HomeMy WebLinkAbout873 - SignsORDINANCE NO. 873 AN ORDINANCE OF THE CITY OF NEWPORT BEACH REPEALING CHAPTER 5 OF ARTICLE VIII OF THE NEW- PORT BEACH . MUNICIPAL CODE AND ENACTING A NEW CHAPTER 5 OF AR- TICLE VIII RELATING TO - SIGNS. The City Council of the City of Newport Beach does ordain as follows: SECTION .1: Chapter 5 of Ar. ticle VIII of the Newport Beach Municipal Code is repealed. SECTION 2: A new Chapter 5 is added to Article VIII of the Newport Beach Municipal Code to read: "Chapter 5 SIGNS SECTION 8500. Purpose and Scope. The purpose of this Chap- ter is to provide minimum stan- dards to safeguard life, health,. property and public welfare by regulating and controlling the design, quality of materials con. struction, location, electrification and maintenance of all signs and sign structures in the City. - The provisions of this Chapter are not intended to modify any of the provisions of the Charter, Municipal Code, ordinances or special codes. SECTION 8501. Enforcement. (a) Authority. The Building Official is hereby authorized and directed to enforce all the pro- visions of this Chapter. (b) Right of Entry. No per- son shall refuse the Building Of- ficial or his duly authorized rep - presentatives permission to en- ter any building, structure, or premises in the City at any rea- sonable time to perform any duty imposed upon him by this Chapter. (c) Board of Adjustments. The City Council shall appoint a Board of Adjustments to consist of three (3) members. The terms of the members of the Board of _ - Adjustments shall be determined by the City Council and the members shall be subject to re- moval by the City Council. The Board of Adjustments shall have the authority and duty to perform the following functions: 1.To interpret the provisions of this Chapter at the request of the Building Official or when a written appeal from a de- cision of the Building Official is filed with the Board. 2.. To issue Exception Permits as provided in this Chapter. (d) Procedure for Exception permits. 1. Application. Application for an Exception Permit shall be made by the property owner or by the less- ee if approved by the property owner in writing on a form prescribed by the Board of Adjustments and shall be ac- companied by a fee of Twen. ty-Five Dollars ($25.00). The application shall be ac. companied by a statement, plans and evidence showing that there are exceptional or extraordinary circumstances applying to the location, erec. tion, and use of the proposed sign, which circumstances or conditions do not apply gen- erally to signs in the same district. 2. Public Hearings. No public hearing need be held thereon, provided that the Board of Adjustments may hold any hearings it deems necessary. In case- a public hearing is deemed necessary, notice of such hearing shall be given at least ten (10) days prior to such hearing by one pub- lication in a newspaper of general circulation in the City and by ordinary mail to all property owners whose names and addresses appear on the latest adopted tax roll as owning property within a distance of three hundred (300) feet from the exterior boundaries of applicant's property. Where a public hearing is deemed necessary by the Board of Adjustments, it may require the applicant to fur- nish the Board of Adjust- ments a certified list of prop- erty owners owning the prop. erty located within three hun- dred (300) feet of the exter- ior boundaries of applicant's property, accompanied by an ORDINANCE No. 873 — Page 1 additional fee of Fifteen Dol- lars ($15.00). If no such list of owners is furnished by the applicant, the additional fee shall be Twenty -Five Dollars ($25.00). 3. Action by Board of Adjust- ments. The Board of Adjustments may designate such condi- tions in connection with the Exception Permit as it deems necessary to secure the pur- poses of this Chapter and may require such guarantees and evidence that such conditions are being or will be complied with. In cases where the Ex- ception Permit is refused, the Board of Adjustments shall state its reasons for such re- fusal. Exception Permits shall not become effective for fif- teen (15) days after being granted and, in the event ap- peal is filed, said permit shall not become effective until a decision is made by the City Council on such appeal. 