IN THE COUNCIL CHAMBERS OF THE NEWPORT BEACH CITY HALL ROLL CALL: Commissioners Present: Briggs, Copelin, Longmoor, ' el�ger, Mudd, Smith, and Wightman. Commissioners Absent: Eller - broek and Reed. MINUTES: Upon motion of Commissioner Rudd, seconded by Commis- sioner Pleger and carried, the minutes of the last regular meet- ing, September 18th, were approved as submitted to the Commission. USE PERMITS: --Ap iration of the Park Beach and Recreation Commission to install public baseball diamond at 15th Street and the Ucean Front. Chairman Longmoor declared the hearing open and gave a brief history of the application. Secretary Copelin read two letters, Ocean Front and Beach Protective Associa.timn, and Cen- tral Newport Beach Improvement Assoc., which had requested that they be read at the public hearing and asked if anyone else wished their letter read. Discussion was thrown open to the floor; the following spoke in opposition of the park: Robt. J. Wallace, 1512 W. Ocean Front R. E..Wolfe, 1510 W. Ocean Front Mrs. Glenn White, owner of Bay & Beach A pts. Henry Campbell, 1710 Y. Ocean Front Russell Olson, 1408 W. Ocean Front Mr. Mitchell, 1824 Ocean Front Mr. Sanders, 1624 Ocean Front Geo Carroll, owner of several ocean front properties. Mrs. Griszinovich, 1605 W. Balboa Blvd. R. H. Robinson, i.o4 W. Ocean Front John Vogel Mrs. Lambert, 104 15th Street Mr. Wolfe, 1514 W. Ocean Front. Harold Glass and A. Alexander Hamilton spoke in regard'to the application and proposed site. After discussion continuing for one hour, Commissioner Wightman made a motion that the hearing be closed, seconded by Commissioner Pleger and carried. Commissioner Pleger then made a motion that the application be('denled, seconded by Commissioner Copelin and carried by the following roll call vote, to -wit: AYES, COMMISSIONERS: Briggs, Copelin, Longmoor, Pleger, Rudd, Smith & Wightman. NOES, COMMISSIONERS: None ABSENT, COMMISSIONERS: Ellerbroek, and Reed. The Commission reconvened at 8:38 p.m. and .opened discus- Use , sion on the Permit application of Everett E. Bie er to add twenty (20) additional spaces to trailer park at b26 O'cast Highway, Newport Beach. (Lot F, Tract 919) 23 =1 Commissioner Rudd recommended the granting of the ' application and so moved. Commissioner Smith seconde& the motion and the Use Permit was granted by the following roll call vote, to -wit: AYES, COMMISSIONERS: Briggs,. Copelin, Longmoor, Pleger, Rudd, Smith, & Wightman. NOES, COMMISSIONERS: None ABSENT, COMMISSIONERS: Ellerbroek, and Reed. Use Permit application of M. J. Franklin to construct six units on an R -3 lot at Via Lido Soud an37Genoa. Lot 900, Tract 907, Lido Isle. This was previously before the Commission on an appli- cation for five units which was granted; however, they find they have the area for six units. Commissioner Pleger moved the application be approved, seconded by Commissioner Coplein and carried by the following roll call vote, to -wit: AYES, COMMISSIONERS: Briggs Copelin Longmoor, Pleger, Rudd, Smith, & *ightman. NOES, COMMISSIONERS: Nore ABSENT, COMMISSIONERS: Ellerbroek, and Reed. VARIANCES: Application of Alton B. Culver for Variance to change setback lines on Lots I to 7 inc.—.Block 335, Canal Section from 401 to 201. This was held over from last regular meet- ing pending a survey as to the wishes of the rest of the property owners in that block. After discussion, Commissioner Wightman moved the hearing be closed, seconded by CommissionerCopelin and car- ried. Commissioner Copelin stated that the Engineering Depart- ment had drawn a map showing a definite need for a more complete study Of the entire channel front area to determine the best setbacks for the various blocks. Uommissioner Copelin then made a motion that the ap- plication for a 201 setback be denied, seconded by Commis- sioner Smith and carried by the following roll call vote, - to -wit: AYES, COMMISSIONERS: Briggs, Copelin, Longmoor, Pleger, Rudd, Smith, & Wightman. ' NOES, COMMISSIONERS: None ABSENT, COMMISSIONERS: Ellerbroek, and need. Application of Lewis E. Cock for a 30" overhang on alley side of garage apartment at 124 27th Street, (Lot 16, Block 26, Newport Beach Tract) 232 