No, 635 would be violated. Section 9105.2 specifies that no fence, hedge or screen planting shall exceed three (3') feet in height along the property line to the front. Section 9103,15 states that a front yard setback in a is -1 Zone shall be a minimum of twenty (201) feet. Also if this request were approved it would be necessary to subdivide these two lots in order to make a legal building site on the remaining portions. 7. The Committee reported that in this area there are several structures within the 20, rearyard setback and felt that addition of a room would improve the property and make better living accomodations for the family. 8. A 21 encroachment into a 221 rear yard setback to permit construction of additional living area above garage and an 18" encroachment into required 31 side yard setback to allow for a bay window to project from new structure. 5. DISCUSSION It was brought to'the attention of the applicant that Section 9103425 (b) provides that the side yard on the rear twenty (20) feet of the street side of a corner lot, where there is reverse frontage, shall not be less than the front yard required or existing on the adjacent reversed frontage.. 7. FINDINGS The Committee upon investigation of the property stated that in the past variances have been granted for rear yard overhangs where a 101 alley has existed, although they have never been permitted to go more than 50% of the required setback. Since the alley in this case is 151 wide a recommendation of an 18" encroachment was made. The adjacent house is approximately 91 back of his property line therefore the Committee felt the bay window construction should not be permitted. . 8. Commissioner Smith moved the Commission recommend the GRANTING of an 18" encroachment into the required 2211 required rear yard setback and that the request for a bay window projection be DENIED, seconded by by Comm. FINDINGS A policy heretofore was adopted by the Planning Commission to not allow any rehabilitation of existing billboards and to prohibit the placement of any new ones in the City. Two letters were submitted to the Commission by adjacent property owners protesting the raising of the present panel. 7. FINMNGS In keeping with other multiple wits allowed along Marguerite St. in Corona del Afar and there being no protests entered the Committee recommended that four units on each parcel or each building site be permitted. 8, Commissioner Reed moved the Commission recommend the GRANTING of this • Use Permit subject to the condition that the four units be constructed on each parcel or building site, seconded by Comm. Posted September 7, 1956 4. The erecting of one structure on the two lots instead of two separate structures. 5. Separate structures will not permit the providing of two car garages for.each apartment. If this permit is granted and one structure is erected, two car garages will be provided for each apartment. In addition, the building will be considerably more attractive. We ,respectfully submit that the more the beauty and the more the garage space, the better the community is served. 6. DISCUSSION : Note findings. 7. FINDINGS : The Committee reported that two garages were to be • provided for each unit relieving any parking problem that would be created by a multiple dwelling in this area. It was stated that the architectural design of this structure would add to the community. No. protests were entered, therefore a recommendation of approval was made. 8. DISCUSSION : Note findings. • 6. FINDINGS : At the time the present Zoning Ordinance was adopted, considerable opposition was offered to the suggested Parking Provision by owners of property fronting on the State Highway in Corona del Mar. Consequently, this resulted in a C -1 zoning for all of this frontage, and in only one block has this been changed. Page - 8 USE PFMIITS • #261 (con'd from page 7) Section 9103.51 of the Code provides for certain uses of these properties. Section 9103.52 provides for certain other uses at the discretion of the Commission and the City Council. Your Committee is reluctant to recommend the use of property for a purpose which might be detrimental to adjoining home owners, or unless there is suitable parking area on the property itself. The Commission does not feel that a fabrication operation should be located adjacent to residential uses if no-street or alley exists to separate the such operations or uses from the residential zone. 7. FINDINGS: The lot in question being in an "Unclassified" District a Use Permit is required under section 9103.81 a.of Ordinance # 635. 6. Commissioner Keene moved the Commission recommend the GRANTING of this Use Permit, seconded by Comm. L E T T E R S Presented to the Commission was a letter dated August 15, 1956 signed by Mr. Charles A..Kramer, 1372 Cameo Drive, Santa Ana., Calif. wherein it was requested that his Use Permit application No.212 be extended for a period of six months. The office of the City Attorney stated that under Section 9106.111 • of Ordinance # 635 the Use Permit could not be extended and that it would be necessary for Mr. Kramer to file a new application for per- mission to construct a four unit dwelling on the corner lot at F and Balboa Streets. On motion of Commissioner Reed, seconded by Comm. Hayton and carried, the regular meetings of the Planning Commission were established as the third Thursday in each month beginning with the month of November 1956. ::..::..... Hayton, and carried, proceedings were initiated to adopt a Resolution of intention to amend .Bection 9106.33 of Ordinance No. 635. . . . . . . . . . . . Commissioner Copelin moved the Commission change the meeting time from 8:00 to 7 :30 P.M. beginning with the month of November 1956, seconded by Comm. Hayton and carried. A two (21) foot frontyard setback along Balboa Blvd, instead of the 5' 0" front setback required by District Map # 9. 5. The above described property lies between commercially developed properties. The owner wishes to construct a decorative fence with 16 ft. wide by 5 feet deep recessed planting pockets for palm trees and other planting with decorative lighting without an excessive loss of useful ground area imposed by the present 5 foot setback. A 2 foot setback will in no way interfere with the view of or otheMse damage surrounding properties. C -1 zone properties having a zero front setback allowance are located a block away on each side of the property involved in this request. • .-. 6.. DISCUSSION ►`1 U : NOTE FINDINGS: Page - 2 -. VARIANCES # 311 (con'd from Page 1 ) 7. FINDINGS A minimum of a 51 front yard setback is required in residential zones along Balboa Blvd. between Newport 11 Blvd.. &Balboa.. There are some blocks with a 10' front yard setback. 2. If the Planning Commission should grant a reduction of the 51 setback to any property owner, particularly the City itself, then the Commission does not have much de- fense or justification to refuse other property owners a reduction of front yard setback. A definite precedent would be set. 3. The Commission explored the possibility of granting this application with the restrictive provision that the allowed area be used only for the construction of a fence and landscaping to accomplish a pleasing screen and decorative street front for the trailer park. The Code permits a fence on the front property line providing it does not exceed 31 in height.. This limited height would not present a pleasing screen or decorative front con- sidering the length of street frontage involved. 4, After considering all the facts involved the Planning Commission recommends denial of the application.. 8.. Commissioner Keene moved the Commissiom recommend the DENIAL of this Variance, seconded by Comm. Briggs and carried by the following roll call vote, to wit:.
