ORDINANCE NO- 841
AN ORDINANCE OF THE CITY OF NEWPORT BEACH,.,
CALIFORNIA, ORDERING, CALLING, PROVIDING FOR
AND GIVING NOTICE OF A SPECIAL MUNICIPAL
ELECTION TO BE HELD IN THE CITY OF NEWPORT
BEACH, CALIFORIA, ON THE 8TH DAY OF APRIL,
1955, FOR THE PURPOSE OF SUBMITTING TO THE
QUALIFIED VOTERS OF SAID CITY PROPOSITIONS
TO INCUR BONDED INDEBTEDNESS BY SAID CITY
FOR CERTAIN MUNICIPAL IMPROVEMENTS, AND
CONSOLIDATING SAID ELECTION WITH THE GEN-
ERAL MUNICIPAL ELECTION TO BE HELD ON SAID
DATE.
WHEREAS, the City Council of the City of Newport Beach,
California, did on the 10th day of February, 1958, by a vote of at
least two - thirds of the members of said City Council, adopt Resolu-
tion No. 4747, entitled "Resolution of the City Council of the City
of Newport Beach, California, determining that the public interest
and necessity 'demand the acquisition and construction of certain
municipal improvements, and making findings relating thereto,"
which said resolution was duly signed and approved by the'Mayor
of said City and attested and certified by the City Clerk of said
City;
NOW, THEREFORE, the City Council of the City of Newport
Beach DOES ORDAIN as follows:
Section 1. That a special municipal election be held, and the
same is hereby called to be held, In the City of Newport Beach,
I California, on the Sth day of April, 1958, for the purpose of sub -
mitting to the qualified voters of said City four propositions of
incurring indebtedness and issuing bonds of said City therefor, in
the amounts hereinafter set forth, and for the objects and purposes
set forth in said resolution and hereinafter stated -
Section 2. That the object and purpose for which each of said
indebtedness is to be incurred and,bonds issued therefor are as
follows:
PROPOSITION A — POLICE BUILDING BONDS:
The acquisition and construction by the City of Newport
Beach of a certain municipal improvement, to wit: Additions
to the Police Department Wing of the City Hall, including the
acquisition of all furniture, fixtures, furnishings, equipment
and other property necessary therefor.
PROPOSITION B - FIRE FIGHTING BONDS:
The acquisition and construction by the City of Newport
Beach of a certain municipal improvement, to wit: replace-
Mentz of the fire fighting system of said city as follows: (1) a
new fire station to serve the Central Newport, Balboa and
Balboa Peninsula area, of the City of Newport Beach, replac-
ing present fire station No- 1, including the acquisition of land,
.furniture, fixtures, furnishings, equipment and other property
necessary therefor, and (2) the acquisition of a fire engine.
to replace fire engine No. 4 serving Balboa Island and nearby
mainland areas-
PROPOSITION C — STREET IMPROVEMENT BONDS:
The acquisition and construction by the City of Newport
Beach of a certain municipal improvement, to wit: street im
provements in the city in the triangular area bounded by 32nd
Street, Balboa Boulevard and Newport Boulevard, including
the widening of existing streets and the construction of new
streets, together with the acquisition of land, easements, rights
of way and other property necessary therefor.
PROPOSITION D — CORONA DEL MAR.PUBLIC
LIBRARY BONDS: -
The acquisition and construction by the City of Newport
Beach of & certain municipal improvement, to wit: a public
library in Corona del Mar, together with the planting and
landscaping of grounds, Including the acquisition of- all furni-
ture, fixtures, furnishings and other property necessary there-
for.
Section 3. That the estimated cost of tife municipal Improve-
ment described in Proposition A in Section 2 hereof is the sum of
$150,000 and that the amount of the principal of the indebtedness to
be incurred therefor is the sum of $150,000- The estimated cost of
said municipal improvement includes any or all of the following:
ja) legal or other fees incidental to or connected with the authori-
zation, issuance and sale of the bonds, and (b) the costs I of print-
ing the bonds and other costs and expenses incidental to or con-
nected with the issuance and sale of the bonds -
That the estimated cost of the municipal improvement describ-
ed in Proposition B in Section 2 hereof is the sum of $150,000 and
that the amount of the principal_ of the indebtedness to be incurred
'therefor is the sum of $150,000- The estimated cost of said Muni-
cipal improvement includes any or all of the following[ (a) legal !
for other fees incidental to or connected with the authorization,
issuance and sale of the bonds, and (b) the costs of printing the
bonds and other costs and expenses incidental to or connected with
the issuance and sale of the bonds.
That the estimated cost of the municipal improvement describ-
ed in Proposition C in Section 2 hereof is the sum of $310,000 and
that the amount of the principal of the indebtedness to be incurred
therefore IS the sum, of $310,000: The estimated cost of.said munici-
pal improvement includes any or all of the following: (a) legal or
other fees incidental to or connected with the authorization, is-
suance and sale of the bonds, and (b) the costs of printing the
'bonds and other costs and expenses incidental to or connected with
the issuance and sale of the bonds. -