Commissioner Copelin reported recommending the granting of the application. Commissioner Wightman moved the hearing be closed, seconded by Commissioner Smith and carried. Commissioner Copelin then made a motion that the appli- cation be granted, seconded by Commissioner Wightman and carried by the following roll call vote, to -wit:' AYES, COMMISSIONERS: Briggs, Copelin, Longmoor, Pleger, Rudd, Smith, & Wightman. NOES, COMMISSIONERS: None ABSENT, COMMISSIONERS: "'llerbroek, and Reed. Application of Anton Laubersheimer, M.D. for a Variance to: (1) Designation of property as a building site, (2) the building of a two story, single family dwelling, at 705 E. Bay Ave, (Wly 30' of Lots 1 & 2, Block 5, East Newport) Chairman Longmoor declared the hearing open and asked if anyone wished to speak for- or against. Kenneth A. Cary, speaking in behalf of the applicant, presented notes of approval from neighbors. Secretary Copelin read Commissioner Briggs' report stating that it would create a precedent and recom- mending its denial. Application was not made by property owner either. After further discussion, Commissioner Copelin made a motion that the hearing be closed, seconded by Commissioner Pleger and carried. ' Commissioner Copelin then made a motion that the appli- cation be denied, until such time that.the owner of the property makes application, the Commission could not consider it further, and seconded by Comm3m loner Smith and carried by the following roll call vote, to -wit: RYES, COMMISSIONERS: Briggs, Copelin, Longmoor, Pleger, Rudd, Smith, & Wightman. NOES, COMMISSIONERS: None ABSENT, COMMISSIONERS: Ellerbroek, and Reed Application of the Fowler Drilling Company for the dril- ling of oil oh Lot 9, Block 160, River Section. Mr. Harold Miller, of the Fowler Drilling Company was present and asked that the application be withdrawn in view of the fact that they ar4 not the owners of the property, but the lessee, and a new application should be filed by the owner, Joe Livernash. Chairman stated that in view of the fact that the F owler Drilling Company has withdrawn their application, the Commission will not proceed with said application and a confirmation from the company is to follow by mail. ' .AMENDMENT: Application dif the Griffith Company for amendment of thf zoning ordinance as per their letter of September 16, 1952. NY ID covering certain property on via Genoa, Lido Isle. Chairman Longmoor opened the first fixing and stated ' that the Griffith Company was withdrawing this application and filing a new one including all lots involved; therefore, Commissioner Smith made a motion that the first hearing be closed and set over to next meeting, seconded by Commissioner Wightman and carried. Letter withdrawing application to be filed by Griffith Comlony. OLD BUSINESS: R. V. Sweeney, director and attorney for theSouth Coast Co, was present to discuss the parking situationw e Commission. Chairman explained the granting of the Use Permit and stipulations. Commissioner Briggs moved that the Use Permit be ex- tended for an additional six months upon same conditions that the first Use Permit was issued and that the City Coun- cil be notified that we are aware of violations. 'There was further discussion, and for lack of a second, Commissioner Briggs withdrew his motion. After further discussion, Commissioner Pleger moved that the Use Permit be granted for the storage and processing of ship lumber on the site of the original application for a period of six months and the provision that at least 30 car ' off- street parking be provided on this site or a convenient nearby site. Motion seconded by CommissionerRudd and carried by the following roll call vote, to -wit: AYES, COMMISSIONERS: Briggs, Copelin, Longmoor, Pleger, Rudd, Smith, and Wightman. NOES, COMMISSIONERS: None ABSENT, COMMISSIONERS: Ellerbroek, and Reed. NEW BUSINESS: Commissioner Rudd made a motion that the annual report as drawn up by the Chairman be approved, seconded by Commis- sioner Pleger and carried. ADJOURNMENT: There being no further business to come before the Com- mission, Commissioner Pleger made a motion for adjournment, seconded by Commissioner Smith and carried.
