AN ORDINANCE OF THE CITY
OF NEWPORT BEACH AP-
PROVING THE ANNEXATION
TO THE CITY OF NEWPORT
BEACH OF CERTAIN UNIN-
HABITED TERRITORY CON.
71GUOUS TO THE CITY OF
NEWPORT BEACH AND
KNOWN AS "FIRST ADDITION
TO HARBOR VIEW ANNEX"
WHEREAS, pursuant to the
provisions of an act of the Legis-
lature of the State of California,
known as the "Annexation of
Uninhabited Territory Act of
1939 ", the City of Newport Beach
instituted proceedings for the
annexation of certain uninhabit-
ed territory contiguous to the
City of Newport Beach and desig-
nated as "First Addition to Har-
bor View Annex ", and which is
hereinafter more particularly
described- and
WHEREAS, the City Council of
the City of Newport Beach by
Resolution No. 5325 set Monday,
the 12th day of December, 1960,
at the hour of 7:30 P.M. at the
City Council Chamber, City Hall,
3300 Newport Boulevard, New-
port Beach, California, as the
time and place that said City
Council would hear protests to
the proposed annexation of said
territory to the City of Newport
Beach by any person owning real
property within the said terri-
tory; and
WHEREAS, the City Council of
the City of Newport Beach has
determined in accordance with
the Annexation of Uninhabited
Territory Act of 1939 that The
Irvine Company is the owner of
the real property in the aforesaid
territory proposed to be annexed;
and
WHEREAS, The Irvine Com-
pany, the owner of the real
property in the said uninhabited
territory, has filed its written
consent with the City Clerk of
the City of Newport Beach prior
to the adoption of this ordinance,
whereby it consented to the an-
nexation of said First Addition
to 'Harbor View Annex to the
City of Newport Beach and that
the property in said territory be
subjected to taxation after an-
nexation equally with property
in the City of Newport Beach to
pay the bonded indebtedness of
the City of Newport Beach out-
standing or authorized at the
time of annexation, for the
acquisition, construction or com-
pletion of municipal improve-
ments; and
WHEREAS, at the time set for
the hearing of the protests as
-set forth by said resolution, no
I or oral protests were
made by the owners of the ter-
ritory proposed to be annexed as
prescribed in the Annexation of
Uninhabited Territory Act of
1939; and
WHEREAS, it appears that the
necessary proceedings relating
to annexation have been con.
ducted strictly in accordance
with the law;
NOW, THEREFORE, the City
Council of the City of Newport
Beach does ordain as follows:
SECTION 1: The annexation to
the City of Newport Beach, Cali-
fornia, of that certain uninhabit-
ed territory contiguous to said
city, known as "First Addition to
Harbor View Annex ", is hereby
approved, and the same is here.
by ordained to be annexed to
and made a part of the City of
Newport Beach, California. Said
territory is particularly described
as follows:
Beginning in the boundary
of the city of Newport
Beach at a point distant
thereon S 63° 00' E 550 feet
from the most 'Easterly cor-
ner of Tract 2202 per map
recorded in Book 123, Pages
22 et seq., said Easterly
corner being an angle point in
said City Boundary and run-
ning thence N 270 00' E 130
feet; thence S 63° 00' E 305
feet; thence S 500 00' E 795
feet; thence S 72 ° 00'W 245
feet; thence S 410 30' W 350
feet; thence S 64° 00' W 275
feet; thence S 770 00' W 110
feet; thence S 46° 30' W
280 feet, more or less, to
said City Boundary; thence
N 32° 34' 52" W along said
Boundary 20 feet, more or
less, to an angle point there.
in; thence N 37° 05' 40" E
along said Boundary 180 feet,
more or less, to an angle
point therein; thence N 15°
20' E along said Boundary
900 feet, more or less, to an
angle point therein and the
Southeasterly extension of
the line previously described
as S 63° 00' E; thence N
63° 00' W along said Boun-
dary 270 feet to the point of
beginning.
SECTION 2: The property in
the aforesaid "First Addition to
Harbor View Annex" shall be
subjected to taxation after an-
nexation equally with iproperty
within the City of Newport
Beach to pay the bonded indebt•
edness of the City of Newport
Beach outstanding or authorized
at the time of annexation, for
the acquisition, construction, or
completion of municipal im-
provements.
SECTION 3: The boundaries of
the City of Newport Beach, Cali.
fornia, be, and the same are
hereby altered to include the
territory described herein, the
annexation of which is ap-
proved and ordained herein, and
incorporated in the City of New.
port Beach, California.
SECTION 4: The proceedings
and annexation herein ordained
are had and taken under and
pursuant to the provisions of an
act of the Legislature of the State
of California, designated and re-
ferred to as the "Annexation of
Uninhabited Territory Act of
1939".
SECTION 5: This ordinance
shall be published once in the
official newspaper of the City,
and the same shall be effective
30 days after the date of its
adoption.
This ordinance was introduced
at a regular meeting of the City
Council of the City of Newport
Beach held on the 12th day of
December, 1960, and was adopted
on the 27th day of December,
1960, by the following vote, to
wit:
AYES, COUNCILMEN: At.
kinson, Cook, Stoddard,
Hart, Lorenz, Somers.
NOES, COUNCILMEN: None.
ABSENT COUNCILMEN:
Kingsley.
