I I • ORDINANCE NO, 1036 AN ORDINANCE OF THE CIS I TYOF NEWPORT BEACH EX= CLUDING CERTAIN UNIN- HABITED TERRITORY FROM THE CITY WHEREAS, pursuant to Sec- : Lion 35561.4 of the Govern' ment Code the City Council of 'ithe City of Newport Beach ini- tiated proceedings to exclude certain uninhabited' territory 'hereinafter described from the City, said territory being A. por- ition of territory annexed to the City as uninhabited tetritory; and f WHEREAS -, a specific legal description and map thereof were submitted to the County Boundary Commission and, af- ter a report from said Commis- sion approving said•boundaries, the City Council set a public hearing to consider the exclu- sion of said uninhabited terri- tory from the City; and - WHEREAS, there was no pro- test by propetty owners repre- senting -fifty percent (50(0) of the. area and assessed value of f the, land of the territory pro- posed for exclusion at or before the time set for said public hearing;' and WHEREAS, it appears that the necessary proceedings relating to the exclusion of said terri- tory have been -conducted in accordance with the require- ments of said Section 35561.4; NOW, THEREFORE, the City Council of the City of Newport Beach does ordain as follows: Suction 1, There is hereby l excluded from the City of New - port Beach that certain uninha- hired territory particularly des- k cribed as follows, to wit: That •portion of lot 139, block 50 of Irvine's Sub- . division in the City of New - port Beach, County of Or- ange, State of California, as. said, subdivisiou is shown on a map recorded in Book 1, page 88 of Miscellaneous Record Maps in the office of the County Recorder of said county described as follows: Commencing at the most northerly corner of Tract -No. 3201 as per, map recorded in Book130, pages25 to 30 in- clusive, of Miscellaneous Maps, records of Orange County; thence North 39^ 48' 15" East 108.82 feet a- Iong the southeasterly right ofwaylineof Acacia Street, 70 feet wide, as shown on said tract map, said south - easterlyright ofwayline be- ing also the 'northwesterly line of the Acacia Street An= nex to the City of Newport BeacL as described in Ord- inance No.. 837 of said city toan intersection with anon- tangent curve concave south- easterly having a radius of 1200 feet; said intersection " being the true point of be- . ginning, a radial to Bald point bears North 35° 21'.39 West ; thence continuing North 39 °48'15" East 377•.58 feet-along said southeasterly right of way lind,and Said northwesterly line of the 'Acacia Street Annex to an intersection with the wester* right of way line'of MacAr- thur Boulevard, 110 feet wide, asdescribed in a deed recordedinBook 1047, page 557 of Official Records, re- cords of., Orange.
