that the minutes of the meeting
held October 18, 1939 be
approved as written. Seconded
by Com. Estus.
Motion carried and
so ordered by the Chairman.
No regular meeting was bald
in November, due to lack of
a quorum.
HEARINGS:
VARIANCE APPLICATION
OF JOSEPH B. PARKS
Application of Joseph
B. Parks for a 75% front yard
setback variance on Lot
3, Blk 1, Sec 5, Balboa Island
was read by the Secretary.
He stated that plans had
been posted and hearing
advertised for Nov. 15, notices
of hearing having been sent
to 9 surrounding property
owners representing 11 lots.
As there was not a quorum'
present on Nov. 15, the
commission had followed the custom
of hearing those present
interested in the application.
Chairman Hopkins declared
the hearing open for
discussion.
The Assistant-Secretary
read the following state -'
ments made at the informal
hearing on Nov. 15th. -
- - - The Assistant Secretary
stated that Mr. Eames,
owner of Lot 2, Blk 1, See
5, had telephoned because
he was unable to attend
this hearing, to protest a 75%
variance. He stated, however,
that he would have no
objection to the granting
of a 50% variance.
Mr. Beardsley, attorney
for Miss Gloria Carts,
owner of Lot 1, Blk 1, Sac
5, stated that his client
strenuously protests a
5% front yard setback variance.
She would be in accord with
Mr. Eames in not objecting ;
to a 50% variance if the
house were not solidly built.
SMiss
Gartz has a substantial
investment in her property
and feels that the Boni
g ordinance was established to
protect the values of property
and should be followed
as nearly as possible.

Com. Seeger inquired if Miss Gartz had,taken ad-
vantage of the 60%ifront yard variance granted her
when her house was built.
Miss Gertz replied that she believed that the 60%
variance had been used, but it was her opinion that
this variance had been granted for an open porch which
obstructs the view of other lots very little.
Com. Seeger stated that the commission must consider
any portion of the house having a roof over it as a
part of the house and can make no discrimination as to
whether it is open or not.
Mr. Beardsley stated that Miss Gertz's house is
back 4 feet from the lot line. However, this proposed .
building on Lot 3, according to the plans, is solid and
there is more objection to allowing more than a 50%
variance for this reason. The development along the
Bay Front in this niegh orhood is of a high class nature
and for the good of all property owners, the setbacks
should be uniform. No 2ew building should be allowed to
set farther out than that established line. - - -
Plot plans for the proposed building were examined
by the commission.
Com. Patterson re orted that a survey by his dep-
artment showed that there are 4 houses in the block.
,The corner house is wit in 2 ft, of the property line,
the next house is on the property line, the lot in
question has a house on the rear of the lot and Miss
Gertz's house has a set ack of 6 ft, from the property
line. Cow. Patterson was not in favor of allowing a
variance in this instan e.
Com. Seeger statel he believed the setback on the
Gertz house to be 4 ft.
Com. Estus moved hat the variance as applied for
be denied and that Reso ution No. 161 be adopted recom-
mending that the same setback be allowed to Joseph B.
Parks on Lot 3, Blk 1, Sec 5, Balboa Island as exists
on the Gertz residence (50%) and that the same be trans-
mitted to the City Council by the Secretary as the re-
commendation of this commission and a copy filed as a
part of the minutes of this meeting. Seconded by Com.
Findlay.
Discussion:
Secretary read a letter from Milo D. Eames, ad-
joining property owner, protesting allowance of any
variance in setback requirements on Lot 3.
Com. Hopkins called attention to the fact that
Mr. Eames' telephone conversation as reported at the
previous meeting states that he has no objection to a
50% variance.
Secretary also read two letters of protest from
Miss Gloria Gertz; one stated that she protested any
variance greater than 50% and the other protested the
granting of any variance.
Chairman Hopkins inquired if anyone present wished
to protest the granting of this variance.
No objections were heard from the floor.
Cam. Seeger stated that he believed the request
of the applicant entirely reasonable. He has establish-
ed a line between the Gertz residence and the house on
the east which is a 75% variance.
No further discussion.

VARIANCE APPLICATION OF JAMES C. and JANET D. FRAIZEH
Application of James C. and Janet D. Fraizer for
a 33 -113% side yard setback variance for a portion of
the house and a 100% side yard setback variance for a
garage was read by the Secretary. He stated that plans
had been posted, hearing advertised and notices sent to
• the surrounding prrperty owners. Due to an error in the
legal description of the property in the application, a
notice of correction had been published one week previous
to this hearing.
Chairman Hopkins declared the hearing open for
discussion.
Plans and plot plan were examined by the Commission.
Cam. Findlay stated that he has inspected the pro -w
perty in question and that he considered it a reasonable
request and would not injure anyone.
Mr. Fraizer was present and stated that he had re-
quested this variance in order to make addition and im-
provements on this property. The lot is small and he
can only make the contemplated improvements by securing
the variance as applied for.
Cam. Estue moved the adoption of Resolution No.162"
recommending that a 33 -113% side yard setback variance
for a portion`of the house and a 100% side yard setback
variance for the garage be granted to James C. and Janet
D. Fraizer on Lot 1, Blk 536, Canal Section and that the
same be transmitted to the City Council as the recommends -
• tion of this commission and a copy filed as a part of the
minutes of this meeting. Seconded by Cam. Seeger.
Cam. Hopkins inquired if anyone present wished to
protest the granting of this variance.

