ORDINANCE NO. 472
The City of Newport Beach, by
and through its City Council. does
ordain as follows:
Section 1. Subdivision "b" of
Section 5, of Ordinance No. 471
of the City of Newport Beach is
hereby amended to read as fol-
lows: .
"NO license or permit shall be
granted to any person under the
provisions of this section until
the ice plant wherein said ice so
to be delivered and sold in the
city of Newport Beach has been
inspected by the health officer
of the City of Newport Beach,
and a certificate issued by said
health officer showing said pre-
mises to be sanitary in every
respect and the ice therein man-
ufactured free from impurities,
and possible contamination, and
further, such certificate shall
show that said plant manufactures
ice only from distilled water or
water which in the course of
manufacture is agitated as that
term is known to ice manufac-
turers, or water which is free
from impurities or contamination,
and in this connection the sale
of "White Ice" in the city of
Newport Beach is hereby pro-
hibited. A fee of 450.00 shall be
paid to the City of Newport Beach
for such inspection."
Section 2. This ordinance in
hereby declared to be an urgency
measure necessary for the im-
mediate preservation cf public
peace, health and safety. within
the meaning of Section 1 of Article
4 of the Constitution, and there-
fore shall go into effect immedi-
ately upon its first publication.
The facts constituting the neces-
sity are as follows: That on the
16th day of May, 1934, the City
Council of the City of Newport
Beach adopted Ordinance No. 471
of said City, and through in-
advertance and mistake, subdivi-
sion "b" of Section 5 of said
ordinance contained a statement
that the certificate of the health
officer of the City of Newport
Beach should show that said ice
plant manufactures ice only from
distilled. water. That distilled,
water is not generally used to
modern ice plants and such pro-
-vision would prohibit the sale of
ice in the City of,Newport Beach;
that modem ice plants use water
which has been agitated for the
manufacture of ice; that the sale
and distribution of ice is neces-
sary to the health and comfort of
the citizens of the City Of New-
port Beach and it is therefore
necessary that said subdivision
"b ". of Section 5 of said Ordinance
No. 471 be amended so as to permit
the sale of pure ice in the City of
Newport Beach.
Section 3. The City Clerk shall
certify to the separate vote on
the urgency of this ordinance and
its passage by the vote of five
members of the City Council of
the City. of Newport Beach, and
cause the same to be published
once in NEWPORT NEWS, a
newspaper printed and circulated
in the City of Newport Beach, and
upon such publication this ordi-
nance shall become immediately
Operative and take full effect
I ' hereby certify that the ques-
tion of the urgency of the fore-
going ordinance was passed and
the foregoing ordinance was
adopted by a vote of five (5)
members of the City Council of
the City of Newport Beach at its
meeting of June 6th, 1938.
