Request to divide 8:8 acres into 25 residential TENTA= lots. T ACT Location: Portion of Blocks 56 and 92 .of Irvine's 7-=: Subdivision, located southerly of Ford Road between MacArthur Boulevard and APPROVE Jamboree Road in the "Big Canyon" Planned Community. Zone; P -C Applicant: The Irvine Company, Newport Beach Engineer: Shuirman and Simpson, Newport Beach Owner: Same as applicant Planning Director Wilson presented the map to the Commission. Mr. Warren James of the Irvine Compan represented the applicant: There was a discussion regarding the right of way width, curb line, maximum street grades and off- street parking spaces. After a further discussion x the tentative map of Tract 7323 was approved, sub - x ject to the following, conditions: 1. That all public improvements be con- structed as required by ordinance and the Public Works Department. 2. That Section 19.16.030 of the Subdivision Ordinance regarding map scale be waived provided maps drawn to a scale of 1" = 100' are furnished to the Public Works Department. 3. That.the boundary of the final tract map be checked by the County Surveyor before being submitted to the City for approval. 4. That all grading be in accordance with grading.plans and reports approved by the Public Works Director and a qualified Soils Engineer. Upon completion of.the grading, the Civil Engineer and the Soils Engineer shall certify that the grading has been completed according to the plans and the requirements of the grading ordi- nance. That the following special conditions of approval be applied to the private street system:. a. The structural and geometric design shall be approved by the Public Works: Department. b. Construction shall be inspected by the Public Works Department and a standard inspection fee shall be paid. c. A satisfactory means of providing for perpetual operation and maintenance of the private street system shall be demonstrated prior to recordation of . the final. map. d.. Satisfactory provision for future dedication of the rights -of -way, if destred,.shall be made. e. Satisfactory provision for City util- ities.shall be made, with City rights superior to those of other utilities. 6. That a determination be made as to.whether or not the California Vehicle Code will be enforced on the private street system. 7. That easements dedicated to the City be a minimum of ten feet in width, with wider easements provided where required the .by Public Works.Department: 8. That the design and location of sewer access roads be approved by the Public'. Works Department;.the.surface shall be. accessible for its .full length to main- tenance vehicles in all weather conditions. 9. That the Subdivision Ordinance require- ments for local street widths of sixty feet of right -of -way and forty feet of paved surface be waived, and street widths be approved as shown on the tenta- tive map. 12. That the Subdivision Ordinance requirement for maximum street grades of 7 %.be waived; with steeper grades where made necessary for topographical reasons, subject to approval by the Public Works Department. 13. That Zone III water fees be paid. 14. There shall be a minimum of two parking spaces per dwelling unit provided for visitors and guests. A minimum of fifty percent of the required guest parking for frontage lots shall be provided in common areas, including both off - street parking bays and on-street-parking. These spaces shall be properly designed and located to provide fully usable and evenly distribu- ted parking throughout the subdivision. Common area parking.plans shall be sub -. mitted to the Planning Director for his review and approval. The remaining re- quired guest parking may be provided in private driveways or on site provided that., no more than one space per driveway be counted toward fulfilling the requirements. 15. That street trees shall be installed and maintained in compliance with a plan approved by the Director of Parks, Beaches and Recreation. Item 3. Request to divide 11.2 acres into ten parcels. Zone: C -O -H Applicant: The Irvine Company, Newport Beach Owner: Same as applicant. Planning Director Wilson presented the application to the Commission and stated that the Fire Chief had requested that the street name "Santa Catalina" be changed in order to avoid confusion with Catalina Drive in Newport Heights. Alternate names of Anacapa Drive and San Clemente Drive were suggested by the Irvine Company inasmuch as names of the Channel Islands are being used in this area. Planning.Director Wilson pointed out that this street as shown on the submitted map is curved whereas previous maps indicated a straight align- ment. It was noted that the City had emphasized this point to the architects and it should be taken into consideration in their plans for the new Civic Center: Mr. Wilson explained that the architects have been contacted regarding this change but as yet, the City.has not received a reply as to whether this will make a difference in the Civic. Center plans. It was noted the street could provide a direct visual connection between the shopping,center and the governmental center -- as presently shown, it does not. Mr. Stone of the Irvine Company explained that the alignment for Civic Center Drive had been moved and now provides a fixed northerly boundary for the Civic Center site.. He stated further that the specific layout of Newport Center utilizes curvi- linear street design throughout and a straight . street would be completely contrary to what they are trying.to achieve. The Commis- sion expressed concern regarding the creation of lots with less than 50 feet of width and the prob- lems in ba,c ing vehicles out onto Bayside Drive. There was,la discussion regarding cross easements, zero sid,`yard setbacks, as well as dividing the lots in;vanother manner so they would not be sub -, standard in width. Assistant City Attorney O'Neil was asked under . what circymstances the Commission legally could approve lots less than 50 feet in width. Section 19.32.010 Page 7. Conditions for Granting, were read from the Munici- pal Code. A lengthy discussion ensued during which the Commis- sion indicated that perhaps the application should be set over. Commissioner Brown stated he did not want to infer that setting the case over would mea he would vote for approval;. Commissioner Martin concurred in this observation. Commissioner Brown stated further that Assistant City.Attorney .O'Neil should interpret what is meant by "petitioning and showing why an ordinance should not be observed ". Assistant City Attorney O'Neil stated that there should be a statement of facts and.conditions sub- mitted by the applicant which demonstrates that this property is unique and sets forth the reasons why, the Commission should waive the 50 foot lot width requirement. Mr..Clemence requested a continuance until December x 3, 1970 so that he could present a plan of develop - x ment. The continuance was granted. Item 8. Request to permit the resubdivision of one parcel RESUBDI into two residential lots. VISION N3 Location: Lot 12, Block 51, River Section, lo- cated at 5101 River Avenue and 5100 APPROVE Neptune Avenue, on the westerly side of 51st Street between River Avenue and Neptune Avenue. Zone: R -2 Applicant: Mrs. Louise J. Woolsey, Newport Beach Owner: Same as applicant. The applicant, Mrs, Louise J. Woolsey, was present. It was explained that this is the last lot in the entire block to come before the Commission for, resubdivision. ADDITIONAL BUSINESS Chairman Jakosky asked if it would be possible to go back to the 20 day cut off time for filing applications as it is unfair to the City and to th applicant to expect a. decision on material which is delivered to the Commission the evening before, or even on the day of the meeting, as the' Commis- Sion does not have time to review this material properly. There was also a discussion regarding starting the meetings at 7:30 rather than 8 :00 P.M , however this did not meet with full approval. The Commission expressed the opinion that if a revisio is important enough to the applicant to be inserte into the package, then that should be cause for it to be held over to the next meeting. Planning Director Wilson presented to the Commis- sion a drawing showing the sight line contours for the Civic Center Sight Plane which will estab- lish maximum heights for buildings on a portion Motion x of the Civic Center site. All Ayes in the.City Council Chambers.. * * * * * * * * * * * * * * * * * * * * ** Planning Director Wilson presented to the Commis- sion building plans for two residences located at the corner of Acacia and Pacific in Corona del Mar submitted by Mr. and Mrs. John Mitchell, for a determination as to whether these plans constitute two or three story buildings. There was a long discussion regarding this matter and the Commissio concluded that they could not take any formal acti n as they did not have a proper application before them. On motion.of Commissioner Adkinson, seconded by Commissioner Watson, and carried, the meeting was. adjourned until 4:30 P.M. on December 3, 1970 in the City Council Chambers. .