4. Appeal. In case the applicant or any other person is not satisfied with the action of the Board of Adjustments, he may with. in fifteen (15) days appeal in writing to the City Council. SECTION 8502. Prohibitions. No person shall erect, con- struct, enlarge, alter, repair, move, improve, remove, convert, demolish or equip any sign or sign structures in the City, or cause or permit the same to be done, contrary to or in violation of any of the provisions of this Chapter. Any person violating any of the provisions of this Chapter shall be deemed guilty of a sep- arate offense for each and every day or portion thereof during which any such violation is com- mitted, continued, or permitted. SECTION 8503. Definitions. For the purpose of this Chapter, cer- tain abbreviations, terms, phrases, words and their deriva- tives shall have the meanings herein assigned to them unless from, the context it appears that a' different meaning is intended. . SECTION 8504. Approved Plas- ,tic Material. Plastic material which the Building Official has ORDINANCE NO. • found to be suitable functionally for the purpose for which it is offered, which burns no faster than two and one -half (2Y2) inches per minute in sheets six- ty- thousandths of an inch (0.060 ") in thickness when tested in accordance with U.B.C. Stan- dard No. 52 -2, or which is not consumed in less than two (2) minutes when tested in accord- ance with U.B.C. Standard No. 52 -3, the thickness of the plastic material to be determined by U.B.C. Standard No. 52 -4. (See Plastic Material). SECTION 8505. Building Line. The setback line established by ordinance beyond w h i c h no building may extend. A building line may be a property line. SECTION 8506. Building Offi. cial. The Director of Building and Safety or other officer or person charged with the admin- istration and enforcement of City regulations pertaining to build- ings and structures or his duly authorized deputy. SECTION 8507. Combination Sign. Any sign incorporating any combination of the features of ground, projecting and roof signs. Each portion of a sign which is subject to more than one clas- sification shall meet the require- ments for the classification to which such portion is subject. SECTION 8508. Combustible Material. Wood, or materials not less combustible than wood. SECTION 8509. Display Sur- face. The area made available by the sign structure for the pur- pose of displaying the advertis- ing message. SECTION 8510. Electrical Sign. Any sign illuminated by electric lighting devices which are fas- tened to the surface or mounted on the interior of the sign. SECTION 8511. Ground Sign or Pole Sign. Any sign which is supported by one or more up- rights, poles, or braces in or upon the ground which are not a part of any building. SECTION 8512. Incombustible Material. Any material which will not ignite at, or below, a temperature of 1,200° Fahrenheit during an exposure of five (5) minutes, and which will not con - 873 — Page 2 0 tinue to burn or glow at that temperature. Tests shall be made as specified in U.B.C. Standard No. 4 -1. SECTION 8513. Marquee. A permanent roofed structure at- tached to and supported by a building and projecting over public property. SECTION 8514. Plastic Mater- ial. Material made wholly or principally from standardized plastics listed and described in U.B.C. Standard No. 52 -1. (See Approved Plastic Material.) SECTION 8515. Nonstructural Trim. The molding, battens, caps, nailing strips, latticing, cutouts or letters and walkways which are attached to the sign struc- ture. SECTION 8516. Projecting Sign. A sign, other than a wall sign, which projects from and is sup- ported by a wall of a building or structure. SECTION 8517. Projection. The distance by which a sign extends over public property or beyond the building line. SECTION 8518. Roof Sign. A • sign erected upon or above a roof of a building or structure. SECTION 8519. Sign. Any media, including their structure and component parts, which are used or intended to be used out - of -doors to attract attention to the subject matter for advertis- ing, directional or informational purposes. The area of a sign shall mean the space enclosed by the outer dimensions of the sign, or, if there is no border, the area shall be the space en- closed by sets of parallel lines containing the wording or im- ages composing the sign. SECTION 8520. Sign Structure. The sign, and the supports, up- rights, braces and framework of the sign. SECTION 8521. Structure. That which is built or constructed, an edifice or building of any kind, or any piece of work artificially built up or composed of parts - - joined together in some definite _ - manner. SECTION 8522. Temporary _ Sign. Any sign, banner, pen - nant, valance or advertising dis. play, constructed of cloth, can - vas, -light fabric, cardboard, wall- - ORDINANCE NO r 1 LJ board, or other light materials, with or without frames, intended to be displayed for a limited per- iod of time only. SECTION 8523. Uniform Build. ing Code. The latest publication of the Uniform Building Code, Volume 1, published by the In- ternational Conference of Build. ing Officials, adopted by the City of Newport Beach. SECTION 8526. U. B. C. Stan- dards. The latest publication of the Uniform Building Code Stan- dards, known as Volume III, Uni- form Building Code, published by the International Conference of Building Officials, adopted by the City of Newport Beach. SECTION 8525. Wall Sign. Any sign attached to, erected against or painted upon the wall of a building or structure, the face of which is in a single plane parallel to the plane of said wall. SECTION 8526. Horizontal Wing Sign. Any projecting sign consisting of one (1) face more or less parallel to the face of the building or structure to which it is attached and two (2) or more connecting faces attached to and forming an angle with the wall to which said sign is attached. SECTION 8527. Wind Sign. A series of similar banners or ob- jects of plastic or other light ma- terial which are fastened toget- her at intervals by wire, rope, cord or string, designed to move and attract attention upon being subjected to pressure by wind or breeze. SECTION 8525. Horizontal W' Sign. Any projecting sign con- sisting of two (2) faces back to back but not parallel to each other. SECTION 8529. Moving Sign. Any advertising structure which has any visible moving parts, visible revolving parts or visible mechanical movement of any description, except clocks. SECTION 8530. Permit Re. quired. No person shall erect, re- erect, construct or perform struc- tural alterations on any sign which has a value in excess of Twenty Dollars ($20.00) without first obtaining a permit for the same from the Building Official. Application Application for a sign permit shall be made in writing upon forms furnished by the Building Official. Such application shall contain the location by street and number of the proposed sign structure, as well as the name and address of the owner and the sign contractor or erector. The Building Official may re- quire the filing of plans or other pertinent information where in his opinion such information is necessary to insure compliance with this Chapter. No permit shall be issued for any sign and no person shall cause or permit a sign to be con- structed, installed, or erected which does not comply with all the provisions of this Chapter or which has less horizontal or ver- tical clearance from energized electric power lines than pre- scribed by the California Penal Code Section 385, the regulations of the California Public Utilities Commission, and the orders of the Division of Industrial Safety, State of California. SECTION 8532. Exemptions. (a) The following signs shall not re- quire a sign permit: 1. Real estate signs not ex- ceeding twelve (12) square feet in area which advertise the sale, rental, or lease of the premises upon which said signs are located. 2. Professional name plates not exceeding two (2) square feet in area. 3. Bulletin boards not over twelve (12) square feet in area for public, charitable, or religious institutions when the same are located on the premises of said institutions. 4. Signs denoting the archi- tect, engineer or contractor when placed upon work un- der construction and not ex- ceeding twelve (12) square feet in area. 5. Memorial signs - or tablets, ,. names of buildings and date of erection when cut into any masonry surface, or when constructed of bronze or other - incombustible materials. Replacing copy in theatre marquees and similar signs specifically designed for the use of replaceable copy. 8. Painted window signs. (b) These exemptions shall not apply to electrical signs. (c) These exemptions shall not relieve the owner of the sign from responsibility for its erec- tion and maintenance and com- pliance with the provisions of this Chapter or any other law or ordinance regulating the same. Cd) Painting, repainting, or cleaning of an advertising struc- ture shall not be considered an erection or alteration which re- quires a sign permit unless a structural change is made. SECTION 8533. Prohibitions. No person shall place, maintain or display upon or in view of any highway or street any un- official sign, signal or device or any sign, signal or device which purports to be or is an imitation of, or resembles, an official traf- fic sign or signal or which at- tempts to direct the movement of traffic or which hides from view any official traffic sign or signal. No person not authorized shall erect or maintain any device which directs a beam of light in a flashing sequence toward any street or highway, nor shall any person erect or maintain any electrical advertising sign or similar device that interferes with the visibility of any official traffic control device or warning signal. The following types of signs are prohibited: 1. Flashing or animated elec- trical