AN ORDINANCE GRANTING PA-
CIFIC ELECTRIC RAILWAY
COMPANY, A CORPORATION,
AUTHORITY TO CONSTRUCT
AND MAINTAIN POLES AND
WIRES IN CENTRAL AVENUE
IN THE CITY OF NEWPORT
BEACH.
WHEREAS, Pacific Electric Rail-
way Company, a Corporation, now
maintains a line of Its railway sys-
tem over and along a private right-
of -way lying between the northerly
and southerly roadways of Central
Avenue in fhe City of Newport
Beach, California, using as motive
power therefor electricity, and
which railroad, is now constructed
with center pole construction; and
WHEREAS it is the desire of thel
City of Newport Beach that such
center pole construction be chang-
ed to side pole construction; and
WHEREAS, Pacific Electric Rail -
way Company has filed its applica-
tion dated December 3, 1928, for
franchise for such side pole con-
struction and maintenance of its
poles and wires for a period of fifty
years; and
WHEREAS, pursuant to said ap-
plication the City Council of the
City of Newport Beach did by Reso�
lotion No. 480 of said City, fix the
time and place for public hearing
on the application of the said Pa-
cific Electric Railway Company, for
said franchise, and directed that
jngtice be given thereof; and,
WHEREAS, notice was duly giv-
en as directed by said Resolution
and as required by law, and the
28th day of January, 1929, at the
hour of 7:30 o'clock P. M. at the
]chambers of the City Council of
j the City of Newport Beach, was
fixed as the time and place for
public hearing, opening of bids and
the awarding of said franchise;
and
WHEREAS, the public hear,(ng
was,held at the time and place ifx-
ed in said notice and all bids were
publicly opened and duly consid-
ered; and, -
WHEREAS, it appearing that the
Pacific Electric Railway Company
was the highest and best bidder and
that there were no other bids pre -
sented, or no other offers made
for said franchise, and said fran-
chise was duly struck off, sold and
awarded to the Pacific Electric
Railway Company.
NOW, THEREFORE, the City
Council of the City of Newport
Beach does ordain as follows:
SMUOn 1. That permission be
and the same is hereby granted to
Pacific Electric Railway Company I
to construct and for the period of
fifty years to maintain and operate
its trolley wires, trolley suspension,
wires, trolley feeder cables. trans-
mission lines, telephone wires and
other wires necessary or conven-
ient for the operation of its rallway,
supported upon side poles with
cross arms to be constructed ad-
Rtcent to and back of the curbs
which may be constructed, or curb
line, In Central Avenue over the
following described route, to-wit:
IIAlong the northerly side of
the northerly roadway of Cen-
tral Avenue and the southerly
side of the southerly roadway
of Central Avenue, between the
westerly side of Alvarado
Street and the easterly side of
"B" Street.
Section 2. That the center polo
,construction along the route here
tofore described may be remove[
by, the Pacific Electric Railway
Company.
Section 3. The City Clerk shall
certify to the passage of this Or
dinance and shall cause the same
to be published once in Newport
News, a weekly newspaper, printed
Published and circulated in the City
of Newport Beach.
1 hereby certify that the fore-
going Ordinance was adopted by
the City Council of the City of
Newport Beach at its regular meet-
ing thereof, held not less than five
days subsequent to the introduc-
tion of this ordinance, and that the
same was adopted at the regular
meeting held on the 4th day of
February, 1929.

The City Council of the City of
Newport Beach, do ordain as fol-
lows: i

Section 1. Ordinance of Inten-
tion No. 333 of the City of Newport
Beach, together with all proceed -
Ings had and taken thereunder, is
hereby repealed.
Section 2. Ordinance No. 342 of
the City .of Newport Beach, to-
gether with all proceedings had
and taken thereunder, Is hereby
repealed.
Section 3. All proceedings of
every nature and kind had or taken
relative to or In connection with
Municipal Improvement District.
No 6 of the City of Newport Beach,
are hereby annulled, vacated, set
aside and abandoned.
Section 4. This Ordinance shall
be printed and published once in
Newport News, a newspaper print-
ed, published and circulated in the
City of Newport Beach and shall
take effect and be in full force
thirty (30) days after its passage.
The above and foregoing Ordin -'
ante was introduced at a regular
meeting of the City Council of the
City of Newport Beach, held on
the 4th day of February, 1929, and
was finally passed and adopted on
the 11th day of February, 1929, by
said City Council at an adlourned
regular meeting thereof, by the
following vote, to -wit:
