ORDINANCE NO. 461.
The City of Newport Beach, by
and through its City Council, does
ordain as follows:
Section 1. It is hereby declared
unlawful to bathe in the waters
of Newport Bay, between Adams
Street and the intersection of
Buena Vista Boulevard with Bay
Avenue, in the City of Newport
Beach, between the hours of ele-
ven o'clock P.M. and four o'clock
A. M. of any day after this ordi-
nance shall go into force and ef-
fect.
Section 2. This ordinance is
herby declared to be an urgency
measure, necessary for the im-
mediate preservation of public
health, peace and safety, within
the meaning of Section 1 of Ar-
ticle IV of the Constitution of the
State of California, and therefore
shall go into effect immediately
upon its first publication.
The facts constituting the neces-
sity are as follows: That the water
front of Newport Bay, between
Adams Street and the intersection
of Bueno Vista Boulevard with Bay
Avenue, in the City of Newport
Beach is closely built up with resi-
dences which are generally occu-
pied during the summer months;
that these residences, at high tide,
are only a few feet away from the
water front of Newport Bay, be-
tween said streets; that the City of
Newport Beach, is a summer resort
and thousands of people from in-
land cities visit said beach during
the summer months, and many
young people, after the dance and
other public amusements have been
closed, are in the babit of taking
a swim in the waters of Newport
Bay between these points men-
tioned in this ordinance; that there
is a great deal of laughter, loud
talk and noises by these bathers
and by reason thereof the resi-
dents of the water front are unable
to enjoy their homes; that it is an,
impossibility to properly police
said water front between said
points during the hours mentioned
and many nuisances are committed
by bathers; that often, bathers
believeing that the public is a-
sleep, will bathe in the waters of
said Newport Bay in the nude;
that if an ordinance is passed
prohibiting bathing as afore said,
it will then be possible for the
police to properly police said dis-
trict and to cause arrests of bath-
ers violating the provisions of this
ordinance.
Section 3. The City Clerk shall
certify to the separate vote on
the urgency of this ordinance and
its passage by the vote of four
members of the City Council of
the City of Newport Beach, and
cause the same to be published
once in Newport News, a news-
paper printed and circulated in
the City of Newport Beach, and
upon such publication this ordi-
nance shall become immediately
operative and take full effect.
I hereby certify that the ques-
tion of urgency of the foregoing
ordinance was passed and the fore-
going ordinance was adopted by a
vote of four members of the City
Council of the City of Newport
Beach, at its meeting of June
14th, 1937.

ABSENT COUNCILMEN: Gar-
field.