signs 2. Wind signs 3. Moving signs 4. (c) Seismic Loads. Signs and sign structures shall be designed and constructed to resist seismic forces as provided in Section 2312, Appendix, of the Uniform Building Code. (d) Combined Loads. Wind and seismic loads need not be combined in the design of signs or sign structures; only that loading producing the larger stresses need be used. Vertical design loads, except roof live loads, shall be assumed to be acting simultaneously with the wind or seismic loads. (e) Allowable Stresses. The design of wood, concrete, or steel members shall conform to the requirements of Chapters 25, 26 and 27 of the Uniform Building Code. Loads, both vertical and horizontal, exerted on the soil shall not produce stresses ex. ceeding those permitted by Chapter 28 of the Uniform Build. ing Code. The working stresses of wire rope and its fastenings shall not exceed twenty -five (25) per cent of the ultimate strength of the rope or fasteners. Working stresses for wind or seismic loads combined with dead loads may be increased as specified in Section 2303 of the Uniform Building Code. SECTION 5538. Constrction. (a) u 'General. The supports for all signs or sign structures shall be :placed in or upon private prop - -`erty and shall be securely built, constructed, and erected in con- formance with the requirements ORDINANCE NO. of this Chapter. (b) Materials. Materials of construction for signs and sign structures shall be of the quality and grade as specified for build- ings in the Uniform Building Code. In all signs and sign struc- tures the materials and details of construction shall, in the ab- sence of specified requirements, conform with the following: 1. Structural steel shall be of such quality as to conform with U.B.C. Standard No. 27 -1. Secondary members in con- tact with, or directly support- ing, the display surface may be formed of light guage steel provided such members are designed in accordance with the specifications for the design of light guage steel as provided in U.B.C. Standards No. 27 -2 and No. 27 -3 and are galvanized to comply with American Society for Testing Materials `Standard Specifi- cations for Zinc- coated Iron and Steel,' A93 -46. No mini- mum thickness is specified. Secondary members, when formed integrally with the display surface, shall be not less than No. 24 guage in thickness. When not formed integrally with the display surface, the minimum thick- ness of the secondary mem- bers shall be No. 12 guage. The minimum thickness of hot - rolled steel members furn- ishing structural support for signs shall be one - fourth (14) Inch ungalvanized and three - sixteenth (3/16) inch if gal. vanized. Steel pipe shall be of such quality as to conform with U.B.C. Standard No. 27.4. Steel members may be con- nected with one galvanized bolt provided the connection is adequate to transfer the stresses in the members. 2. Anchors and supports for signs when of wood which are embedded in the soil, or are indirectly in contact therewith, shall be pressure - treated with an approved pre- servative before erection. Such members shall be marked or branded by an ap- proved agency. 873 — Page 6 • 3. No material, part, portion, or equipment shall be used in any sign which might be. come dangerous because of vibration, corrosion, disinte. gration, or any other reason. (c) Restrictions on Combust. ible Materials. All signs and sign structures erected in Fire Zone No. 1 shall have structural members of incombustible ma- terials. Ground signs and pole signs may be constructed of any ma. terial meeting the requirements of this Chapter, except as pro- vided above. Combination signs, pole signs, roof signs, wall 'signs, projecting signs, and signs on marquees shall be constructed of materials as specified in the Uniform Building Code and as provided in subsection (d) of this section. No combustible materials other than approved plastics shall be used in the construction of elec- trical signs. (See Section 8504 for approved plastics) For requirements on tempor. ary signs see Sections 8560, 8561 and 8562. (d) Nonstructural Trim. Signs attached to masonry, concrete, or steel shall be safely and securely fastened thereto by means of metal anchors, bolts, or approved expansion screws of sufficient size and anchorage to support safely the loads applied. No wooden blocks or plugs or anchors with wood used in con. nection with screws or nails shall be considered proper an- chorage, except in the case of signs attached to wood framing. No anchor or support of any sign shall be connected to or supported by an unbraced para- pet wall, unless such wall is de- signed in accordance with the provisions of Section 2312, Ap. pendix, of the Uniform Building Code