No. 627 establishing regulations for amateur radio
antennas and Item No: 8, Amendment No. 628 establishing

Commissioner Turner asked if the signs proposed for the
exterior walls facing East Bay Avenue conform with the
Sign Ordinance. Discussion followed between staff and
Commissioner Turner regarding the Sign Ordinance and
the necessity for an Exception Permit.

Rick Dayton, 224 1/2 Sapphire Avenue, Balboa Island,
appeared before the Planning Commission on behalf. of
the applicant. Mr. Dayton explained that the purpose
for the Exception Permit would be to allow more than
one sign per tenant in multi- tenant buildings; to allow
more than one directory sign in one of the proposed
buildings; and to allow more than 200 square feet of
sign area on each building.
Mr. Dayton referred to Condition No. 2 requesting that
only one wall sign or one awning sign be permitted on
any .commercial or restaurant frontage. Mr. Dayton
advised that the awning signs will be utilized as
graphic signs, and that the wall signs will be made'by
one manufacturer and applied to sign bands located on
the exterior elevations of each building.

In reply to questions posed by Commissioner Koppelman,
Mr. Dayton advised that there will only be one tenant
wall sign on the East Bay Avenue frontage of Building
"B ", and the remaining tenants will be permitted awning
signs and optional window signs.
Mr. Hewicker stated that the purpose of Condition No. 2
is to permit a pedestrian- oriented bracket sign, which
is perpendicular to the building; and a wall sign or an
awning sign, which would be a horizontal sign, visible
directly in front of a building.

FINDINGS
1. That the proposed sign program, as approved,
represents a reasonable request considering the
size of the proposed project and the number of
commercial spaces maintaining more than one
building frontage.
2. That the proposed signs maintain a unified design
which is compatible with the architecture of the
building and will serve to enhance the overall
appearance of the proposed project.
3. That the granting of this exception permit will
not be contrary to the purpose of Chapter 20.06 of
the Municipal Code, and will not be materially
detrimental to the health, safety, comfort or
general welfare of persons residing in the neigh-
borhood, or detrimental or injurious to property
or improvements in the neighborhood, or to the
general welfare of the City.

stantial conformance with the approved sign plans

Request to amend a previously approved use permit which UP2056
permitted the establishment of an auto service facility (Amended)
in the M -1 -A District. The proposed amendment includes
a request to expand the subject business into the Approved
remaining portion of the existing building and to allow Condition -
the addition of an auto body and paint service facility ally
within an enclosed building.

neighborhood or the general welfare of the City.
CONDITIONS:
1. That development shall be in substantial confor-
mance with the approved plot plan.
2. That all applicable Conditions of Approval of Use
Permit No. 2056 as adopted by the Newport Beach
Planning Commission on January 7, 1982, shall be
met.
3. That all repair, service, body and paint op-
erations shall be conducted inside the building.
4. That noise and fumes shall be contained on the
site.
5. That fire sprinklers shall be installed in the
auto repair, paint and body shop.
6. That the Planning Commission may add or modify
conditions of approval to this use permit, or
recommend to the City Council the revocation of
this use permit, upon a determination that the
operation which is the subject of this use permit
causes injury, or is detrimental to the health,
safety, peace, morals, comfort, or general welfare
of the community.
7. This use permit shall expire unless exercised
within 24 months from the date of approval as
specified in Section 20.80.090 A of the Newport

CONDITIONS:
1. That development shall be in substantial confor-
mance with the approved plot plan and floor plan.
2. That the development standards pertaining to
parking lot illumination, circulation, walls,
landscaping, utilities, and parking shall be
waived.

