Whereas. on the 3rd day of Novem-
ber, 1924, a petition in writing was
flied in the office of the Clerk of the
city of Newport Beach. as Clerk of
the Board of Trustees thereof, signed
by qualified electors of the city of
Newport Beach, residing in the t:r:

and being signed by more than one-
tenth of all the qualified electors re-
siding in said territory. and setting
forth a..general description of the im-
provement to be acquired, and a gen-
eral description. of, tile. exterior boun-

Whereas, the improvement to be ac-
gnfred is an improvement which the
city of Newport Beach is authorized
by law to acquire:
The Board of Trustees of the city
Of Newport Beach do ordain as fol-
lows:
Section 1. The Board of Trustees
of the city of Newport Beach, as the
Wslative body thereof. hereby de-
glares its intention to call an elec-
tion in all that certain territory with-
. in and a part of the city of Newport
Beach, which Is proposed to be form-
er} into a municipal improvement dis-
*iet, and which territory is accur-
atley described as:
Located in the city of Newport
Beach, County of Orange, State of
California, and beginning at the in-
lersection of the northeasterly line of
Surf Avenue, and the northwesterly
ifae of B Street: thence southeasterly
along the northeasterly line of Surf
Avenue to the southeasterly line of E
Street; thence southeasterly in a di-
rect line to the southwesterly corner
Of Lot "F" of Tract No. 518, as per
map thereof recorded in 3liscellone-
one Maps Book 17. pages 33. 34. 35 and
36, Records of Orange County. Calf -
.ternia; thence southeasterly along
the southwesterly and southerly lines
of Lots F. G. H. 1. and J. of the afore -

ing harbor lines. approved by the War
Department. January 18. 1917: thence
northwesterly, along the U. S. Bulk-
head Line. extending from U. S. Bulk-
head Station No. 108 to U. S. Bulkhead
Station No. 109. as said Bulkhead line
and Bulkhead stations are laid cull
and shown upon the aforesaid Map
of Newport Bay, California. showing
harbor lines. to the last mentioned
U. S. Bulkhead Station -.No. 109: thence
northwesterly in a direct line to the
northeasterly corner of Lot 7. Block
-S" of the Bay Front Section of the
Balboa Tract. as recorded in Mis-
cellaneous Maps Book 6. page 15. rec-
ords of Orange County. California;
thence westerly and northwesterly
along the northerly and northeasterly
line of the aforesaid Bay Front Sec-
tion of the Balboa Tract to its inter-
section with the northeasterly pro-
longation of the northwesterly line of
B Street; thence southwesterly along
the northwesterly line of B Street to
the place of beginning:- or as the
same may be . hereafter modified, as
provided by law, for the purpose of
submitting to the qualified electors
of said district the proposition of
authorizing the issuance and sale of
bonds of such district in the manner,
and for the purposes set forth in the;
ordinance of intention
. Section 2. The -improvement to be!

pal improvement district located in

Beginning at the intersection of the
northwesterly line of B Street and a
line. which line Is six (6) feet south-
westerly of and parallel with the
northeasterly line of Central Avenue;
thence southeasterly and easterly
along a line. which line is six (6) feet'
southwesterly of and parallel with
the northeasterly and northerly lines'
of Central Avenue, to the southerly
I� prolongation of the easterly line of
,(^L Street; thence southerly along the
, asterly line of L Street to the south -

South. Range 10 West, San Bernar-
dino Base and Meridian; thence west-
erly along the southerly line of the
last mentioned Section 35 to its inter-

(6) feet northeasterly of and parallel
with the southwesterly line of that
part of Central Avenue lying easterly
of E Street; thence northwesterly
along a line, which line is six (6) feet
northeasterly of and parallel with the
southwesterly line of Central Avenue
to its intersection with the north-
westerly line of B Street; thbuce
northeasterly along the northwesterly
line of B Street to the place of begin-
ning.
Section 3. The cost of the proposed
improvement is estimated to be $54:
.000.00, and there are no incidental ex-
penses connected therewith.
Section 4. The 2nd day of February
1925. is hereby fixed as the date upon
which an election will be called in i
said district and upon said date an
election will be called and held there-
in for the purpose of submitting and
there will be submitted to the quali-
fied voters thereof the proposition of
incurring indebtedness by the issu-
ance of bonds of said district to pay
the cost of the acquisition of the pro-
posed improvement:
A map showing the exterior boun-
daries of the said district with rela-
tion to the territory immediately con-
tiguous thereto. and a general des-
cription of the proposed improvement
are on file in the office of the Cler'.:
of the city of Newport Beach. as 1
Clerk of the legislative body of said
city. which map shall govern for all
details as to the extent of the dis-
trict.
Section 5. The hour of 7:30 o'clock
p. m. of Monday, the 22nd day of De-
cember. 1924. at the council chamber
of the Board of Trustees of the city
of Newport Beach. in the City Hall of
said city. in the city of Newport
Beach, is hereby fixed as the date.
hour and place. for the hearing of
protests.
Any person interested, objecting to
the formation of said district. or to
the extent of the said district. or to
the proposed improvement. or to the
inclusion of his property in said dis-
trict, may file written protests setting
forth such objections. with the Cleric
of the city of Newport Beach. at or
before the time set for the hearing of
said protests. at which time and
place the hoard of Trtlatees will hear.
the Petition. all protests an o i -
itions filed. and all persons appearingi
Ito object.
Section 6. The election will be a,
special election and for the purpose
of holding the election the proposed
municipal improvement district will
be and constitute one voting precinct.
and Mrs. M. D. Ady's Garage. within
!the proposed district. will be desig-
,nated as the polling place.

