ORDINANCE NO. 502
The City of Newport Beach, by
and through its City Council. does
ordain as follows:
Section 1: Section 25 of Or-
dinance No. 393 of the City of
Newport Beach is hereby amended
to read as follows:
"Section 25. The rate of license
for conducting the business of a
park' place or station, and which
is defined to be a place or station
at which automobiles are received
for the purpose of being parked.
for hire. shall be $2.00 per annum.
provided. however. such parking
place or station shall not be on
two distinct parcels of land. and
for each such distinct parcel. a
license of $2.00 per annum shall
be paid.
In connection with this para-
graph. no license shall be issued
until the person. firm or corpor-
ation intending to operate t h e
business herein mentioned has filed
with the City Clerk a Schedule of
Prices to be charged for the park-
ing of automobiles. and in ad-
dition thereto has posted in a con-
spicuous place upon said premises
a Schedule of Prices to be charg-
ed the public for the parking of
automobiles on said parking lot
and said Schedules shall not be
changed or varied until a new
Schedule has been filed with the
City Clerk and a new Schedule
posted as aforesaid on the prem-
ises. In the event the person. firm
or corporation who shall obtain
a license to conduct a parking lot
shall fail or neglect to keep a
Schedule of Prices to be charged
the public for services posted as
aforesaid. the license of said per-
son. firm or corporation to con-
duct said business shall be can-
celled at any regular or spec:ai
meeting of the City Council."
Section 2. Section 28 of Or-
dinance No. 393 of the City of
Newport Beach is hereby amended
to read as follows:
"Section 28. The rate of license
for conducting the business of a
feed stable. horse or automobile liv-
ery or stable. for each such feed or
livery stable. $12.00 per annum."
Section 3. Section 30 of Or-
dinance No. 393 of t.:e C ty of
Newport Beach is hereby amended
to read as follows:
"Section 30. TEe rate of license
for conducting or carrying on the
business or a merry -go- round.
circular swing. scenic railroad.
ferr.s wheel. acroplane glide. swing
or other similar device or dodgem.
or anyth'ng of a similar nature.
$5.00 per month."
Sect on 4. Section 38 of Or-
dinance No. 393 of the City of
Newport Beach is hereby amended
to read as follows:
"Section 38. The rate of license
fo,, conducting the business of a
planing mill or lumber yard and
building supplies shall be $15.00
per annum."
Section S. Section 39 of Or-
dinance No. 393 of the City of
Newport Beach is hereby amender
to read as follows:
"Section 39. The rate of license
for conducting the business of a
restaurant. cafe. lunch counter.
cafeteria, s h a 11 be $12.00 p e r
annum: provided. however. no li-
cense shall be issued except upon
the recommendation of the health
officer of the City of Newport_
Beach.
In the event music or entertain-
ment is furnished patrons of a
restaurant. cafe. lunch counter. or
cafeteria. the rate of license shall
be $25.00 per annum."
Section 6. Section 5 5 o f Or-
dinance No. 393 of the City of
Newport Beach is hereby amend-
ed to read as follows:
"Section 55. The rate of license
for conducting the business of
selling new or used automobiles
shall be $12.00 per annum."
Section 7. Section 6 2 of Or-
dinance No. 393 of the City of
Newport Beach is hereby amended
to read as follows:
"Section 62. The rate of license
for the business of junk collector.
junk dealer or maintaining a junk
yard. $50.00 per annum. In this
connection. any person. firm or
corporation collecting junk from
retail. wholesale or industrial
plants shall only be required to
pay $10.00 per annum."
Section S. Section 6 5 o f Or-
dinance No. 393 of the City of
Newport Beach Is hereby repealed.
Section 9. Section 7 2 of Or-
dinance No. 393 of the City of
Newport Beach is hereby amended
to read as follows:
"Section 72. For every person.
firm or corporation who shall en-
gage in the autdmobile garage
business. the annual license tax
shall be $12.00.
Automobile garage is hereby de-
fined as and declared to be a
place where automobiles are sold.
stored or cared for. cleaned or
repaired. and where the necessary
machinery is kept for the purpose
of repairing automobiles and where
automobile accessories. gasoline.
oils and supplies are kept and
sold."
Section 10. Section 77 of Or-
dinance No. 393 of the City of
Newport Beach is hereby amended
to read as follows:
"Section 77. Every person. firm
or corporation who shall engage
in the business of contracting
grading or laying streets. side-
walks. drains or sewers in said
City shall pay an annual license
tax of $50.00."