that the amount of the principal of the indebtedness to be incurred
therefor is the sum. of $140,000. The estimated cost of said mutd.

s and other sale of the bonds, and (b) the costa of printing the
costs and expenses incidental to or connected with
ssuance and sale of the bonds.
I Section 4. , That the maximum rate of interest to be paid m
any indebtedness incurred for any of the purposes stated in this
ordinance shall not exceed six per cent (6^/o) per annum, payable
annually for the first year and semi - annually thereafter.
Section S. That if any of the propositions for the incurring
of bonded indebtedness so submitted receives the requisite number
-of votes, to wit, two - thirds of the votes of the qualified electors
voting on said proposition, bonds of said City, in not exceeding
the principal amount stated in such proposition, shall be issued and
sold for the object and purpose set forth in said proposition.
Section 6. That the polls for said election shall be opened at
seven o'clock, A.M., of the day of said election and shall remain
open continuously from said time until seven o'clock, P.M., of the
1 same day, when said polls shall be closed, except as provided in
Section 5734 of the Elections Code of the State of California.
Section 7. That on the ballots to be used at said special e16r-
tion in addition to any other matters required by law, there Shall
be printed substantially the following:

STAMP; NEVER WITH PEN OR PENCIL. -
(ABSENTEE BALLOTS. MAY' BE MARKED. WITH PEN
AND INK OR PENCIL.)
INSTRUCTIONS TO VOTERS
To vote on any measure, stamp a cross ( +) in the voting
square after the word "YES" or after the word "NO ". All
marks, except the cross (-4-) are forbidden. All distinguishing
marks or erasures are forbidden and make the ballot void.
If you wrongly stamp, tear or deface this ballot, return it
to the inspector of election and obtain another.
On absent voter ballots mark a cross ( +) with pen or
pencil.

Section 8. A cross ( +) placed in the voting square after the
word "YES " in the manner hereinbefore provided shall be counted '
In favor of the adoption of a proposition. A cross ( +) placed in
the voting square after the word "NO" in the manner hereinbefore
provided- shall be counted against the adoption of a proposition.
Section 9. That the special municipal, election hereby called
shall be and is hereby ordered consolidated with the general muni-
cipal election to be held in said city on Tuesday, the 8th day of
April, 1958, and such elections shall be held in all respects as if
'there were only one election, and only one form of ballot shall be,
used thereat. The, precincts, polling places, and officers of election
for this special municipal election shall be the same as those pro-
vided for said general municipal election, and said precincts, polling
'places and officers of election are set -forth in,the resolution pro-
viding for said general municipal election, to wit: Resolution No.
4746, adopted February 10, 1958.
Section 10. That except as .otherwise provided in this ordi-
ance, the election called hereby shall be conducted as provided by
law for other municipal elections in said City.
Section 11. That the City Council of said City shall meet at
its usual place of meeting in the City Hall on Tuesday, the 15th
day of April, 1958, at 7:30 o'clock, P.M., of said day, and proceed
to canvass the election returns and declare the result of said
election.
Section 12. That the City Clerk shall certify to the passage
and adoption of this ordinance by a vote of at least two - thirds of
all of the members of the City Council of said City and shall cause
said ordinance to be published once a week for two consecutive
'weeks in the NEWPORT HARBOR NEWS- PRESS, a newspaper
of general circulation in said City published leas than six days a
week in said City. No other notice of such election need be given.
Section 13. This ordinance shall take effect upon its adoption.
ADOPTED, SIGNED AND APPROVED this 24th day of
February, 1958. • -
