ORDINANCE NO. 435
The City of Newport Beach, by
and through its City Council, does
ordain as follows, to -wit:
SECTION 1. It is hereby de-
clared unlawful rrom and after
the 1st day of January, 1936, for
any person, firm, co- partnership
or corporation, within the corpor-
ate limits of the City of Newport
Beach to deal in, carry on, open
or cause to be opened, conduct or
cause to be conducted, either as
owner or employee, whether for
hire or not, any game of skill bal.,
tango, flasher, mechanical game,
or any game played with cards,
dice or by means of any device, for
checks, credit, gifts, tokens, prizes,
disks, merchandise or other rep-
resentative of value.
SECTION 2. It is hereby de-
clared unlawful from and after
January 1st, 1936, for any person,
firm, co- partnership or corpor-
ation, within the city limits of the
City of Newport Beach, to carry
on, conduct, open or cause to be
opened, or cause to be conducted,
either as owner or employee,
whether for hire or not, any
marble game, slot or card ma-
chine, contrivance, appliance or
mechanical device, and which is
intended to be operated or which
is operated or played by placing
or depositing therein coins, disks,
slugs or balls.
SECTION 3. It is hereby de-
clared unlawful for any person,
firm, co- partnership or corpor-
ation within the City limits of the
city of Newport Beach, to open
up, carry on or deal in any game
which shall have as its object or
one of Its objects the giving of
any prize, token, gift, disk or
other representative of value, for
the playing of said game.
SECTION 4. No license shall
be issued for any of the games
herein prohibited from and after
January 1st, 1936, and all licenses
for the games herein mentioned,
hereinafter issued by the City of
Newport Beach, shall expire as of
the 1st day of January, 1936. Said
licenses so to be issued shall be
semi - annual licenses and date as
of July 1st, 1935, and the rate
therefor shall be one -half of the
annual rate specified by Ordinance
No. 393 of the City of Newport
Beach and amendments thereto.
Section 5. This ordinance shall
never be held or construed as li-
censing or permitting the carrying
on of any unlawful trade, calling,
occupation or game, and every
such trade, calling, occupation or
game is prohibited, and no licensa
shall be granted or issued there-
for.
SECTION 6. Any person, firm,
corporation or co- partnership in
the city of Newport Beach, violat-
ing any of the terms of this ordin-
ance shall be guilty of a misde-
meanor, and shall be punished by
a fine not to exceed $300.00, or by
imprisonment in the City Jail of
the City of Newport Beach, or the
County Jail of the County of Or-
ange, not to exceed three months,
or by both such fine and impros-
onment.
SECTION 7. Any ordinances
or parts of ordinances of the city
of Newport Beach in conflict with
this ordinance are hereby specif-
ically repealed.
SECTION 8. This ordinance
shall be published once in NEW-
PORT NEWS, a newspaper of
general circulation, printed, pub-
lished and generally circulated in
the city of Newport Beach, and
shall take effect and be in force
thirty days after its final passage.

ance No. 435 was passed ai an ad .
journed regular meeting of the
City Council of the City of New-
port Beach held on the 10th day
of June, 1935, by the following
vote, to -wit:
AYES, Councilmen: Gordon,
Claire, Ellsworth, Garfield, Hilmer.
NOES, Councilmen: None.
ABSENT, Councilmen: None.
The above and foregoing Ordin-
ance No. 435 is approved and sign-
ed by me this 11th day of June,
1935.
