ORDINANCE No. 565
.AN ORDINANCE OF THE CITY
OF NEWPORT BEACH REGU-
LATING THE ISSUANCE OF
PERMITS FOR FOOD HAND.
LING BUSINESSES, AND PRO-
VIDING A PENALTY FOR
THE VIOLATION THEREOF.
The City of Newport Beach, by
sand through its City Council, does
ordain as follows:
SECTION 1. It shall be unlaw-
161 for any person, firm or corpor-
'ation owning, controlling or leas -
ing, acting as agent for, conduct-
ing, operating or managing any
restaurant, cafe, lunch counter,
cafeteria, soda fountain, ice cream
parlor, soft drink stand, fruit and
vegetable stand, grocery, meat
market, bakery, popcorn, peanut,
,or other food vending stands or
stations, or food processing or
manufacturing plants, bottling
plants, or other places or vehicles
in the City of Newport Beach
where food is prepared for sale,
sold, distributed, or displayed for
sale, to conduct or operate, or
cause or permit to be conducted
or operated in said City of New-
port Beach such restaurant, cafe,
lunch counter, cafeteria, soda foun-
tain, ice cream parlor, soft drink
stand, fruit and vegetable stand,
grocery, meat market, bakery,
popcorn, peanut or other food
vending stands or stations, or food
processing or manufacturing
plants, bottling plants or other
places or vehicles where food is
prepared for sale, sold, distributed,
or displayed for sale, or for any
person to sell, or offer for sale, or
cause or permit to be sold or of-
fered for sale, any food or drink
therein or therefrom without first
applying for and receiving from
the Health Department of the City
of Newport Beach a permit there-
of.
A permit for which application
is made under the provisions of
this Ordinance, may be granted at
any time during the year, but all
permits granted hereunder shall
expire concurrently with the city
business license issued for the cor-
responding period. A permit may
be temporarily suspended by the
health office upon violation by the
holder of any law, ordinance or
regulation governing food sanita-
tion, or revoked after a hearing
by the health officer.
SECTION 2: It shall be law-
ful for any member or employee
of the Health Department of the
City of Newport Beach to enter
upon any premises herein niention-
ed at any time for the purpose of
inspecting the same and any mem-
ber of the Health Department
may revuirr any person owning
a permit undc-r this ordinance to
produce the same for inspection.
If such inspection be refused the
pc;mit shall be forthwith revoked.
SECTION 3: That any person
violating any of the provisions of
this Ordinance shall be deemed
guilty of a misdemeaneor and
upon conviction thereof shall 'be
punishable with a fine not exceed-
ing three hundred dollars ($300),
or by imprisonment in the County
Jail of the County of Orange for
a period of not exceeding thirty
(30) days, or by both fine and
imprisonment.
PROVIDED, that this Ordin=
ance shall not apply to cigar
stands or other places or vehicles
of business where no food of any
kind or nature is offered for sale
or sold other th ^n candy or soft
drinks received in sealed packa-
ges, or boxes, or bottles where
tl:c seal or seals on said packages
or boxes are not broken prior to
sale thereof.
SECTION 4: This Ordinance
shall take effect and be in force
at the expiration of thirty days
from and after its passage, and
before the expiration of fifteen
days the same shall be published
with the names of the members
voting for and against the same,
for at least one week in the New-
port Balboa News - Times, a news-
paper of general circulation pub-
lished in the City of Newport
Beach, County of Orange, State of
California, together with the
names of the members of the City
Council voting for and against the
same.
The above and foregoing Ordin-
ance was introduced at an adjourn-
ed regular meeting of the City
Council of the City of Newport
Beach, held on the 25th day of
August, 1947, and was finally
passed and adopted on the 2nd
day of September, 1947, by the
City Council at an adjourned regu-
lar meeting thereof, by the fol-
lowing vote, to -wit:
AYES, Councilmen: Allen, Siler,
Isbell, Robertson, Reed.
NOES, Councilmen: None.
ABSENT, Councilmen: None.
