MINUTES ieloex Item #1 Request to adopt a Concept Plan for the area 24th Street CANNERY generally bounded by 32nd Street and on the north, Balboa Boulevard and the Pacific McFADDEN Ocean on the west,.19th Street on the south, and S U Lower Newport Bay and the Rhine Channel on the C N PT PLA- east. Initiated by: The City of Newport Beach CONT. DO, Community Development Director Hogan commented on the Specific Area Plan being established as pre- scribed by the General Plan adopted in 1973,.and the need for public input in developing a satisfactory plan for the area. He further advised that any conceptual plan adopted was merely a guideline for more detailed planning and in no way restricted any changes to said conceptual plan. He also commented on the parking study presently underway as well as the need for further studies with respect to traffic circulation, parking and intensity of uses. Page 1. Commissioner Heather commented on the need to protect the marine industry and her reluctance at this time to tamper with the existing character of the area. Senior Planner Talarico reviewed the four origina concept plans presented at the previous public hearing as well as a fifth concept plan which was prepared as a result of the public testimony received at that hearing. Public hearing was opened in connection with this matter. Milton Bren, owner of 10 lots on 30th Street, appeared before the Commission and requested clarification as to the location of the proposed 29th and 30th Streets closure. Peg Forgit, 2205 W. Balboa Boulevard, felt that the basic problem was that of traffic circulation need for wider streets, and adequate parking facilities; that the proposed concept plans shoul be scrapped; that a parking district should be formed; that no more commercial development be allowed i.n the area until the traffic and parking situations are corrected; and that new owners be required to provide required parking rather than being allowed to hide behind the "grandfather" clause. Ed Martindale, owner of a marine oriented busines on 30th Street, commented on the mix presently allowed and felt that the real problem was parkin not land use or zoning. Mike Singer appeared before the Commission on behalf of his family who own 26 lots on the corne of 28th Street and Newport Boulevard. He advised that the family has spent over 40 years acquiring these lots for the purpose of a combined develop - ment and that the lots have been cleared of old rundown buildings. He also objected to a small parcel being placed in a public parking area because it would be stripped of any value for development. Hans Dickman commented on the traffic situation i the area. Bob Hinch, one of the owners of 2300 Newport Boulevard, South Coast Shipyard and Design Centel appeared before the Commission on behalf of Bill Blurock and 9 other partial owners of the properl He advised of their interest in the study of the area and offered their services in an effort to help enhance the area and make it a better place to work and live. Robert Lee, Architect, with the firm of Lee and Klages, appeared before the Commission and felt it was difficult to evaluate any of the concept plans proposed. He questioned the ultimate character desired for the area and suggested tha• one color be placed over the entire area which we permit any of the existing uses to occur anywhere thus providing a unique mix of commercial and /or resi.dential rather than designating certain uses to occur on specific lots. He also offered any assistance the City may need in planning the are+ The concept as proposed by Mr. Lee was briefly discussed by the Planning Commission as well as possible ways to implement such a plan. Milton Bren appeared before the Commission and commented on the parking problem in the area. Carl Akerman, property owner in the McFadden are commented on the zoning and felt that considerat should be given to the concept of shared parking based on the hours of operation, since some businesses operate only in the daytime while oth operate only at night. Planning Commission discussed the uniqueness of the area, need for more information in connectio with the parking, need for additional planning and input from those who have offered their services and live and work in the area, and Page 3. The proposal also includes a modification to permit two open parking spaces in front of a two -.car garage, meeting the Ordinance requirement of four parking spaces. However, the two open parking spaces encroach to the front property line (where the Districting Map indicates a required 15 -foot front yard setback along Dahlia Avenue). Further more, a modification is required to permit a proposed second floor balcony to encroach to within 2'6" of the rear property line (where the Ordinance requires a 5 foot rear yard when abut- ting a 14 -foot wide alley). Location: Lot 2, Block 332, Corona del Mar, located at 400 Dahlia Avenue, . adjacent to the proposed park on Bayside Drive, in Corona del Mar. Zone: R -2 Applicant: Ken McFarland, Costa Mesa Owner: Andrew Glassell, VII, Balboa Islam Staff advised that since the last meeting, the . applicant had redesigned the plan so as to confoi with the 1.5 floor area ratio as required by the Coastal.Commission. Photographs had also been taken showing the roof elevations of the propose, structure. Public hearing was opened in connection with thi matter. Ken McFarland appeared before the Commission on behalf of the owner, Andrew Glassell. He review, the revised plans and advised that the upper uni had been reduced from a 3- bedroom to a 2- bedroom unit. He presented pictures of a simulated structure indicating the height and related view obstruction, and a letter from the engineer . verifying the data and methods used in obtaining the pictures. Mr. McFarland also answered questions of the Commission relative to the retaining walls which will be required. Page 5. She also read a letter signed by Theodore and Sylvia