for parapet walls. (f) Display Surfaces. Dis. play surfaces in all types of signs may be made of metal, glass or approved plastics, in ac. cordance with the area limita- tions set forth in Table No. 8 -5A. Design, Ground Signs and Pole Signs. Ground signs and pole signs shall be de- signed in accordance with all re- quirements specified in this Chapter. SECTION 8540. Clearance and Height, Ground Signs and Pole Signs. No person shall erect any ground sign or pole sign (a) with a height greater than twen. ty -five (25) feet above the level of the street upon which the sign faces; (b) which extends beyond the front property line except as permitted in Section 8555; or (c) which exceeds one hundred and sixty (160) square feet in area. SECTION 8541. Material, Com. bination Signs. Combination signs shall be constructed of in- combustible materials except as provided in Section 8538(d). SECTION 8542. Design, Com- bination Signs. SECTION 8543. Other Require. ments, Combination Signs. The individual requirements of roof, projecting and ground signs shall apply to combination signs incorporating any of the features of roof, projecting or ground signs. SECTION 8544. Display Sur. face Area, Combination Signs. The display surface of that por- tion of any combination sign ex- tending beyond the property or building line shall not exceed an area of one hundred and sixty (160) square feet per face; pro- vided, however, that said sign may not extend above the build- ing by more than forty (40) per cent of the height of the build- ing. SECTION 8545. Material, Roof Signs. Roof signs shall be con- structed of incombustible ma- terials except as provided in Sec- tion 8538(d). ,.SECTION 8546. Design, Roof Sins. Roof signs shall be thor- oughly secured and anchored to the -frame of the building over which they are constructed or erected, and shall be designed inlaccordance with all require- ` r ORDINANCE NO. ments specified in this Chapter. SECTION 8547. Clearance and Height above Roof, Roof Signs. (a). Clearance. Passage clear of all obstructions shall be left un- der or around and immediately adjacent to, all signs exceeding a height of four (4) feet above the roof thereunder. Such pass. ages shall be not less than three (3) feet wide and four (4) feet high and shall be at parapet or roof level. There shall be at least one such passage or access opening as follows: I. For each roof sign upon a building. 2. Within twenty (20) feet of walls and parapets when roof signs are at right angles to a face of the building. (b) Height above Roof. No roof sign shall extend more than thirty (30) feet above that part of the roof structure on which it is erected. SECTION 8548. Height and Ar. ea, Roof Signs. The height of a roof sign shall not exceed forty (40) per cent of the height of the face of the building or structure to which it is attached, and the area shall not exceed an area equal to the square of the allow- able height of the sign with maximum height as set forth in Section 8547. In no event may the area of any face of the sign exceed one hundred and sixty (160) square feet. SECTION 8549. Material, Wall Signs. Wall signs shall be con- structed of incombustible mater- ial, except as provided in Section 8535(d). SECTION 5550. Design, Wall Signs. Wall signs shall be de- signed in accordance with all re- quirements specified in this Chapter. SECTION 8551. Projection, Wall Signs. No wall sign shall have a projection over public property greater than twenty-four (24) in- ches, nor extend above any ad. jacent parapet or roof of the supporting building. SECTION 8552. Area, Wall Signs. The area of a wall sign or wall signs on any wall shall not exceed forty (40) per cent of the exposed finished wall sur. face area, including openings. 873 — Page 8 �J I � SECTION 8553. Material, Pro. jecting Signs. Projecting signs shall be constructed of incom- bustible materials, except as provided in Section 8538(d). SECTION 8554. Design, Project. ing Signs. Projecting signs shall be designed in accordance with all requirements specified in this Chapter. SECTION 8555. Projection, Clearance, and Display Surface Area, Projecting Signs. (a) Pro- jection. No sign shall project more than five (5) feet over pub- lic property and may not project to within two (2) feet of the curb line. Subject to all limitations in this Chapter, the distance any sign may project over public property or beyond the building line is governed by Table No. 8 -5C. TABLE NO. No sign or sign \structure shall project into any :public alley whatsoever, below a height of fourteen (14) feet above grade, nor more than eighteen (18) inches when over fourteen (14) feet. No sign or sign structure shall be erected in such a manner that any portion