ORDINANCE NO. 513
The City of Newport Beach by
and through its City Council does
ordain as follows:
SECTION 1. The term "open
fire" as used in this ordinance shall
he construed to mean and shall
mean fires built in the open air and
outside of closed structures and
buildings.
SECTION 2. It shall be unlaw-
ful for any person to ignite, kindle,
start or maintain an open fire on
any public or private property
within the city limits or the City
of Newport Beach between the
hours of one hour before sunset
and one hour after sunnee on any
day.
SECTION 3. Any person violat.
ing any of the provisions of this
ordinance shall be deemed guilty of
a misdemeanor and upon convlc-
tion thereof shall be punished by a
fine not to exceed $300.00, or by
imprisonment in the City Jail of
the City of Newport Beach or the
County Jail of Orange County for
a period not exceding three (3)
months, or by both such fine and
imprisonment.
SECTION 4. This act is here-
by declared to be an urgency
measure necessary for the imme-
diate preservation of the public
peace, health and safety within the
meaning of Section 1, Article 4 of
the Constitution, and shall there-
fore go into immediate effect. The
facts constituting the necessity are
as follows: It is not known ex-
actly what form our enemies may
employ to attack us. There al-
ways exists the possibility of
"nuisance" raids by gun fire from
enemy submarines on our shores
and nearby installations; that fires
or lights not coming within the
so- called "Blackout Ordinance" of
the City of Newport Beach, might
guide the enemy to our shores on
such "nuisance" raids as afore-
said. It is therefore imperative
that an ordinance be passed at this
time prohibiting open fires on pub-
lic or private property in the City
of Newport Beach during the night
time.
SECTION 8. The City Clerk
shall certify to the separate vote
on the urgency of this ordinance
and its passage by the vote of fiva
members of the City Council of the
City of Newport Beach, and cause
the same to be published once in
the NEWPORT - BALBOA PRESS
a weekly newspaper printed and
circulated in the City of Newport
Beach, and upon such publication
this ordinance shall become imme-
diately operative and take full ef-
fect.
I hereby certify that the ques-
tion of the urgency of the fore-
going ordinance was passed and
the foregoing ordnance was
adopted by a vote of five mem-
bers of the City Council of the
City of Newport Beach at its
meeting held on the 30th day of
April, 1942.
