ORDINANCE NO. 409
AN ORDINANCE AMENDING
SECTION 3, SUBDIVISION
"B" OF SECTION 6 OF OR-
DINANCE NO. 277 OF THE
CITY OF NEWPORT BEACH,
AND ADDING A NEW SEC-
TION THERETO TO BE
KNOWN AND DESIGNATED
AS SECTION 6 %.
The City of Newport Beach, by
and through its City Council do
'ordain as follows, to -wit:
SECTION 1. Section 3 of Or-
dinance No. 277 of the City of
Newport Beach is hereby amend-
ed to read as follows:
"The Superintendent of the mu-
nicipal water system shall have
full authority to employ and dis-
charge all persons necessary to be
employed by him in' the mainten=
ante and operation of the mu-
nicipal,aater system, but shall be
authorized to pay only such wages
or per diem as the City Council
may havg previously fixed and es-
tablished.
He shall also have authority to
purchase.all needed fuel, supplies
and equipment for the mainten-
ance and operation of the munici-
pal water system when the expen-
diture doss not exceed the sum of
$200.00, in all other cases the
same shall be. purchased only upon
authorization of the City Council,
and as prdvided for by law.
SECTION 2. Subdivision "B"
Of Section 6 of Ordinance No. 277
of the City, 6f Newport Beach is
hereby amended to -read as fol-
lows i'
"The minimum rates to be
charged 'and collected monthly
frdin consumers of water supplied
by the City of Newport Beach,
State of California, for water
supplied by said City, or to any
person, firm, company, association
or corporation, are hereby fixed,
determined and established as
follows:
METER RATES
First: The monthly rate for
water consumed through meters
shall be as follows:
For % inch meters, first 800
'feet or less, $1.00.
For - 3/4 inch meters, first 800
feet or less, $1.00.
For 1 inch meters, first 1100
feet or less, $1.30.
Fd'r 11/2 inch meters, first 1500
feet or less, $1.70.
Fpr 2 inch meters, first 1800
feet or less, $2.00.
For 3 inch meters, first 2800
feet Or less, $3.00.
For each additional 100 cubic
feet and up to 10,000 cubic feet,
per 100 cubic feet, $.10.
For all over 10,000 cubic feet
and up to 40,000 cubic feet, per
100 cubic feet, $.09.
For all above 40.000 cubic feet,
per 100 cubic feet, $.08.
Water used for commercial pur-
poses shall be subject to special
rates to be fixed by the City Coun-
cil under separate agreement with
the consumers.
SECTION 3. There is hereby
added to Ordinance No. 277 of the
City of Newport Beach a new sec-
tion to be known and designated
as Section 6%, and shall read as
follows:
"No service connection less than
three - fourths ( %) inch in size
shall be installed.
The fees for the installation of
water services, or for enlarging
those already in, shall be as fol-
lows:
For a three - fourths O inch
service, $15.00.
For a one inch (1 -1n.) uervice,
$25.00.
For a one and one -half inch
(11/d -in.) service, $35.00.
For a two inch (2 -1n.) service,
$65.00.
For sizes larger than two (2)
inch, or where it becomes neces-
sary to open paved street, the
actual cost of labor and material
in laying such a service and re-
placing the pavement shall be
charged plus ten per cent (10%)
for overhead. In such cases the
cost of materials and labor shall
be estimated by the Superintend-
ent and the estimated cost shall
be paid to the City Water Depart-
ment by the person applying for
such installation before the work
of connecting the main with the
'Property is begun; provided, that
whenever the e,5timated cost is
not sufficient to cover the total
expense for labor and material,
the deficit shall be charged to the'
property for which such installa-
tion was made and to the owner
thereof: provided, further, that
any excess payment shall be re-
turned to the person applying for
the installation."
SECTION 4. This ordinance is
an emergency measure and is re-
quired for the immediate preser-
vation of the public peace and
morals, the facts constituting its
urgency being as follows:
There are a great number of
people in the City of "Newport
Beach who are effected by the
terms of this ordinance, in this,
to -wit, that water rates through-
out the city will be lowered when
this ordinance goes into full force'
and effect; that there is an emer -'
gency existing at this time for a
reduction in water rates as con-
sumers generally throughout said
city are having difficulty in pay-
ing their water bills and there is
a surplus of water at this time
in the City of Newport Beach.
SECTION 5. The City Clerk
shall certify to the separate vote
on the urgency of this ordinance,
and to its passage by the vote of
five (6) members, of the City
Council of the City of Newport
Beach, and cause the same to be
published once in NEWPORT''
NEWS, a newspaper of general'
circulation in the City of Newport
Beach, and it shall thereupon
take effect.
I hereby certify that the ques-
tion of the urgency of the fore-
going ordinance was passed and
t h e foregoing ordinance w a s
adopted by a vote of five (5)
members of the City Council of
the City of Newport Beach, at its
meeting of December 12th, 1932.
