HomeMy WebLinkAbout454 - Dog License Tax• • r • • ORDINANCE NO. 4464 The City of Newport Beach, by and through its City Council, does ordain as follows: Section 1. That a license tax is hereby levied on all dogs over the age of three months owned, harbored or kept in the City of Newport Beach, at the rate of One Dollar ($1.00) for each malt. neuter, or spayed female dog, and two dollars ($2.00) for each fe- male dog, per fiscal year from the to the —, payable in advance for the whole Vear or any fraction of such year. Such license tax shall be deemed a debt due the City of Newport Boas:; and can be collected by the Cliief of .Police in the name of the cjty. as any debt is collected unddi- general laws. Section 2. That it shall b° the duty of the Chief of Police to col - ,lect the licenses as provided in St!ction 1, and when so collected 'shall deliver to the person 'prying the license a metal tag wh:c'i shall be stamped with the fiscal year for which it is issued anal numbered, such tag must be at- tached to the dog for which it is issued. Any kennel having more than eleven dogs over the age, of three months shall pay a tax of thirty dollars ($30.00) a year. The location of such kennel shall be only on the approval of the Flan - ning commission or the City Council of the City of'-Newport Beach. Section 4. That it shall be un- lawful for any person having care, charge or control of any dog to be at 'large axon any bead: unless such nog is securely held by a leash or chain not exceeding six (6) feet long, and such dog may be ordered muzzled by the Chief of Police or any police officer or ordered removed from such beacii, or impounded as a public nui- not paid. It ,sliall be the duty o the Chief of police and all poice officers, upon receiving an affidavit from any person who has been bitten 'by a dog, or from any person who has witnessed such occurrence, to notify the owner, possessor or custodian of such dog, in writing, to keep such dog at all times on the property or premises where such owner, possessor or custodian resides, or on the property or premises of any person to whom the custody of such dog may be given, and to post a notice conspicuously on such premises bearing the words "Beware of Dog" in letters at least one and one -half inches high, and to securely hold said dog or : ause said dog to be securely held by a leash or other device or means, so as to prevent said dog from wandering, straying or get- ting beyond the control of its cus- todian. Section Ll. The City Clerk of the City of Newport Beach shall cause this ordinance to be pub, lished once in. NEWPORT NEWS. :1 newspaper of general circula- tion, printed, published and gener- ally circulated in the City of Newport Beach and shall take ef- fect and be in force thirty days after its :assage. The above and foregoing ordi- nance was introduced at an ad- journed regular meeting of the City Council of the City of New- port Beach held on the 19th day of April, 1937, and was finally pass- ed and adopted on the 22nd day of April 1937, by said City Coun- cil at an adjourned regular meet - ing thereof, by the following vote, to -wit: AYES, COUNCILMEN: Gordon, Cicire.
