There is hereby created and set up a Park, Beach and Recreation Commission of the City of Newport Beach. Section 2421. The purpose for which the Park, Beach and -Ree- reation Commission is created is to facilitate the planning of Park and Beach developments and the planning for adequate Recreation programs utilizing to the fullest extent all types of recreation fa- cilities availab'.e in the Harbor area. Section 2422. The Park, Beach and Recreation Commission shall have the power and it shall be the duty of said Commission to make recommendations to and ad- vise the City Council of the City of Newport Beach in all matters pertaining to the creation, opera- and control of all parks, play- grounds, community recreation programs and activities. Nothing contained herein shall be construed estricting or curtailing any 1We powers of the City Council f the City of Newport Beach in its supervision and authority over property owned or controlled by the City of Newport Beach. Section 2423. The Park, Beach and Recreation Commission shah consist of nine members, all of whom, except the member ap- pointed from the Orange County Board of Supervisors and the member appointed from Newport Harbor Union High School Board of Trustees must be citizens of the City of Newport Beach and shall be appointed by the Mayon of the City of Newport Beach, which appointment shall be sub- ject to confirmation by the City Council of the City of Newport Beach. One of such members shall be appointed from the Board of Trustees, Newport Beach Elemen -: tart' Schools, or its employees, one s>-udI be-appointed from the Board of Trustees of the Newport Har- bor Union High School, or its em- ployees, one shall be appointed from the members of the City Council of the City of Newport Beach, one shall be appointed from She Orange County Board of Su- pervisors, and five members to be appointed at large. Any member whomisses attend- ing three consecutive regular meetings of the Park, Beach and Recreation Commission without a leave of absence being granted by said Commission, shall be removed by a majority vote of the remain- ing members of the Commission. The term of office of the first members to be appointed for the, Park, Beach and Recreation Com- mission shall be determined by lot so that the term of office of three members shall be for one year, the term of office for. three members shall be for two years, and the term of office for three members shall be for three years. All terms of office for the mem- bers of said Commission shall com- mence on the date of appointment) of the first members of the first commission. Any vacancies exist- ing at any time in the Park,; Beach and Recreation Commission i shall be filled by appointment by the Mayor and for the unexpired term subject to confirmation of the City Council. All members of the Commission shall serve without compensation. Any necessary expense incurred by any member of the Commission while acting in his official capa- city and upon the approval by the City Council of the City of New- port Beach may be paid by the City of Newport -Beach upon de- mand being presented therefor. No member of the Park, Beach and Recreation Commission shall serve in such capacity for more than three (3) consecutive terms of (,3) years each. Section - 2425-, Tlie Park-, Heacht and Recreation Commission shall; hold regular meetings at least once a month at a designated time and place, which shall be fixed and determined by said Commis- sion and entered upon the Minutes. i Special meetings of the Park? Beach and Recreation Commission . may be held at such times and places as the Commission shall determine, or special meetings l may be called by the Chairman of the Commission as he deems advisable. All special meetings must be called by written notice served upon such member of the Commission personally or by reg- istered mail at )cast forty -eight (48) hours before the time of such meeting. If all of the members of the Commission consent in writ- ing to the holding of such special meeting, it must be deemed legally and regularly called. A majority of the members of the Park, Beach and Recreation Commission shall constitute a quo- . rum for the_-transaction of busi-, ness of the Commission. The Com -, mission shall, at its first meet- ing, elect a Chairman, a Vice -1 Chairman and a Secretary, all of whom shall serve at the pleasure, of the Commission. The Park, Beach and Recrea- tion Qummission may adopt its own rules and regulations for the transaction of its business. The secretary shall keep a rec- ord of all proceedings of the Park, Beach and Recreation Commission, its resolution, findings and action, which record shall be a public record and copies thereof shall be filled with the City Clerk of the" City of Newport Beach. Section 2426. The Park, Beach and Recreation Commission shall, ,prior to the first of May each . year, submit to the City Council of the City of Newport Beach, through the City Manager's office. budgets showing the estimated, revenue and expenditures of &I Park, Beach and Recreation pro- gram of the City of Newport Beach, together with a detailed statement as to how and in which manner the moneys Irt• aaid- bud- get shall be expended. No expense shall be incurred by said Commis- sion unless the same is set up in t e ,� dgets s �bs eGa i by - awd O.bminission and approved by 'the City Council of the City of New- port Beach, or unless'. authority for any such expenditure shall . shall have been first obtained from the City Council of the City of Newport Beach. All purchases and contracts for expenditures must be signed by the Purchasing Agent of the City of Newport Beach. Section 2427. The Park, Beach and Recreation Commission shall cause to be prepared and filed with the City Council of the City of Newport Beach a Master Plan for the acquisition, development, I improvement and operation of parks and recreational areas, fa- cilities and programs in the City of Newport Beach. Section 2428. Nothing contained herein shall be construed as re- stricting or curtai :ing any of the powers or authority of the Cit;c Manager of the City of Newport I Beacli. as contained -in Ctrapter 3, City of Newport Beach Municipal Code, in his supervision and au- thority over property and person -, nel of the City of Newport Beach. SECTION 2: This Ordinance shall be published at least once in the Newport- Balboa Press, a newspaper of general circulation, printed and published in the City of Newport Beach and shall be- come effective thirty days after its final passage. The above and foregoing Ordi- nance was introduced at a regu- lar meeting of the City Council of the City of Newport Beach held on the 9th day of April, 1951, and was finally passed and adopt- ed on the 23rd day of April, 1951, by the following vote, to wit: AYES— Coucilmon: Finch, Ram- sey, Greeley, Blue, 'Isbell.
