AN ORDINANCE OF THE CITY
OF NEWPORT BEACH AMEND-
ING SECTIONS 9100.33 and
9106.34 OF CHAPTER VI
OF ARTICLE IX OF
THE MUNICIPAL
CODE OF
NEWPORT BEACH
The City Council of the City of
Newport Beach does ordain as
follows:
SECTION 1: That Sections
9106.33 and 9106.34 of Chapter VI
of Article IX of the Municipal
Code of the City of Newport
Beach be amended to read as
follows:
"Section 9106.33. Action by
Commission:
"(a) After the conclusion of
the public hearing the Planning
Commission shall render its deci-
sion on any variance within
thirty -five (35) days following
the close of the public hearing.
The granting of any variance,
when conforming to the provi-
sions of this section, is hereby
declared to be an administrative
function, the authority and
responsibility for performing,
which is imposed upon the Plan-
ning Commission and the action
thereon by said Commission
shall be final and conclusive ex-
cept in the event of an appeal
as hereinafter provided.
"(b) The Planning Commission
may designate such conditions
in connQetion�jrwith the variance
as it deems necessary to secure
the purpose of this article, and
may require such guarantees and
evidence that such conditions are
being or will be complied with.
"Section 9106.34. Appeal:
"(a) In case the applicant or
any person, firm or corporation is
not satisfied with the actions of
the Planning Commission, he
may within fifteen (15) days ap-
peal in writing to the City Coun-
cil.
"(b) The City Council shall set
date for public hearing and shall
post notice as set forth in Section
9106.32 (a). Notice shall also be
given to the Planning Commis-
sion of such appeal and the Plan-
ning Commission shall submit a
report to the City Council setting
forth the reasons for action taken
by the Commission, or shall be
nepresented at the meeting.
(c) The City Council shall ren-
der its decision within sixty (60)
days after the filing of such ap-
peal."
SECTION 2: This ordinance
shall be published at least once
in the Newport Harbor Ensign, a
newspaper of general circulation,
printed and published and circu-
lated in the City of Newport
&each and the same shall be in
full force and effect 30 days after
this passage.
The above and foregoing ordi-
nance was introduced at a regu-
lar meeting of the City Council of
the City of Newport Beach held
on the 26th day of November,
1956 and was. finally passed and
adopted on the 10th day of De-
cember, 1956, by the following
vote, to wit:
AYES, COUNCILMEN: Hart,
Wilder, MacKay, Stoddard,
Higbie, Ridderhof, Hill.
NOES. COUNCILMEN: None.
ABSENT COUNCILMEN:
None.
