ORDINANCE NO. $96
ORDINANCE REQUIRING
COVERING AND P R O T E C-
TION OF SUMPS, WELLS,
CISTERNS, PITS, CAVES
AND OTHER EXCAVATIONS.
The City Council of the City
of Newport Beach does ordain as
follows:
SECTION 1: It shall be un-
lawful for any person as owner,
tenant or occupant of any prop-
erty within the City of Newport
Beach to maintain, or to permit
to be maintained upon his prop-
erty, any sump, pit, reservoir,
well, cesspool, cistern, cave, or
other excavation, unless the same
shall be adequately covered,
guarded or protected against the
possibility of access thereto,
except by or upon the authoriza-
tion of s u c h owner, tenant, or
occupant and, in such instances,
only for the purpose of service,
repair or u s e essential to t h e
lawful occupation or operation of
such property.
SECTION 2: Any person vio-
lating any of the provisions of
this Ordinance shall be deemed
guilty of a misdemeanor and upon
conviction thereof shall be punish-
able by a fine of not more than
Five Hundred Dollars ($500.00)2
or by imprisonment in the City
of County jail for a period of not
more than six (6) months, or by
both such fine and imprisonment.
Each such person shall be deemed
guilty of a separate offense for
every day during any portion e[

which any violation of this ordi-
nance is committed, continued or
permitted by such person, an d
shall be punishable therefor as
aforesaid.
SECTION 3: It is hereby de-
clared that this is an ordinance
for the protection of the public
health and safety and its urgency
arises from the fact that there
presently exist within the City of
Newport Beach various excava-
tions which are not adequately
covered, guarded or protected.
SECTIOIN 4: T h i s ordinance
shall be published once in t h e
Newport - Balboa Press, a news-
paper printed and published and
of general circulation in the City
of Newport Beach, and the same
shall become effective forthwith
upon its final passage.
The foregoing ordinance w a s
introduced at a regular meeting
of the City Council of the City
of Newport Beach held on the
9th day of May, 1949, and was
finally passed adopted on the
23rd day of May, 1949, at a regu.
lax meeting of the City Council
by the following vote, to wit:
AYES, COUNCILMEN: Greeley,
Robertson, Isbell, Blue, Drake.
NOES, COUNCILMEN: None.
ABSENT, COUNCILMEN: None.