S. Harrington., owners of property at 402 -404 Dahlia Avenue, relative to construction of retaining walls and the instabili of the hillside. Staff advised that any development of this propel would require a soils report and engineering design which would satisfy the needs of the soils report and the adjacent property. There being no others.desiring to appear and be heard, the public hearing was closed. Motion X Motion was made that Planning Commission make thi following findings: 1. That there are exceptional or extraordinary circumstances applying to the land, building or use referred to in the application, which circumstances or conditions do not apply generally to land, buildings and /or uses in the same district, because of the steep topo graphy of the site. 2. That the granting of the application is necessary for the preservation..and enjoyment substantial property rights of the applicant since the steep terrain of the site preclude the construction of the duplex within. the required 24 foot height limit. 3. That the proposed development will not, unde the circumstances of the particular case, materially affect adversely the health or. safety of persons residing or working in the neighborhood of the property of the applican and will not under the circumstance of the particular case be materially detrimental to the public welfare or injurious to property improvements in the neighborhood. . 4. That water and sewer services satisfactory to the Public Works Department be provided a the applicant's expense. 4. That all improvements to be constructed in Dahlia Avenue and Bayside Drive be construct at the applicant's expense. The proposed wo shall be shown on standard improvement plans prepared by a licensed civil engineer and shall be approved by the Public Works and Parks, Beaches and Recreation Departments. That prior to the issuance of a building permit, a soils report on the stability of t lot shall be submitted to the Building Divis of the Community Development Department. 6. That the stairway which currently encroaches into the alley right -of -way shall be removed and the alley improved in a manner meeting the approval of the Director of Public Works Commissioner Hummel commented in opposition to encroachments into setbacks and, therefore, opposed the granting of this variance. Newport Beach 1977 POLL CALL Commissioner Lynch stepped down from the dais and refrained from deliberation in connection with Items #4 and #5 due to a possible conflict of interest. Items #4 and #5 were heard concurrently because o their relationship. Request for review of a development plan in compliance with the General Plan requirement for Planning Commission approval of any development plans for the subject site, and the certification of an Environmental Impact Report. (Note: This request was originally filed as Use Permit No. 1840 which was a request to exceed the basic height limit in the 26/35 Foot Height Limitation District, but is no longer required because of redesign of the project.) He requeste that revised conditions No. 6 (b) and (c) include the responsibility of.the lessee in addition to that of the owner and that consideration be given to something less than an 8 foot wide sidewalk as required by Condition No. 8 of the resubdivision request. Wally Geer, applicant, 336 Lugonia, appeared befo the Commission and reviewed the site plan, eleva- tions, cross sections, and landscaping. He pre - sented slides and indicated that portion of the view which would be lost from various locations surrounding the property. Larry Seeman, Environmental Consultant, presented a series of before and after pictures pertaining to the loss of view. Morgan Stanley, 1125 Dolphin Terrace, appeared before the Commission and felt that the proposed development should be approved as they have gone out of their way to satisfy the concerns of the people affected by this development. He commente in opposition to the recommendation of the Citiie Environmental Quality Control Advisory Committee relative to shared parking. Jerry King, 979 Sandcastle, Chairman of the Citizens Environmental Quality Control Advisory .Committee, commented on the basis for their recommendation relative to shared parking and its use by the public during weekends.and holidays with the restriction that no overnight parking be allowed. Planning Commission discussed the problems connec ed with joint use of the parking lot, including the hardship imposed on those who use the marina and docking facilities and problems connected wil policing the use of the parking lot. George Engles, representing the Little Balboa Island.Property Owners Association, commented in support of the proposed development as well as their feeling that the park originally proposed would serve no useful purpose and therefore recommended that it be eliminated from the plan a substituted with a greenbelt along the bay and. Bob Millar, 116 Crystal Avenue, member of the Board of Directors of the Little Balboa Island Property Owners Association, appeared before the Commission and commented in opposition to.the.joi use of the parking lot. He felt that the plan as submitted should be approved since much planning and study had gone into the proposed development. Planning Commission discussed the access easement along the bay and its possible design as to landscaping, use and access. Commissioner Agee voiced concern that the park ha been eliminated, questioned the advisability of substituting a walkway for a small neighborhood park, and commented on his preference for the small park concept. Commissioner Frederickson felt there were advanta to pricing a park at this location and concurred with Commissioner Agee that it should be recon- sidered. Bob Millar appeared before the Commission and pointed out that the reason for recommending elimination of the park was the concern with the improvement of the entrance to the island and since both the park and the landscaping strip could not be provided, the homeowners felt the landscaping strip would be more beneficial and aesthetically pleasing to the entrance. Jerry King appeared before the Commission and com mented on the preference for the landscaping buff area as opposed to the proposed park. . There being no others desiring to appear and be heard., the public hearing was closed. Commissioner Agee commented on the merits of the development, however, he failed to see the benefi of eliminating the park and felt that some squar footage of the landscaping should be devoted to installation of a small park. Absent X Motion X Motion was made that Planning Commission approve the Development Plan, subject to the following conditions: 1. That development shall be in substantial conformance with the approved plot plans and elevations. 