AMENDMENT TO ORDINANCE 440 - RE: BILLBOARDS -
Secretary read a communication from the City
Council 'submitting to the Planning Commission for con-
sideration and recommendation a proposed amendment to
Ordinance 440 including billboards in the list of uses
not .permitted in R -1, R-2,, R -3, C -1 and C -2; districts.
Secretary read the proposed amendment.
It was Com. Patterson's opinion that the billboards in
Corona del Mar shnuld be eliminated.
Com. Seeger stated that he had made a survey of
Highway 101 through Corona del Mar and reported that is
less than 1 mile there are 39 large billboards. However,
in his opinion, this amendment will not eliminated
billboard. It will simply make them a non - conforming
use.
Com. Estus moved that the Secretary be authorized
to proceed with setting a date for public hearing on
this proposed amendment after consultation with the
City Attorney on the legal advertisement. 'Seconded
• by Com. Findlay.
Motion carried and so ordered by the Chairman.

COMMUNICATIONS:
Secretary read a letter from the Mill Valley Plan.
ning Commission requesting suggestions for City planning.
The letter complimented the Newport Beach City Planning
on its outstanding achievements. Secretary read his
reply to this letter and stated that he had sent the
Secretary of the Mill Valley Commission a copy of our
annual report. (Letters filed)
Secretary presented City Engineer Patterson with
a copy of the annual report. -
COMMITTEE REPORT&:
RECREATIONAL COMMITTEE -
Secretary reported his attendance, in accordance
with instructions of the commission, at the November 14th
meeting of the Orange County Planning Commission. The
Orange County Planning Commission had informed him that
the plan for the Orange County Water Park adjacent to the
City of Newport Beach im d been approved by them and re-
ferred to the Board of Supervisors. It had not been
started because of lack of funds. They had suggested'
that the Planning Commission interest other civic bodies
in this project and contact the Board of Supervisors in
regar to starting work on this project.

Secretary stated that he had presented the matter to
the Coast Association at one of their meetings and that
Body had passed a motion to urge the Board of Supervisors
to complete the Orange County Water Park..' The matter
was also presented to the Orange County Harbor Chamber
of Commerce and that Body was interested to the extent
that they wished to study the plan and suggested a joint
meeting of the Planning Commission and their Board of
Directors.
Com. Seeger moved that the Chairman arrange with
the Directors of the Chamber of Commerce a suitable
time for a joint meeting. Seconded by Com. Estus.
Motion carried and so ordered by the Chairman.
Mr. Russell Norton and Dr. P. A. +Chamberlain
representing the Coordinating Council of Newport Beach
and Costa Mesa were present.
Mr. Norton stated that they were present to find
out what recommendations the Planning Commission have
to make as to locations for play grounds in this city.
He explained that the Coordinating Council is composed
of representatives of civic organizations and one of
their principal purposes is to assist in retarding
juvenile delinquency in the city. It has been proven
that, by providing proper playground facilities and thus .
proper use of spare time, juvenile delinquency can be
eliminated. Mr. Scudder, head of the Los Angeles County
Coordinating Council has proven this by establishing
playgrounds in East -side Los Angeles, the worst part of
the city and today it is the white spot of Los Angeles.
The Coordinating Council is interested in finding'
out what plans are recommended for playground facilities
in this city and interesting the organizations represent-
ed on the Council to take some action for their realiza-
tion.
Dr. Chamberlain stated that the Coordinating Council'
is trying to help the youth movement in this city. The
Council would like to help the Planning Commission in
establishing recreational centers. The Councils idea
is to help the commission with any ideas which they think
are feasible.
Com. Patterson displayed the map which he has
prepared showing areas available for recreational centers.
Recreational needs of the city were discussed.
Chairman Hopkins suggested that Mr. Patterson's
report be accepted as a progress report and that he pro-
ceed to make a study of the different areas to suggest'
possible use for these areas as recreational parks.
Com. Estus so moved.
Seconded by Com. Patterson.
Motion carried and so ordered by the Chairman.

Com. Estus suggested that Mr. Patterson cooperate
with the Coordinating Council.
