ORDINANCE NO. 475
AN ORDINANCE OF THE CITY
OF NEWPORT BEACH AMEND-
ING ORDINANCE NO. 393 OF
THE CITY OF NEWPORT
BEACH, BY ADDING A NEW
SECTION THERETO TO BE
KNOWN AS SECTION 93 -a.
The City of Newport Beach, by
and through its City Council, does
ordain as follows:
Section 1. Ordinance No. 393
of the City of Newport Beach is
hereby amended by adding a new
section thereto to be known as
Section 93 -a, and to read as fol-
lows:
"Section 93 -c. The rate of
license for operating music ma-
chines, as that term is hereinafter
defined, in any place of business
in the city of Newport Reach,
shall be $5.00 per annum, for each
music machine or phonograph in-
stalled, attached or operated in
the city of Newport Beach.
The term "music machine" as
used in this ordinance is intended
to mean and shall mean any ma-
chine which has recordings, either
music or talking, and which shall
produce music or talking, upon
the placing therein of a coin, disk,
slug or other representative of
value."
Section 2. This Ordinance is
hereby declared to be an urgency
measure, necessary for the immedi-
ate preservation of the public
peace, health and safety, within
the meaning of Section 1, of
Article IV of the Constitution, and
therefore shall go into effect im-
mediately upon its first publica-
tion. The facts constituting the
necessity are as follows:
That during the summer months
in the city of Newport Beach, there
are vast crowds of pleasure seek-
ers and summer vacationists;
that these pleasure , seekers and
vacationista cause many busi-
nesses to open up; that during
the past several weeks in the
city of Newport Beach, many
music machines and phonographs
have been installed in various
places of business in the city of
Newport Reach and there has been
no license covering the installa-
tion and operation thereof; that
there are so many music machines
and phonographs in the various
places of business in said city
that the same has become a
nuisance and 'need regulation and
licensing.
Section 3. The City. Clerk of
the city of Newport Beach shall
certify to the separate vote on the
urgency of this ordinance. and its
passage by the vote of five mem-
bers of the City Council of the
city of Newport Beach, and cause
the same to be published once
in 'NEWPORT NEWS, a news-
paper printed and circulated in
the city of Newport Beach, and
upon such publication this ordi-
nance shall become immediately
operative and take full effect.
I hereby certify that the ques-
tion of the urgency of the fore-
going ordinance was passed and
the foregoing ordinance was adopt-
ed by a vote of five' members of
the City Council of the City of
Newport Beach at its regular
meeting held on the 1st day of
August, 1938, by the following
vote, to-wit:
AYES, Councilmen: Gordon,
Whitson, Brown, Williamson.
NOES, Councilmen: None.
ABSENT, Councilmen: Claire.
