day, December 16, 1948, with Chairman Long7,00r presiding.
Commissioners present: Baltz, Copelin, Daniell, Ellerbroek, Johnson, ROLL CALL
Longmoor, Pleger, Rudd and Wightman.
Commissioners absent: None.
Commissioner Johnson made the motion for the approval of the minutes of MINUTES
the meeting of November 18, 1948, as read, which was seconded by Commis-
sioner Rudd and carried, after which Commissioner Johnson made the motion
for the approval of the min tea of the adjourned meeting.of December 21
1948, as read, which was also seconded by Commissioner Rudd, and carried.
Final hearing upon the matter of a proposed amendment to "rdinance 525
relative to Tract 12372 Corona Highlands, and zone same as outlined in
the application of the Jennie S. Crutcher Foundation, was declared. Sev-
eral property owners were present, protesting any R -2 zoning in this'
tract, most of whom were property owners in the Shore Cliff Tract, which
is derectly across the highway from Corona Highlands, and who stressed
that the two tracts are closely related, in that when they purchased in
Shore Cliffs tract,that it was "with the understanding that both tracts
be highly residential", and that the Corona Highlands tract has access to
the private beach of Shore Cliffs, with easements set for this, and R -2
zoning in Corona Highlands would only increase the number of people and
traffic using the private beach. Those in protest included Mr. and Lars.
C. A. Perry, (o£ Shore Cliffs) and telegrams from harry and Teresa n
Brooks, Herbert F. Brown, D. V Saber, Harold E. Mitchell, I. F. Negowan,
Arthur and Adeline McKinney, 0. K. Earl Jr., !+Zary E. Brown, i4. and Mrs
Ben F. Smith, and Elmer Lipp, and, letters of protest from Mragaret B.
Lawrence and Elsie B. Toll. Ur. and Mrs. Perry presented the above named
letters and telegrams. Also appearing in protest and speaking were caul
Payne and Louis Kemlitzer. Appearing in favor were B. Z. McKinney, Att-
orney for the Crutcher Foundation, 5enneth Sampson, engineer and planner
for the Crutcher Foundation, who defended the zoning map, as proposed, as
"land use classifications are right, reasonable end good protection, even
in the zoning of Newport Beach, some areas have used the method of "trans-
ition zoning, or buffer zones ", Braden Finch, Dean Bradford, and Ralph
Hoyle. After much discussion, Commissioner Copelin made the motioni sec-
onded by Commissioner Rudd that the matter be tabled to the next meeting.
Motion carried and so ordered.
Final hearing upon the application of Dr. R. R. Hansen and Dr. H..A. Le-
Vantine, for rezoning Lots 16, 18, 20, 22, Block 732, Corona del Mar,
from R -3 to C -2, was declared, same having been tabled from the last meet-
ing for final action. Commissioner Johnson made the motion, seconded by
Commissioner Wightman that the hearing be closed, which carried, and Com-
missioner Johnson then made the motion, seconded by Commissioner Wightman
that the Commission recommend that this application be denied, which car-
ried by the following roll call vote, AYES:Baltz, �;opelin; Daniell, Eller -
brokk, Johnson, Longmoor, Pleger, Rudd, Wightman. NOES: None. ABSENT:
None.
Final hearing upon the matter of a proposed amendment to Ordinance No. 525
relative to regulating parking in C-1 and C -2 zones, was declared, and
discussion brought out the suggestion from Chairman Longmoor that this be
tabled dtntil the Commission can explore the proposed new zoning ordinance,
drafted and submitted by the Planning Consultants. Commissioner Johnson
agreed but mentioned the technicality of not permitting the matter to
lapse for a period of time longer than forty days, so Commissioner Pleger
made the motion for closing the hearing, seconded by Commissioner Wightman,
which carried, and 6onnissioner Pleger then made the motion, seconded by
Commissioner Wightman that "Planning "ommission does not desire, at this
66 time to make a recommendation on said proposed amendments to Ordinance
No. 525, Sections 7,8, and 11, for the following reasons: (1) We have
referred this to the Planning Consultants for their recommendation and
study, (2) Planning Consultants will make a complete study of the
Zoning Ordinance, now in effect, and indicate in their conversation
that all or the essential parts of these regommended amendments will
be incorporated in the new ordinance, which they are now in the process
of drafting for our consideration, and (3) we are advising you of our
action, at this time, on account of the time limit imposed upon the
ordinance for the consideration of any amendments ", which carried by
a unanimous roll call vote, AYES: Baltz, Copelin, Daniell, Ellerbroek,
Johnson, Longmoor, Pleger, Rudd, and Wightman. NOES: None. ABSENT:
None.
Hearing was declared upon the application of Mr. Walter Geldert for a
50% setback variance for Lot 49, Block A, Tract 673, @orona del 'gar,
same having been duly filed and advertised. Commissioners Pleger,
Copelin and Johnson reported as having check =d the property and area,
and approving of the granting of the variance. Commissioner Pleger
made the motion, seconded by Commissioner Wightman for the closing of
tY,e hearing, which carried, and Commissioner Pleger, seconded by Com-
missioner Baltz made the-motion for the recommendation by the Commis-
sion for the granting of this application, which carried by unanimous
roll call vote,:;AYES: Baltz, Copelin, Daniell, Ellerbroek, Johnson,
Longmoor, Pleger, Rudd and Wightman. NOES: None. ABSENT: None.
NEW BUSINESS Mr. Sam Colyer, of the Stantard f'darine Station at Balboa, appeared as
spokesman for the marine stations in Newport Beach, requesting the
matter of increased gasoline'storage for marine stations, be reopened
and reconsidered. Discussion brought out that this matter will be
considered by the Planning Consultants in drafting the new ordinance.
A-:;plication of the Southern Counties Gas Company, to the Orange County
Planning Commission, for a Distribution Station on the north side of
Bayside Drive, about 500 feet east of the intersection of Marine -Ave-
nue, in the North Newport Beach Ahea (County), was read, and Commis -
s,oner Pleger made the motion, seconded by Commissioner Daniell that
the matter be referred, as usual, to the Standing Committee composed
of `'ommissioners Johsnon, Copelin, and Rudd, for study and recommend-
ation to the County Planning Commission, on beHalf of the City Plan-
ning Uommission. Motion carried and so ordered.
Chairman Longmoor'appoi t'ed a committee of Commissioners Baltz, Eller -
broek, Pleger, Copelin, and Building Inspector "elson, to check with
the Planning " onsultants upon the matter of the proposed rezoning of
Corona Highian�zs, and also to explore the idea dna matter of future
planning for the highway, for future subdivisions.
ADJOURNMENT Commissioner Pleger ma:e the motion, seconded by Commissioner Copelin
for adjournment, which carried and so ordered.