of its surface or supports will interfere in any way with the free use of any fire escape, exit or stand. pipe. No sign shall obstruct any window to such an extent that any light or ventilation is re- duced to a point below that re- quired by any law or ordinance. (f) Display Surface Area. The area of the display surface of a projecting sign which projects over public property, or beyond a building line, shall not exceed one hundred and sixty (160) square feet. SECTION 8556. Signs on Mar. quees. No projecting signs may be attached to a marquee. Signs hung from the underside of a marquee shall be clear of the sidewalk by not less than eight (8) feet. Signs may be placed on the outer faces of a marquee if they are made a part thereof and do not exceed the limitations of marquees. Cut -out letters may be installed on top of marquees. SECTION 8557. Material, Elec. trical Signs. Electrical signs shall be constructed of incom- bustible materials, except as pro- vided in Section 8538(d). The enclosed shell of electrical signs shall be watertight, ex. cepting that service holes fitted with covers shall be provided in each compartment of such signs. SECTION 8558. Illumination. Illuminated signs shall be pro. vided with illumination as pro. vided in this section. Illumination shall be fur- nished by means of incandescent lamps or luminous tubes either affixed to the surface of the sign or suitably mounted in the interior of the sign itself. When such lamps are placed in the interior of the sign, ap- proved translucent m a t e r f a 1 shall be provided in the faces. The maximum rating of indi. vidual incandescent lamps ex- posed on the surface of any sign shall be forty (40) watts. The m a x i m u m nighttime brightness of any sign shall be fifteen thousand (15,000) foot lamberts. 873 — Page 9 rJ • 0 The maximum brightness of any lamp used to illuminate any sign, as measured from any nor- mal viewing angle, shall be fif- teen thousand (15,000) foot lam- berts. The required illumination shall be uniformly distributed over the faces of the sign. The use of luminous tubes as bord- ers and trim only shall not be construed to provide sufficient illumination. . SECTION 8559. Electrical In- stallations. (a) Installation. El- ectrical equipment used in con- nection with display signs shall be installed in accordance with all provisions regulating electri- cal installations. (b) Erector's Name. Every electrical sign projecting over any street or alley or public place shall have painted on the surface of the sign the name of the sign erector and date of erection. Such name and date shall be of sufficient size and contrast to be readable from ground level. Failure to provide such name and date shall be grounds for rejection of the sign by the Building Official. SECTION 8560. Temporary Signs. No temporary sign shall exceed one hundred (100) square feet in area. Temporary signs of rigid material shall not exceed twenty -four (24) square feet in area, or six (6) feet in height. Temporary signs may remain in place for a period not exceed- ing sixty (60) days. Restrictions of time, size and height provided by this section shall not apply to signs for which a Use Permit has been ob- tained under the provisions of Article IX SECTION 8561. Cloth Signs. (a) Support. Every temporary cloth sign shall be supported Ad attached with wire rope of three- eighths (3/8) inch mini- mum- diameter. No strings, fiber ropgsl or wood slats shall be per - mlUed for support or anchorage purposes. Cloth signs and panels z shall be perforated over at least ten (10) per cent of their area to reduce wind resistance. (b) Projection and - Clearance. Cloth signs may extend over public property. Such signs, when extended over a public street, shall maintain a mini- mum vertical clearance of twen- ty (20) feet. (c) Council Permission. Cloth signs may extend across a public street only by permission of the City Council and shall be sub- ject to all applicable laws and ordinances. SECTION 8562. Other Tempor• ary Signs. Other temporary signs, when eight (8) feet or more above the ground, may project not more than six (6) inches over public property or beyond the building line. SECTION 8563. Nonconforming Signs. Signs existing at time of adoption of this Chapter which do not comply with the provi- sions hereof shall be regarded as legal nonconforming signs and alterations thereto may be al- lowed upon obtaining an Ex- ception Permit according to the provisions of this Chapter." SECTION 3: This Ordinance shall be published once in the Newport Harbor Ensign, a news- paper of general circulation, printed and published in the City of Newport Beach, and the same shall be effective 30 days after the date of its adoption.
