ORDINANCE NO. 1015 City Council as hereinafter AN ORDINANCE OF THE CITY OF NEWPORT BEACH REPEAL- ING CHAPTER 3 OF ARTICLE VII OF THE NEWPORT BEACH MUNICIPAL CODE AND ADD- ING A NEW CHAPTER •3 TO ARTICLE VII OF SAID CODE RELATING TO PLANTING IN PARKS, - PARKWAY$,..' AND STREETS The City Council of the City of Newport Beach does ordain as follows: - SECTIONI. Chiapter3 ofArt-= icle VII of the Newport Beach Munjcipal Code is repealed, - SECTION2, Anew Chapter 3 is added to Article Vil.. of the Newport Beach Munic paI Code to read: "Chapter. 3 PLANTING IN PARKS, PARK- WAYS, AND, STREETS SECTION 7900.Jurisdiction and Authority;' Subject to the administrative control established by, the - CityCharter and the provis- ions of this Chapter, the Parks. Beaches and Recre- ation Department shall exer- cise jurisdiction and control over the planting, mainten- ance, and removal of trees, shrubs, and plants in all pub-. lic areas under the control of the City, and shall have the authority and duties prescrib- ed in this Chapter. SECTION 7301. Street Tree$ Planting and Improvements - Permit Required. (a) No person shall plantany tree, shrub or flower, or place any structures or im- provements within -the street right -of -way of any street end terminating at Newport Bay or any beach area, of Ocean Front or of any public srreetadjoining and parallel to any beach area or public or private waterway in the City without first obtaining a permit to do so from the ORDINANCE provided. (b)No person shall plant any tree in any street right -of- way, not described in sub - section (a) hereof, and no person shall.place any brick, . stone, . concrete or other solid surfacing material in any parkway, , traffic island, or street right -of -way, notdes- cribed in subsection (a) here- of, except in the course of the construction or repair of pavement or sidewalks auth- orized by the City, without a - written permit therefor i issued by the City as herein- , - after provided. (c)Application for any such permit shall be filed with the Parks, Beaches and , Recie- ation Department on a form to be provided by the City and shall show the location of the proposed planting or work and the nature thereof. If the 'application is for a permit required under sub- section (a)hereof, itshall be forwarded to the City Clerk for submission to the City Council. If for a permit re- quired under subsection (b) hereof, it shall be processed by the Parks. Beaches and Recreation Department. (d) Any such permit to plant a tree or trees, except when City Council approval is re- quired, shall be issued to the owner or occupant of the adjacent property if the pro- posed planting is in accord- ance with the official tree list and any standards for street tree planting adopted by the City Council. (e) Any permit required hereunder,other than to plant a tree or trees where City Council approval is not re- quired , shall be issued to the owner or occupant of the ad- _ jacent property only if the proposed work does not re- strict access to Newport Bay 101.5 -- Page 1 i • 0 oranybeach area or impede or constitute a hazard to pedestrian or vehicular trav- el, is not harmful or detri- mental to existing or pro- posed street trees or other improvements, and is not in conflict with any standards for street or parkway im- provements adopted by the City Council. . SECTION 7302, Official Tree List. The CityCouncil shall adopt an official tree list which shall set out the names of the streets in the City and the species of tree or trees that maybe planted on each such street or portion thereof. Said list shall be adopted by resolution and three copies thereof shall be kept on file in the office of the City Clerk for inspection by the public and copies shall be available in the Parks, Beaches and Recreation Department for information. SECTION 7303. Removal or Relocation by CCitY, The City may relocate or re- move any tree, shrub,plant, . structure or surfacing mater- ial in any public street right - of -way as determined by the City Council to be necessary or convenient for public tra- vel or in the interest of public health, safety or general welfare. SECTION 7304. Injury to Planting Pro h1" ted. No person shall trim, cut down, damage, remove, or destroy any tree growing upon any public park, beach or playground, or the grounds of any public building, or a public street right-of -way, without written permission of the City Manager. No person shall damage, disfigure, or destroy any seat, trellis, or other facility located there- on. No person shall cut, damage, ORDINANCE remove or destroy any shrub, plant or flower growing in any public park, beach or play- ground, or the grounds of any public building, or on any street right -of -way except in the parkway adjoining the property of which such person is the occupant or owner. SECTION 7305. Prohibited Activities. (a)No person shall place or affix any rope, wire, sign, poster, or other ob ject on any. tree, shrub, or plant. or upon any guard device protecting same, located upon the pub- lic street right- of-way or upon other public property. (b)No person shall deposit or throw upon any public street right -of -way or other public property any substance detrimentalto the growth of any tree, shrub, or plant. (c) No person shall'remove or damage any guard or de- vice placed to protect any tree, shrub, or plant growing in any public street right -of- way or upon other public property. (d)No person shall attach any electric wires or any de- vice for holding electric wires to any tree, plant, or shrub growing in any public street right -of -way or other public property under the control of the City without approval of the City Coun- cil. No person shall, with- out written permission from the Director of Parks, Bea- ches and Recreation, trim, cut, or break any part of such tree, shrub, or plant in order to make passage for electric wires. (e) No person shall placeor maintain loose rock or gravel in the parkway on any stree t. SECTION 7306. Owners of Premises Required toTrim Branches. The occupant in charge or, 1015 -- Page 2 _ F • • 11 if there is no such occupant, the owner of every lot or parcel of land shall trite the branches of any tree, shrub, or plant oil his property, and shall trim all shrubs and plants in the parkway adjacent to his property, so that same shall not encroach upon the side- walk or street in such manner as to impede or interfere with traffic thereon or ob- struct'the passage of light from any street light to the street or sidewalk. The City shall trim and prune all trees located in the public street right -of -way. " SECTION 3. This ordinance shall be published once in the official newspaper of the City, and the same shall be effective $0 days after the date of its adoption. This ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach held on the 8th day of October, 1962, and was adopted on the 29th day of October, 1962, by the following vote, to wit: AYES, COUNCILMEN Stoddard, Gruber, Cook, Hart, Lorenz, Marshall, Elder. This list is subject to revision from time to time and is designed as assistance to individuals and neighborhoods wishing to help beautify the City. Any street or area with planting ideas, other than these suggested, should make their wishes known to the Parks, Beaches & Recreation Department with request for approval. It is hoped that parkway trees will be filled out in blocks where some are lacking.