ed to consist of one inspector. one

Section 7. The proposition to be l
submitted to the qualified voters will I
ibp the incurring of indebtedness byl

iu the sum of $54.000.00 to pay the
cost of the acquisition of the proposed
improvement. If at the election two -
'thirds and more of all the voters vot-
ing thereat shall vote in favor of auth-
i prizing and the sale of the bonds of
the municipal improvement district in
the sum of $54.000.00 for said purpose.
then the Board of Trustees of the city
of Newport Beach sball be authorized
and empowered to issue and will is-
sue and sell the bonds of the munici-
pal improvement district in the sum
of $54.000.00 for the payment of the
cost of the acquisition of the describ-
ed improvement.
Section S. The said sum of $54:
000.00 will be represented by 54 bonds.
numbered from; 1 to 54. both inclu-
sive. each bond in the denomination
of $1000.00. all dated the 1st day of
';larch. 1925. On the 1st day of March
! 1926. Bonds No. 1 and 2 sball fall
due and be paid. and annually there-
after on the 1st day of the month
of March two additional of said bonds
in successive numerical order sball
fall due and be paid. making an an-
nual payment of $2000.00 and which
is less than one-fortieth part of the
whole amount of the indebtedness
each year.
The bonds and the money thereby
represented shall bear interest at the
rate of 6% per annum. and the inter-
est shall be paid semi - annually on the
1st day of the months of September
and March, after their date. until all
of said bonds, principal and interest.
are Paid. All of said bonds and in-
terest shall be paid at the office of the
Treasurer of the city of Newport
Beach, in said city. County of Orange.
California.
Section 9. The municipal improve-
ment district proposed to be formed
when the same is formed. shall be
known as municipal fujprovement dis-
trict No. 4 of the city of ' Newport
Beach.
Section 10. There being no news -,
paper published in the city of New -
port Beach six days a week. this Or-
dinance shall be published once a
week for two weeks, in NEWPORT
,NEWS. a weekly newspaper of gen-
eral circulation. printed. published.
and circulated in the city of Newport
Beach, and one insertion each week
for two succeeding weeks sball be
sufficient publication.
The above and foregoing Ordinance
was introduced before the Board of
Trustees of the city of Newport Beach
at a regular meeting thereof held the
3rd day of November. 1924, and duly{
passed a, a regular meeting thereof;
held on the 17th day of November.

lows: —
Section 1. Certain words here-
after used in this Ordinance are in-
tended to mean. shall mean. and at all
times and places be held and con -I
I strued to have the meaning in this
section defined. 1
"Dwelling house" shall mean any
building or structure erected for the
r purposes of human habitation, or,
I which is capable of being inhabited
by human beings as a place of anode. ,
"Business structure" shall taean:
any building or structure erected far
the purpose of having transacted or;
carried on therein any trade. p°t)-
1 fession. occupation, business. or ca!l
I ing. or which is capable of having
carried on therein any trade, orofc.:-
lion. occupation, husfness. or calling..
"I'tblic sewer" shall mean ntv
sewer in any part of the city of
Newport Beach used. cmArol!nd, er
operated. by the city of Newport
Beach, whether the same be con-
structed by said city directly. or by
assessments upon private pruperty.
Section 2. Every dwelling hops.
now..erected in the city of Newport
Beach shall within thirty days from
the date of this passage of this or -.
dinance be oonnected with the public.
sewer in the manner. at the place, un-
der the supervision of, and to the sat-
isfaction of the Superintendent of the
water system of the city of Newport
Beach. if said dwelling (louse shall be
erected within 200 feet of the public
sewer.
Section 3. Every business struc-
ture now erected in the city of New
port Beach shall. within thirty days
from the date of the passage of this
lordinance. be connected with the
i public sewer in the manner. at the
place, under the supervision of. and
to the satisfaction of the Suparin -I
tendent of the water system of the
city of Newport Beach. if said busi -i
ness structure shall be erected witil-in 200 feet of the public sewer.
Section 4. Every dwelling hones
and business structure hereafter
erected In the city of Newport Beach.!

lie sewer. shall. before it is occupied
i for any purpose, be connected with
!the public sewer. No permit sball
be issued by the building inspector
for the erection of a dwelling house-
or business structure. if the same -is
to be erected within 200 feet of the

the public sewer when the same shall
be constructed and erected. and said
suet shall be used to pay the cost
thereof.
Section 5. The owner of any dwell-
ing house or business structure who
shall neglect. fail. or refuse. for a
- period of ten days. to connect the
same with the public sewer. after
notice in writing to do so from the
Superintendent of the water system
of the city of Newport Beach. specify-
ing the place where said connection
shall be made with the public sewer.
shall be deemed guilty of a mis-
demeanor ant] upon conviction thereof
in a court of competent jurisdiction
shall be ptmished by a flue not ex-
ceeding one hundred dollars. or un-
prisonment not exceeding thirty days.
or by both such fine and imprison-
ment is the discretion of the court.
and every day during which any such
neglect. failura or refusal exists. or
takes place, shall constitute a new and
