ORDINANCE NO. 452.

The City of Newport Beach, by
had through its City Council: 1
ordain as follows:
Section 1. It shall be unlawful
for any person to drink or con-
_ sume wine, beer, whiskey, brandy
be any alcoholic liquors or bever-
ages on the public streets, public
alleys, public sidewalks, public
parks, parking lots, public rest-
. rooms, public piers, City Bay
front properties, parked automo-
biles, vacant lots or ocean front
beaches within fifty feet of the
ocean front sidewalks, within the
corporate limits of the City of
Newport Beach.
Section 2. Any person violating
any of the provisions of this ordin-
ance shall be guilty of a misde-
meanor, and upon conviction
thereof, shall be punished by a
fine not exceeding $300.00 or by
imprisonment in the Orange
County Jail or the City Jail of the
city of Newport Beach, not ex-
ceeding 100 days, or by both such
fine and imprisonment.
Section 3. This ordinance is'
pereby declared to be an urgency
measure, , necessary for the im-
ediate preservation of the pub -
c peace, health and safety, with -
n the meaning of Section 1, of
rticle IV of the Constitution, and
therefore shall go into effect im-
mediately upon its first publica-
tion. -The facts constituting the
necesiity are as follows:
That commencing immediately
in the City of Newport Beach,
there will be large crowds of
pleasure seekers visiting said city;
that particularly during Easter
week, there will be thousands of
young high school and college men
and women visiting said city: that
unless drinking of liquor is pro-
hibited in public places as speci-
fied in this ordinance, much liquor
and alcoholic beverages will be
consumed by people visiting the
City. of Newport Beach, in sold
r'Vublic places and by reason there-
of it will become very difficult
tor too Police 'force of the city of
Qewport Beach to maintain peace
and order in said city, and to pre-
vent unlawful disturbances, un-
awful assemblies and riots; that
the drinking of liquors in the
public places above mentioned has
a tendency to corrupt the morals
of the younger generation and is
indecent and offensive to law-
abiding men and women; that in-
toxicating liquors are often pur-
chased by people of legal age for
minors who cannot ordinarily con-
eume or drink said liquors except
in public places above specified;
that empty liquor bottles are
thrown upon the public streets,
sidewalks and in the alleys in said
city, thus endangering life and
property; that in order to pre -
s.erve law and order and to protect
life and pronerty it is necessary
that this ordinance go into effect
Pt the earliest possible moment
Section 4- The City Clerk of
the City of Newport Beach shall
artify to the separate vote on the
urgency of this ordinance and its
nassage by the vote of four mem-
bers of the City Council of the
City of Newport Beach, and cause
the 'same to be published once'in
NEWPORT NEWS, a newspaper
printed and circulated in th'e'City
of Newport Beach, and upon such
nublication this ordinance shall
become immediately operative and
take full effect.
I hereby certify that the gges-
tien of the urgency of the fore-
going ordinance was passed and
the foregoing ordinance was
adopted by a vote of four members
of the City Council of the City of
Newport Beach at its regular
meeting held on the 1st day of
March. 1937, by the following vote,
to -wit:
AYES. COUNCILMEN: Gordon,
Claire. Whitson, Williamson.
NOES, COUNCILMEN: None.
ABSENT: COUNCILMEN: Gar-
field.