Section 11. Section 85 of Or-
dinance No. 393 of the City of
Newport Beach is hereby amend-
ed to read as follows:
"Section 85. The rate of license
for carrying on or managing or
engaging in'the business of leas-
ing. renting or the hiring of
boats to others. for taxi service.
either as owner or operator. or as
the agent. servant or employee of
another. s h a l l be $15.00 p e r
annum."
Section 12. Section 87 of Or-
dinance No. 393 of the City of
Newport Beach is hereby amended
to read as follows:
"Section 87. The rate of license
for managing or carrying on. or
engaging in the business of re-
ceiving and transporting persons
within the City of Newport Beach.
for a consideration. in speed boats.
shall be $15.00 per annum."
Section 13. Section 88 of Or-
dinance No. 393 of the City of
Newport Beach is hereby amended
to read as follows:
"Section 88. The rate of license
for engaging iii the business of
carrying passengers on boats or
vessels from any point in the City
of Newport Beach shall be $15.00
per annum."
Section 14. Section 93a. The rate
of Ycense for engaging in or
carrying on the business of selling
at retail or at wholesale. c u t
flowers. trees. shrubs. vines.
growing flowers or plants. floral
pieces or displays. potteries con.
taining plants or flowc:s. shall be
$12.00 per annum. In this con-
nection. any retail store in the City
of Newport Beach paying a license
under the terms hereof may en-
gage in the business of selling.
at retail. cut flowers without the
payment of any additional license
therefor.
Section 15. A new section was
added to Ordinance No. 393 of
the City of Newport Beach and
made a part thereof and shall
read as follows:
"A new section. to be known as
"Section 93c ". shall read as fol-
lows:
'Section 93c. F o r each mer-
chandise vending machine oper-
ated in the City of Newport Beach
by the insertion therein of a coin
of the value of $.05 or more.
$2.00 per annum per machine: and
for merchandise vending machines
where coins are inserted of the
value of less than $.05, the sum
a $1.00 per annum per machine.'"
Section 16. Ordinance No. 393 of
the City of Newport Beach is
hereby amended by adding a new
section thereto. to be known as
"Section 93d." and shall read as
follows:
"Section 93d. All machines
known as 'penny machines' and
which are not specifically enumer-
ated or mentioned in this Or-
dinance. and where pennies are
inserted therein for service. shall
pay an annual license of $1.00 per
machine."
Section 17. Ordinance No. 393 of
the City of Newport Beach is
hereby amended. by adding a new
section thereto. to - beknown as
"Section 93e ". and shall `read as
follows:
"Section 93e. All g mes of,every
nature. description :or kind: for
which license. may be Issued in
the City of- Newport Beach. and
which are not herein specifically
enumerated. and !which shall not
give prizes. shall be $12.00 per
annum. In this connection. all
games of every nature. descrip-
tion or kind conducted in the City
of Newport Beach which shall
• offer or give prizes to the public,
shall pay a license of $35.00 per
annum."
Section 18. If any section, sub-
section, sentence, clause, or phrase
of this ordinance is hereafter for
any reason held to be unconsti-
tutional or un- enforceable, such
dec'sion shall not a f f e c t t h e
validity of the remaining portions
of this ordinance. The City Council
of the City of Newport Beach
he eby declares that it would have
passed this ordinance, and each
section, sentence, clause or phrase,
hereof, irrespective of the fact
that any one or more other sec-
tions, sub - sections, a e n t e n c e s,
clauses, or phrases be declared
unconstitutional o r unenforce-
able.
Section 19. Each and every day
or fractional part of a day that
any pursuit, trade, occupation,
avocation, employment, business
or calling in this Ordinance speci-
fied is conducted or carried on
without first obtaining a license
therefore as herein provided, shall
constitute a violation of this Or-
dinance, and any person, who, for
himself, or for any other person,
shall violate any of the pro-
visions of this Ordinance, shall,
for e a c h violation thereof, be
deemed guilty of a misdemeanor,
and upon conviction by any court
• having jurisdiction thereof, shall
be fined in a sum not more than
$200.00, or by imprisonment in
the city jail in the C'ty of Newport
Beach not exceeding twenty -five
days, or both such fine and im-
p': isonment.
Section 20. This ordinance shall
be published once in NEWPORT
BALBOA NEWS - TIMES, a news-
paper of general circulation, print-
ed and published and circulated in
the City of Newport Beach, and
this Ordinance shall take effect
and be in force from and after
¢ the 1st day of July, 1941.
The above and foregoing Or-
dinance No. 502 was passed at a
regular meeting of the City Coun-
cil of the City of Newport Beach,
held on the -19th day of May,
1941, by the following vote, to -wit:
