AN ORDINANCE OF THE CITY
OF NEWPORT BEACH AMEND-
ING SECTIONS 3107, 3108, 3110
AND 3112 OF CHAPTER 1 OF
ARTICLE III OF THE MUNICI-
PAL CODE OF THE CITY OF
NEWPORT BEACH.
The City Council of the City
of Newport Beach does ordain as
follows:
SECTION 1: That Section 3107
of Chapter 1 of Article III of the
Municipal Code of the City of
Newport Beach be amended to
read as follows:
"Section 3107. Open Air Fires
Within Zones One and Two. No
person shall set fire to, ignite
or burn any material In the open
air, or in any incinerator within
Fire Zones One and Two, except
In designated beach or camp
fire areas."
SECTION 2: That Section 3108
of Chapter 1 of Article III of the
Municipal Code of the City of
Newport Beach be amended to
read as follows:
"Section 3108. Open Air Fire
Within Zone Three. No person
shall set fire to, ignite, or burn
any material In the open air, or
in any incinerator, within Fire
Zone Three at any time other
than between the hours of six
o'clock a.m. and ten o'clock a.m.
of the same day, provided, how -,
ever, that the Chief of the Fire'
Department, upon application
thereof, may issue a written per.
mit for the burning of material'
in the open air or In any Incin.
erator after ten o'clock a.m."
SECTION 3: That Section 3110
of Chapter 1 of Article III of the
Municipal Code of the City of
Newport Beach be amended to
rAd as follows:
"Section 3110. Burning Refuse
in Open Air Fires. No building
refuse, manufacturing and shop
refuse shall be burned in open
air fires or incineraters, except
the burning of only untreated
wood and /or untreated paper
products, provided that such
burning Is no closer than one
hundred feet from any structure.
Prior to such burning, written
permits must be obtained from
the City Fire Department and
the Orange County Air Pollution
Control District"
SECTION 4: That Section 3112
of Chapter 1 of Article III of the
Municipal Code of the City of
Newport Beach be amended to
read as follows:
"Section 3112. Camp Fires. No
beach or camp fires shall be
made, set or maintained at any
place within the City of Newport
Beach, except as follows:
"At areas where proper con-
tainers are provided for such
fires by the City and where City
signs are plainly posted indicat.
Ing such fires are permissible.
"Beach or camp fires must be
within the confines of the fire
containers provided by the City.
"Such beach or camp fire areas
shall be designated by the City
Manager, subject to the recom.
mendation of the Park, Beaches
and Recreation Commission."
SECTION 5: This ordinance
shall be published at least once
in the Newport Harbor Ensign,
a newspaper of general circula.
tion, printed and published and
circulated in the City of Newport
Beach and the same shall be in
full force and effect 30 days after
this passage.
The above and foregoing ordi-
nance was introduced at a regu.
lar meeting of the City Council
of the City of Newport Beach
held on the 11th day of March,
1957, and was finally passed and
adopted on the 25th day of
March, 1957, by the following
vote, to wit:
