ORDINANCE NO. 518
'WHEREAS, a National emer-
gency exists in the United States
and in this State and City due to
the declaration of war by the
United States, and this ordinance
is required for the immediate pre-
servation of the public peace,
health and safety in view of the
fact that there is a shortage of
metals and building materials, and
in order -to eliminate conflict with
provisions of Defense Housing
Critical List issued by the War
Production Board, Division Indus-
try Operations Housing Priorities
Branch, or any Defense Housing
Critical List which may be here-
after issued supplementing or
changing the present Defense
Housing Critical List aforesaid,
and during such emergency it is
necessary that restrictions be
changed. in regard to all ordi-
nances of the City of Newport
Beach affected by said Defense
Housing Critical List aforesaid.
NOW, THEREFORE, the City
of Newport Beach by and through
its City Council does ordain as
follows:
Section 1. All ordinances af-
fecting, or in any way relating to
the erection and construction of
houses and buildings in the City of
Newport Beach, including the
Building Ordinance, Plumbing Or-
dinance, Electrical Ordinance, Tile
Ordinance, Chimney Ordinance,
are hereby amended by adding Sec-
tions AA and BE thereto, reading
as follows:
Section AA. When any inspect-
or of the City of Newport Beach
finds and determines that a ma-
terial, manner of construction or
installation is as safe and sanitary
for use as that required by the
ordinances of the City of Newport
Beach in the erection and con-
struction, repair and re- modeling
of houses and other buildings in
the City of. Newport Beach, and
said material, manner of construc-
tion or installation complies with
standards now or hereafter pre-
scribed by the United States War
Production Board, or other auth-
orized Federal Agency, such ma-
terial, manner of construction or
installation may be used in lieu of
that required by said ordinances of
the City of Newport Beach afore-
said.
Section BB. In determining the
safety and sanitation of any pro-
posed alternative use of mater-
ials, manner of construction or in-
stallation, the authorized inspect-
ors of the City of Newport Beach
may require such physical, chem-
ical and other tests as to them or
any of them shall seem necessary
to establish acceptability under
the terms hereof. The applicant
shall pay the entire costs of such
tests.
'Section 2. This ordinance shall
cease to be in effect six months
after the termination of -the pres-
ent War. At such time all ordi-
dinances of the City of Newport
Beach amended by this ordinance
shall read as if this ordinance had
never been passed and from and
after the six months' period this
ordinance shall be of no further
force or effect for any purpose
whatever.
Section 3. This ordinance is
hereby declared to be an urgency
measure necessary for the immed-
iate preservation of the public
peace, health and safety and the
facts constituting such urgency
are ae follows:
That the United States is now
at war and certain metals and
building materials are now pro-
hibited by Federal Legislation in
the building of houses and .other
structures, by individuals, firms
or corporations; that many ordi-
nances of the City of Newport
Beach provide for the use of cer-
tain materials, metals and method
of building which are now in con-
flict with such Federal Legislation;
that in order that houses and build.
ings may be constructed and erect-
ed in the City of Newport Beach
it is necessary that the ordinances
affecting building or the erection
and construction of buildings be
immediately amended in order that
housing facilities may continue and
the City of Newport Beach meet its
obligations to the Federal Govern-
ment and provide housing for de-
fense workers.
Section 4. The City Clerk of
the City of Newport Beach shall
certify to the separate vote on the
.urgency of this ordinance and its
passage by the vote of five mem-
bers of the'City Council of the City
of Newport Beach, and cause the
same to be published once in the
NEWPORT - BALBOA PRESS, a
newspaper printed and circulated
in the City of Newport Beach, and
upon such publication this ordi-
nance shall become immediately
operative and take full effect.
I hereby certify that the ques-
tion of the urgency of the forego-
ing ordinance was passed and the
foregoing ordinance was adopted
by a vote of five members of the
City Council of the City of New-
port Beach at a regular meeting
thereof held on the 5th day of Oc-
tober, 1942, by the following vote:
AYES. Councilmen Gordon, Al-
len. Isbell, Reed, Hall.
NOES: Councilmen: None.
ABSENT, Councilmen: None.
