After considerable discussion the Commission determined that the creation of 2 lots 45 fee wide at this location would have more of a detrimental effect on the neighborhood than being an asset based on topography, access- ibility and the access way into'.China Cove. Therefore the application was denied. Mr. Bradford Miller, owner of the development on which the facility is located also addressed the Commission. The matter had been continued in order that the applicant could present positive evidence of acquiring new quarters or an area for off - street parking. No such evidence was pre- sented therefore the Commission felt that the operation was a definite detriment to the neighborhood and the application was denied. Mr. Richard A. Higbie, attorney, spoke in behalf of the applicant. Mr. Paul Miller, designer, also addressed the Commission. The application was approved subject to the Motion x following conditions: Second x All Ayes 1.- Provide not less than 82 parking spaces on site,.substantially as shown on the revised plot plan dated September 17, 1968. A plot plan showing the revised parking lot lay - out of the convalescent home under construction shall be-submitted to the Planning Department for approval. No parking spaces shall be lost as a result of the redesign.. . 2. Provide the necessary legal documents, suitable to the City Attorney, for the right to connect to and use the drive- way on property to the south. 3. Submit complete working drawings to the Planning Department for approval within one year. Such working draw- ings shall include complete landscape • stabilization planting and irrigation plans prepared by a landscape archi- tect, 8. That all new power and communications facilities be installed underground. 9. That: a. The existing storm drain be relocated outside the building area and an easement (10 ft. minimum) be dedicated for utility purposes; the location to be subject to the approval of the Public.Works Department. Or: b. That design of the building be such that no additional founda- tion loads will be- imposed on the storm drain, and that access to the existing storm drain suitable to the General Services • Department be maintained. That all improvements be constructed as required by ordinance and the Public Works Department. 11. That all plans for public improve- ments be prepared on City.Standard, Sheets by a licensed Civil Engineer. 12. That satisfactory surety and agree- ment be provided to guarantee com- pletion of the public improvements and that a standard inspection fee be paid. 13. That all grading be in accordance with a grading plan approved bythe Building Director and a qualified Soils Engineer. Upon completion of the grading the Soils Engineer shall certify that the grading has been completed according to the plan and • grading ordinance. A reproducible copy of the grading plan on a standard size sheet shall be furnished to the Public Works Department. 14. That the.proposed plan of access be subject to the approval of the Traffic Engineer. 15. That the proposed sub-basement recrea- tion area shall not extend closer than 16 feet to Newport Boulevard and that said area shall not be more than 25% of the building length. 16. That the use of the building shall be only for an adult retiremen-t'resident care facility. Mr. Farley, an employee of the Crab Cooker spoke in opposition to the amendment in behalf of Mr. Bob Roubian who owns property on 20th Street, James Mr. Anthony Vasi and Mr, James Davis, owners Mr.. the boat storage yard, spoke in opposition. Mr. George Weaver of Newport Marine Service and Mr. Swanson who owns property on 21st Street also spoke in opposition. Mr. Thomas Hyans of 217 - 19th Street; who requested the rezoning, addressed the Commis- sion and pointed out that he had requested. only that the west side of 19th Street, includ- ing nine residential properties between Balboa Boulevard and the bay front, but excluding the property containing the Tasty- Freeze business, be rezoned. Five letters of opposition were read into the record and petitions were presented from pro - perty owners on the street containing 15 signa- Page 5.