3. That any seating shall be incidental to the
primary take -out operation of the restaurant. A
maximum of three tables and twelve chairs shall be
permitted.
4. That no alcoholic beverages shall be sold on the
premises unless the Planning Commission approves
an amendment to this use permit.
5. That the hours of operation shall be restricted to
the hours between 7:00 a.m. and 10:00 p.m.
6. That all signs shall conform to the provisions of
Chapters 20.06 of the Municipal Code.
7. That all trash shall be stored in the building
until scheduled trash pick -up occurs.
8. That trash receptacles for patrons shall be
provided in convenient locations inside and
outside the building.
9. That the sidewalk on Marine Avenue shall be kept
clean and regularly maintained. Said sidewalk
shall be swept, vacuumed or washed in such a
• manner that any debris or waste water does not
enter the storm drain system.
10. That a washout area for the take -out restaurant
trash containers be provided in such a way as to

not into the Bay or storm drains, unless otherwise
approved by the Building Department.
11. That all mechanical equipment and trash areas
shall be screened from Marine Avenue, the alley,
and adjoining properties.
12. That a trash compactor shall be installed in
conjunction with the take -out restaurant facility.
13. That grease interceptors shall be installed on all
fixtures in the restaurant facility where grease
may be introduced into the drainage systems in
accordance with the provisions of the Uniform
Plumbing Code.
14. That the Planning Commission may add or modify
• conditions of approval to this use permit, or
recommend to the City Council the revocation of
this use permit, upon a determination that the
operation which is the subject of this use permit,
causes injury, or is detrimental to the health,

Variance No. 1126 (Public Hearing)
Request to permit alterations and additions to an
existing single family dwelling which exceeds the
maximum allowable height within the 24/28 Foot Height
Limitation District. All development will be below the
top of the curb along Ocean Boulevard. The proposal
also includes a request to exceed the maximum 1.5 times
the buildable area of the site and a modification to
the zoning Code so as to allow portions of a proposed
elevator and vestibule area and a second level deck, to
encroach 1 foot, 4 inches into a required 4 foot side
yard sexback.

Mr. Hewicker referred to Dr. Paul Johnson's letter
dated October 17, 1985, requesting that the Planning
Commission review Use Permit No. 3153. Mr. Hewicker
advised that the applicant, Mr. Alex Lovers, and the
aggrieved parties had been working towards a solution
to the problem related to the odor and fumes from the
Mucho Munchies Man Delicatessen into neighboring
businesses, but they have ceased to continue their
negotiations. The subject letter was written to the
Planning Commission based on Condition No. 12 of Use
Permit No. 3153, approved by the Planning Commission on
June 20, 1985, stating that:
"the Planning Commission may add to or modify
conditions of approval of this use permit, or
recommend to the City Council the revocation of

advised that the applicant, Mr. Alex Lovers, and the
aggrieved parties had been working towards a solution
to the problem related to the odor and fumes from the
Mucho Munchies Man Delicatessen into neighboring
businesses, but they have ceased to continue their
negotiations. The subject letter was written to the
Planning Commission based on Condition No. 12 of Use
Permit No. 3153, approved by the Planning Commission on
June 20, 1985, stating that:
"the Planning Commission may add to or modify
conditions of approval of this use permit, or
recommend to the City Council the revocation of

He said that by having the matter come back to the

said that perhaps the aggrieved parties and the
applicant may be concerned about what would happen
after a decision between them were reached, and the
applicant installed the equipment that should eliminate
the odor and fumes, but the equipment did not work
after the installation. Would the aggrieved parties
come back for more stringent requirements on the
applicant? Mr. Hewicker stated that the Planning
Commission can either set a public hearing or suggest
that staff write a letter recommending that the
interested parties continue to negotiate their
differences.
In reply to a question posed by Chairman Person, Mr.
Hewicker commented that an additional two weeks would
give staff time to formulate a letter to the interested
parties and to give the parties time to negotiate.
Commissioner Eichenhofer commented that she visited the
neighboring Dentist's office, dress salon, and beauty
salon between 2 :00 p.m. and 3:00 p.m., this date, and
that she did not notice any odor coming from the
Delicatessen.