2. That the conditions of approval of Resubdivi- sion No. 561 be fulfilled. 3. That a minimum of one parking space /250 squa feet of net floor area of the office buildinc shall be provided on site and that 52 parkinc spaces be provided on site for marina office and slip parking. 4. That all mechanical equipment and trash area! shall be screened from adjacent properties including mechanical equipment on the. roof. 5. Special attention shall be given to the pre- servation of views from Bayside Drive and Marine Avenue and the use of drought resiste plant materials. 6. That the property owner grant an easement to the City of Newport Beach for public access along the entire Bay side of the parcel. Sa easement shall be a minimum of 10 feet in wi and shall provide for a connection with the public sidewalk on the east side of Marine Avenue. a. Liability resulting from the public use o the easement shall be assumed by the City of Newport Beach in a manner satisfactory to the City Attorney. 7. That the interior circulation system shall be approved by the Traffic Engineer before issua of grading and building permits. 8. That the developer shall be instructed to submit to the California Regional Water Quali Control Board the specific water quality cunt plan they intend to follow to insure that the will be no pollution of the Bay: during demoli tion, grading and construction. 9. That the parking lot shall be designed and graded in such a manner so as to drain into e landscaped area or alternative system which will be designed to accommodate low flow run- off. A catch basin and connection to the . City's storm drain system shall be provided for overflow runoff. The grading and storm drain plans shall be approved by the City staff prior to the issuance of grading and. building permits. 10. That the noise impact from the area be considered and that the office building be designed to provide for sound attenuation in accordance with existing noise standards. 11. That all applicable mitigation measures as sl forth in the Environmental Impact Report sha' be met. That the owner grant an easement to the City for unobstructed public access across the Bad side of the parcel. 4. That a condition survey of the existing bulV along the bay side of the property be made b3 a civil or structural.engineer, and that the bulkhead be repaired in conformance with the recommendations of the condition survey and i the satisfaction of the Public Works and Mari Departments. 5. Paul Ruffing, Architect, 610 Newport Center Drive appeared before the Commission and reviewed the proposed development. There being no others desiring to appear and be heard, the public hearings were closed. Motion X Motion was made that Planning Commission make thI Ayes X X X X X X following findings: Absent X 1. That the proposed use is consistent with the Land Use Element of the General Plan and is compatible with surrounding land uses. 2. The project will not have any significant environmental impact. 3. Adequate offstreet parking spaces are being provided for the proposed development. 4. Adequate provisions for traffic circulation being made for the expanded drive -in teller facility. 5: The Police Department has indicated that the do not contemplate any problems with the proposed development. 6. The approval of Use Permit No. 1759 (Amended will not, under the circumstances of this ca be detrimental to the health, safety, peace; morals, comfort and general welfare of perso residing and working in the neighborhood or detrimental or injurious to property and improvements in the neighborhood or the gene welfare of the City. and approve Use Permit No. 1759 (Amended), subje to the following conditions: 1. That the parking spaces be set a minimum of 30 feet back of the existing northerly curb line of East Coast Highway. 3. That the new sign on East Coast Highway be placed a minimum of 20 feet behind the exist- ing curb line on Coast Highway. 4. That a raised median, approximately 100 feet in length, be constructed in East Coast Highw to prevent left turns in and out of the easterly driveway. The final design shall be approved by the Public Works Department. 5. That the raised median in East Coast Highway and the easterly driveway be completed prior to occupancy of the building additions. ' 6. That the proposed minor expansion of the existing private improvements located within the Coast Highway right -of -way be subject to the approval of an encroachment permit. All private improvements within the street rights of -way shall be removed by the Applicant when the area is needed for street widening. 7. That the original Use Permit No. 1759 shall b extended for a period of two years (i.e. unti August 28, 1979) unless the Modifications Committee approves an extension beyond that date. The termination of this application an the other related applications (i.e. Use Perm No. 1794 and Use Permit No. 1759 (Amended)) shall coincide with the termination of the original Use Permit No. 1759. That a standard subdivision agreement with accompanying security be provided if it is desired to record the parcel map before the public improvements are completed. 11.
