ORDINANCE NO. 870
AN ORDINANCE OF THE
CITY OF NEWPORT BEACH
REPEALING SECTION 8509
AND AMENDING SECTIONS
8521, 8522 AND 8523 OF THE
NEWPORT BEACH MUNICI.
PAL CODE RELATING TO
SIGNS AND BILLBOARDS.
The City Council of the City
of Newport Beach does ordain as
follows:
SECTION 1: Section 8509 of the
Newport Beach Municipal Code
is repealed.
SECTION 2: Section 8521 of the
Newport Beach Municipal Code
is amended to read:
"SECTION 8521. Written
Permit. No person shall erect,
construct or maintain any
billboard upon any premises
in the City without the writ.

SECTION 3: Section 8522 of the
Newport Beach Municipal Code
is amended to read:
"SECTION 8522. P e r m i t
Procedure. (a) Application.
To obtain a permit, the ap-
plicant shall first file an ap-
plication therefor in writing
with the Department of
Building and Safety on a
form to be provided by the
department. Every such ap-
plication shall:
1. Identify and describe
the billboard to be con-
structed pursuant to the
permit.
2. Describe the premises
on which the billboard is to
be placed, by lot, block,
tract or house number and
street address, or similar
description that will readily
identify and definitely lo-
cate the proposed billboard.
3. Show the use or oc-
cupancy of the premises.
4. Be accompanied by
plans and specifications as
required in subsections (b)
- and (c) of this section.
5. State the valuation of
_the proposed billboard.
6. Be signed by the ap-
plicant or his authorized
agent, who may be required
to submit evidence to in-
dicate such authority.
7. ,Show such other in-
formation as may be re-
quired by the Director of
Building and Safety.
(b) Plans and Specifica-
tions. With each application
for a permit, the applicant
shall submit plans and spe-
cifications.
(c) Information Required.
Plans and specifications
shall be drawn to scale and
shall be of sufficient clarity
to indicate the nature, size
and construction of the bill-
board proposed and show in
detail that it will conform
to the provisions of the Mu-
nicipal Code, the Uniform
Building Code of the City,
and all other relevant laws,

SECTION 4: Section 8523 of the
Newport Beach Municipal Code
is amended to read:
"SECTION 8523. Enforce-
ment. The enforcement of
this Chapter shall be under
the direction of the Director
of Building and Safety and
the Police Department"
SECTION 5: Emergency Ordi.

This Ordinance is declared by
the City Council to be necessary
as an emergency measure for
preserving the public peace,
health and safety and shall take
effect and be in force upon its
adoption. The reasons for the
urgency of this ordinance are:
The specific provisions of the
Newport Beach Municipal Code
relating to billboards, which by
definition include signs and oth-
er structures erected for adver-
tising purposes, are obsolete and
have proved to be unsatisfactory
in their application with the in-
creased commercial activity in
the City. The provisions are sub-
ject to the interpretation that a
permit is not required for the
construction of some signs on

some premises. If signs are con-
structed in the City without a
permit first being obtained, haz-
ardous conditions will result
from the construction of struc-
tures that are unsafe because of
improper design, erection and
construction and from the use of
unsatisfactory materials. It is ur-
gent that the public safety be
preserved by making this Ordi-
nance effective immediately.
SECTION 6: Publication. This
Ordinance shall be published
once in the Newport Harbor En-
sign, a newspaper of general
circulation, printed and pub-
lished in the City of Newport
Beach.
This Ordinance was introduced
and adopted as an emergency
ordinance at a regular meeting
of the City Council of the City
of Newport Beach held on the
22nd day of December, 1958, by
the following vote, to wit:
AYES, COUNCILMEN: HART
LORENZ SOMERS, KINGSLEY,
ATKINSdN, HIGBIE, STODDARD.
NOES, COUNCILMEN: NONE.
ABSENT COUNCILMEN: NONE
