Dedication for street widening, parking, . and traffic patterns throughout the area were also discussed. Mr. Kuri agreed to all of the conditions recommended in the staff report. There being no others desiring to appear and be heard, the public hearing was closed. Planning Commission discussed dedication by the property owner as opposed to purchase by the City of property for street widening purposes; the Environmental Impact Report; possible use of the units for residential purposes; and height of appurtenant equipment beyond 35 feet. That development shall be in substantial con - formance with the approved plot plans and elevations, except for minor modifications approved by the Department of Community Devel- opment. The height of the proposed structures shall not exceed a maximum height of thirty- five feet above grade except where permitted by the Newport Beach Municipal Code. 2. That valet parking service shall be provided beyond the normal 8:00 A.M. to 5:00 P.M. business day. This requirement shall be provided as a standard service of the manage- ment company which will operate the condominiu and no additional or separate charges for parking on site shall be assessed to the build ing tenants or their business invitees. 3. That all parking spaces shall be.marked with approved traffic markers or painted double white lines not less than four inches wide. 4. That the landscape plan, including a plan for parking landscaping, shall be approved by the • Director of Parks, Beaches and Recreation, and the approved landscaping shall be contin- uously maintained. That all storage or trash shall be shielded from view within the buildings or within an area enclosed by a wall not less than six feet in height. 7. That all improvements be constructed as requir d by ordinance and the Public Works Department, except as otherwise modified.in specific conditions of approval. 8. That the right -of -way of 32nd Street be widened by sixteen feet, and the right -of -way of Lafayette Avenue be widened by thirty -six feet; with corner cut -offs at 32nd Street having a radius of forty feet, and at 31st Street having a radius of seventy -five feet. 9. That the developer dedicate to the City 50% of the additional right -of -way required for street widening, as a condition of develop- ment; and that the City acquire, at fair market value as determined by the City Council, the remaining right -of -way required for street widening. 10. That an agreement and. /or other instruments satisfactory to the City Attorney be executed providing for the developer's use of the subsurface beneath the alley; with compensa- tion to the City to be as determined by the City Council. 11. That the developer be responsible for all alley improvements, including utility reloca- tions and /or other adjustments needed to accommodate the proposed use of the sub - surface. The minimum improved alley width shall be twenty -four feet rather than the twenty feet shown on the plot plan. 12. That the developer be responsible for con- struction of sidewalks and street lighting on 32nd Street, Lafayette Avenue, and 31st Street. i13. That there shall be submitted a. declaration of covenants, conditions and restrictions setting forth the prohibition of residential uses within the complex. Said CC &R's shall be reviewed and approved by the City Attorney and the Director of Community Development. 18. That no air - conditioning equipment or elevato towers shall exceed the height limit of 35 • feet. Planning Commission also accepted Environmental Impact Report No. EIR /NB 73 -037 and adopted the following findings: A. That the report is complete and contains all of the information required by the California Environmental Quality Act and by the State and City guidelines. B. That the project conforms to the General Plan. C. That the significant short -term impacts will include normal construction activity and the de- watering operation. D. That these impacts will be mitigated to the extent possible by careful control of construc- tion and rigid adherence to the requirements o the Regional Water Quality Control Board. E. That the major long -term impact of the project will be an increase in traffic. F. That the traffic impact will be mitigated by • major new street improvements. Page 6. Bob Bein, with Raub, Bein, Frost & Associates, appeared before the Planning Commission to answer questions and commented on the possibility of de- annexation from the Costa Mesa County Water District. He also agreed to the conditions as recommended by the staff as well as an additional condition relative to de- annexation from the Costa Mesa County Water District. Planning Commission discussed Environmental Impact Reports as they pertain to resubdivision requests.
