The City of Newport Beach, by
and through its City Council, does
ordain as follows:
SECTION 1. Section 1 of Or-
dinance 389 is hereby amended to
read as follows:
"Section 1. It is hereby declared
to be the duty of every person,
firm or corporation, to make ap-
plication to the Building Inspector
of the City of Newport Beach be-
fore moving any building or struc-
ture from outside the corporate
limits of the City of Newport
Beach into the City of Newport
Beach, and to pay, at the time of
making said application, the sum
of $500.00, and upon said appli-
cation being made and the pay-
ment of said sum cf $500.00 to the
City of Newport Beach, it shall be
the duty of the Building Insnector
of said City to inspect the building
or structure contemplated to be
moved, for the purpose of ascer-
taining whether or not the same is
free of termites, vermin and ro-
dents, and for the further purpose
of ascertaining whether or not said
building complies in all respects
with the Building Ordinances and
other ordinances of the City of
Newport Beach. If the Building In-
spector shall, upon investigation,
ascertain that said building or
structure to be moved, complies
With the Building, Ordinances and
other Ordinances of the City of
Newport Beach, and is free from
termites, vermin and rodents, it
shall be his duty to issue a permit
to said applicant to move said
building or structure into said City
of Newport Beach, and further, if
said Building Inspector shall find
that said building to be so moved
does not comply with the Building
Ordinances or other ordinances of
the City of Newport Beach, or
find that the same contains ter-
mites, vermin or rodents, he shall
refuse said permit and the sum of
$200.00 shall be retained by the
City of Newport Beach to re-
imburse said City for the recc.e -
sary tests and expenses of inspect-
ing said building as herein pro-
vided. and the balance of said per-
mit fee shall be returned to the
party making application.
SECTION 2. Ordinance 289 of
the City of Newport Beach is here-
by amended by adding a new sec-
tion thereto to be known as See-
tion .1. -a'; which said Section I -a;
shall read as follows:
"Sc,U-n 1 -a. That in agd;tion to,
making the application provided
for by .Section 1 hereof, the appli-
cant shall also furnish to the build-
ing lm: cctor complete plans and
specifications in reference to any
remodeling, rebuilding, repair, con-
struction cr reconstruction of the
building or structure .so moved
into said City, which plans and
specifications must be approved in
writing by the building inspector
of said City before said building or
structure shall be moved into said
City; and the applicant who shall
move a building or structure into
said City shall fully repair, re-
ccnstruct on proper foundations, in
accordance with applicant's plans
and specifications, said building or
stn,eture within ninety days from
and after the sar-e shall have been
placed on the ground.
SECTION S. Any person, firm
or corporation violating any of the
provisions of this Ordinance shall
be deemed guilty of a misdemeanr
or, and upon conviction thereof
shall be punished by a fine of not
exceeding $250.00, or serve thirty
(30) days in the City Jail of New-
port Beach, or County Jail of the
County of Orange, or by both such
fine and imprisonment.
SECTION 4. This Ordinance
shall be publish<d once in NEW -
PCRT BALBOA NEWS - TIMES,
a newspaper of general circulation
printed, published and circulated
in the City of Newport Beach, and
shall take effect and be in force
thirty days after its passage.
The above and foregoing Ordin-
ance was passed by the City Coun-
cil of the City of Newport Beach
at an adjourned regular meeting
thereof held on the 15th day of
October, 1945, by the following
vote, to -wit:
AYES, Councilmen: Allen Stan-
ley, Isbell, Mall.
NOES, Councilmen: None.
AIRSENT, Councilmen: Reed.
The above and foregoing Ordin-
ance is signed and approved by
me this 15th day of October, 1945.
