HomeMy WebLinkAbout514 - Fire Works & Fire CrackersORDINANCE NO. 514 The City of Newport Beach by • and through its City Council does ordain as follows: SECTION 1: It shall be unlaw- ful for any person, firm or corpo- ration to sell, display, dispose of, give away, store, keep, stock or .• discharge, fire, explode or set off any fire works or fire crackers of any description, within the in- corporated limits of the City of Newport Beach. SECTION 2: Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misde- meanor and upon conviction there- of shall be punishable by imprison- ment in the City Jail of the City of Newport Beach or the County Jail of Orange County, for a period not exceeding three (3) months, or by a fine not exceeding $200.00, or by both such fine and imprison- ment. SECTION 3: All ordinances or parts of ordinances in conflict with this ordinance are hereby specifically repealed. SECTION 4: The City Council of the City of Newport Beach here- by declares that this ordinance is • enacted in the exercise of its po- lice powers. That there is an emergency existing and that this crdinance is necessary for the im- mediate preservation of the public peace, health and safety within the meaning of Section 1, of Article IV of the Constitution of the State of California, and Subdivision C of Section 1651 of the Election Code of the State of California, and shall take effect immediately after its adoption. The facts constitut- ing the emergency are as follows: The City of Newport Beach is situated on the shores of the Pa- cific Ocean and in the very midst of an area which is of vital im- portance to the United States of America; that a state of war now exists and it is not known exactly what form our enemies may em- ploy to attack us. There always exists the possibility of nuisance raids by gun fire from enemy sub- marines on our shores and nearby installations; that the setting off of fire crackers or fire works might guide the enemy to ou. shores. It is therefore imperative that an ordinance be passed at this time prohibiting fire works • within the incorporated limits of the City of Newport Beach. SECTION 5: The City Clerk shall certify to the separate vote on the urgency of this ordinance and its passage by the vote of five members of the City Council of the City of Newport Beach, and cause the same to be published once in the NEWPORT- BALBOA PRESS a weekly newspaper printed and circulated in the City of Newport Beach, and upon such publication this ordinance shall become im- mediately operative and take full effect. I hereby certify that the ques- tion of the urgency of the forego. ing ordinance was passed and the foregoing ordinance was adopted by a vote of five members of the City Council of the City of New- port Beach at its meeting held the 18th day of May, 1942.
