt that the expansion would not be detrimental to the are and not increase the parking. George Engles, 125 E. Bayfront, Balboa Island, appeared before the Commission in opposition to this request because of the parking problems and the fact that the expanded area codld be used for other purposes thereby adding to the existing parking problem. He presented a report from the Little Balboa Island Improvement Association stating their reasons for opposition to the expansion and requesting denial of this use permi There being no others desiring to appear and be heard, the public hearing was closed. Motion X Planning Commission denied Use Permit No. 1842, Ayes X X X X X X based on the following findings: Abstain X 1. A substantial increase in floor area is pro- posed on the site which is already nonconforn ing because of the lack of offstreet parking spaces. 2. There is no suitable guarantee that the expan ed commercial space will not be occupied by additional occupants or a separate commercial use at a later date. 3. The proposed development may increase the parking demand in a very congested area along Marine Avenue, and further increase the park- ing of automobiles on adjoining residential streets. 4. Frank Becker, 3412 Quiet Cove, Corona del Mar, appeared before the Commission and concurred witl the staff report and recommendations with the exception of the requirement for a 10 foot setbai along Agate Avenue on the second floor of the proposed structure. He commented on the inspira• tion for the proposed design and felt the develol ment as proposed would be aesthetically pleasing to the area and enhance the neighborhood. The proposed development, with the proposed revisions recommended by staff, meets or exceeds all of the development standards of the C -R District (i.e. yards, building height parking spaces, buildable area, etc.) 4. That the establishment of tandem parking spat on the site will not, under the circumstances of the particular case, be detrimental to the health, safety, peace, comfort and general welfare of persons residing or working in the neighborhood of such proposed use or be detri mental or injurious to property and improveme in the neighborhood or the general welfare of the City and further that the proposed modifi cation is consistent with the legislative int of Title 20 of this Code. 5.
