ORDINANCE NO. 1224
AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING
SECTION 12.56.140 OF THE NEWPORT BEACH MUNICIPAL
CODE RELATING TO OPERATING BICYCLES ON SIDEWALKS
The City Council of the City of Newport Beach does
ordain as follows:
SECTION 1. Section 12.56.140 of the Newport Beach
Municipal Code is amended to read;
"12.56.140 0 eratin Bic cle on Sidewalk. No
person s aal'�operate or r e a bicycle, surrey cycle,
pedicab, or other wheeled device or conveyance used
for transportation and propelled by human power, upon
any sidewalk in the City, except that bicycles may be
ridden on the south one -half of the sidewalk located
on Ocean Front between F Street and McFadden Place and
between 24th Street and 36th Street. The foregoin� pro-
hibition shall not apply to children's or invalids
tricycles, wheelchairs, or skateboards."
SECTION 2. Emergency Ordinance Effective Immediately.
This ordinance is declared by the City Council to be
necessary as an.emergency measure for preserving the public
peace, health, safety and welfare and shall take effect immedi-
ately upon its adoption. The following is a statement of the
facts constituting its urgency-
It has come to the attention of the City Council that
four - wheeled devices known as surrey cycles have recently been
rented for use on the streets and sidewalks within the City. As
presently worded, Section 12.56.140 entitled "Operating Bicycle
on Sidewalk" prohibits any person from riding a bicycle upon any
sidewalk in the City except on the south one -half of the side-
walk within a limited area on Ocean Front. This regulation which
is applicable to bicycles does not necessarily apply to other
wheeled transportation devices propelled by human power. The
City Council has been advised by the Police Department that the
use of such devices on the sidewalks of the City constitutes a
hazard to pedestrians and that there is an urgent need for imme-
diate legislation forbidding the use of such devices on the City
sidewalks.

SECTION 3. Publication, This ordinance shall be pub-
lished once in the official newspaper of the City.
This ordinance was introduced and adopted as an emer-
gency ordinance at a regular meeting of the City Council of the
City of Newport Beach held on the 10th day of July, 1967, by
the following vote, to wits

Marshall, Gruber, Cook, Forgit, Shelton
