Place: Council.Chambers ^ Z A x o o y2 R L CALL Commissioners Present: Clemence, Copelin, Lind, Marshall,Rudd, Skinner, Steelman Commissioners Absent: Ficker, Hudson AMENDMENTS A -71 The Planning Commission considered Amendment No. 71 (proposed amendments to the Zoning Ordinance) which was returned by the City Council with the recommendation that another public hearing be held on sections relating to off - street parking and the amendment that. a use permit be required in C -1 and C -2 Districts for residential uses, hotels, motels, boarding houses and trailer courts. After hearing all the testimony at the meeting and reviewing an amendment to Section 9104.21 prepared by the Assistant City Attorney.the Commission took the following action: (a) Recommended that Section 9104.21 be amended so that off -site parking would be permitted Motion • subject to a review and approval of the build- Second x ing plans by the Planning Commission. All Ayes (b) Recommended that Section 9105.5 requiring one garage space for each of the first four family units and two off - street parking spaces, one of which must be a garage space, for each additional family unit in any dwelling group Motion x of more than four family units, be returned Second to the City Council without any change. All Ayes (c) Recommended that Section 9103.52 and 9103.62 which will.require a use permit for residential uses, hotels, motels, boarding houses and trailer courts in a C -1 and C -2 District be Motion returned to the City Council.without any Second x changes. All Ayes Representatives of the Mariners Mile group were present and the Commission advised that these proposed changes would have no effect upon their property if a special zone between the Three Arches and the Balboa Bay Club is effected as is now under consideration. 06 Presented to the Commission was a communication from Jack H. Bennett, Dell M. Malick and Kenneth C. Albright requesting that Amendment No. 76 which proposes to rezone property located north of 16th Street and Irvine Avenue from an Unclassified to and R -3 District be withdrawn. Page 1. CITY OF NEWPORT BEACH 1COMMISSIONERS rage z I The subject matter was heard before the Planning Commission at an adjourned meeting on November 5, 1959 and it was recommended that it be not zoned R -3 but R -3 -B. The applicants stated that they would rather the property remain Unclassified in order that a "planned development" could be established under use permit procedure. Motion x A motion to rescind prior action by the Commission Second x carried by the following roll call vote, to wits All Ayes A motion to withdraw Amendment No: 76 carried by the Motion x following roll call vote, to wits Second x All Ayes A -78 Presented to the Commission was a request from Austin D. Sturtevant that Amendment No. 78 initiated by him to rezone certain property located north of Wastcliff Drive and east of Irvine Avenue be reconsidered. The subject matter was heard before the Commission at an adjourned meeting on November 5, 1959 and it was • recommended by the Commission that the property be not zoned R -3 but R -3 -B. The applicant produced evidence showing that contiguous property was zoned R -3 and that the proposed new area would be adjacent to a commercial development and it would be inconsistent not to continue the R -3 zoning. After a careful consideration of the evidence on file, upon visiting the property physically and hearing Motion x testimony at the meeting, a motion was made to rescind Second x the prior action. All Ayes A motion to recommend to the City Council that the Motion x property be zoned R -3 carried by the following roll Second x call vote, to wits All Ayes A -81 Planning Commission Amendment No. 81 which proposes to amend District Map No. 26 of the Newport Beach Municipa Code so as to cause certain property located on.the southeast corner of Westcliff Drive and Irvine Avenue Motion x to be rezoned from an Unclassified to a C -N =N District Second x was recommended to the City Council for approval. Considered by the Commission was a request referred by the City Council from Charles Masters to abandon or realign an alley on lot 49, Block B, Tract 673, Corona del Mar. The subject matter was considered by the Commission on November 19, 1959 and referred to the Assistant City Attorney to determine whether the realignment of the alley would result in a resubdivision of the property and if the zoning lines would be affected between the commercial and.residential properties. The Assistant City Attorney advised the Commission that the realignment would not result in a resubdivisio nor would the zoning lines be affected. The Commission recommended to the City Council that the Motion x realignment of said alley be approved in accordance Second x with the map prepared by the Director of Public Works. All Ayes 2. Presented to the Commission was a communication from • Mrs. W. H. Prescott requesting that a filing fee of $15.00 for a use permit be returned since the applica- tion had been denied by the Commission and the City Council. Inasmuch as there had been administrative cost in the processing of the application the Commission moved that Motion x the filing fee be not returned and that said recommends Second x tion be forwarded to the City Council.
