AN ORDINANCE OF THE CITY OF NEWPORT BEACH
REPEALING CHAPTER 15.12 OF THE NEWPORT BEACH
MUNICIPAL CODE ENTITLED "ELECTRICAL CODE"
AND ADOPTING BY REFERENCE THE NATIONAL
ELECTRICAL CODE OF 1968 AS NEW CHAPTER 15.12
OF THE NEWPORT BEACH MUNICIPAL CODE
The City Council of the City of Newport Beach does
ordain as follows:
SECTION 1. Chapter 15.12 of the Newport Beach Municipal
Code setting forth the provisions of Ordinances Nos. 981, 982,
1106 and Subsection 4, Section 2 of Ordinance No.. 1170,is
hereby repealed.
SECTION 2. A new Chapter 15.12 is added to the Newport
Beach Municipal Code to read:

15.12.010 Ado tion of National Electrical Code.
Subject to the particular additions, deletions an
amendments hereinafter set forth in this Chapter, the
rules, regulations, provisions and conditions set forth
in that certain Code entitled 'National Electrical Code,
1968 Edition' (NFPA No. 70 -1968; USAS C1 -1968) published
by the National Fire Protection Association, and the
whole thereof, including the appendix thereto, three
full printed copies of which, printed as a Code in book
form, were by the City Council ordered filed and which
have been actually filed in the office of the City
Clerk and which, as so on file are hereby referred
to, adopted and made a part hereof as fully and for
all intents and purposes as though set forth herein
at length, shall be and the same are hereby established

and adopted as the rules, regulations, provisions and
conditions to be observed and followed in the construction,
alteration, installation, moving, repair and use of any
electrical wiring on any premises within the incorporated
area of the City of Newport Beach; providing for issuance
of permits and collection of fees therefor; and providing
penalties for violation of such code; and subject to said
additions, deletions and amendments hereinafter set forth,
said Code is hereby established and adopted and the same
shall be designated, known and referred to as the
'Electrical Code' of and for the City of Newport
Beach.
15.12.020 Exemptions. The provisions of this Code
shall not apply to public utilities or to electrical
wiring for street lighting or traffic signals located
primarily in a public way.
15.12.030 Compliance with Electrical Code Re uired.
No person erect, construct, alter or repair any
electrical installation or wiring in the City or cause or
permit the same to be done without complying with all
provisions of the Electrical Code.
15.12.040 Violations and Penalties. Any person,

this Code shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be punishable by a fine
of not to exceed Five Hundred Dollars ($500) or by
imprisonment in the County Jail for not to exceed
six (6) months, or by both such fine and imprisonment.
Each separate day or any portion thereof during which
any violation of this Code occurs or continues shall
be deemed to constitute a separate offense, and upon
conviction thereof shall be punishable as herein
provided.
The issuance or granting of a permit or approval
of plans and specifications shall not be deemed or
construed to be a permit for, or an approval of, any
violation of any of the provisions of this Code. No
permit presuming to give authority to violate or
cancel the provisions of this Code shall be valid,
except insofar as the work or use which it authorizes
is lawful.
The issuance or granting of a permit or approval
of plans shall not prevent the Electrical Inspector
from thereafter requiring the correction of errors in
plans and specifications or from preventing construction
operations being carried on thereunder when in violation
of this Code or of any other ordinance or from revoking
any Certificate of Approval when issued in error.

15.12.050 Deletion of Section 90 -6. Section 90 -6 is
hereby dated from the National E ectrical Code, he,reinbefore
adopted in Section 15.12.010.
15.12.060 Amendment to Section 90 -7. Section 90 -7 of
• the NationaTTElectrical Code, hereinbefore adopted in
Section 15.12.010,is amended to read:
'90 -7 Enforcement. The Building Director of
the City of Newport Beach shall enforce the pro-
visions of this Code and shall have the responsibility
for making interpretations of the rules, for deciding
upon the approval of equipment and materials, and for
granting the special permission contemplated in a
number of the rules.'
15.12.070 Addition to Section 90. Section 90 -11 is
added to tFFe—National Electrical Code, hereinbefore adopted
in Section 15.12.010, to reads
'90 -11 Electrical Inspector. Electrical Inspector
shall eFi�tze MuTfIding Director ot the City of Newport
Beach and such other person or persons in the Building
Department as are authorized and directed by the
Building Director to carry out under his direction
and supervision the powers and duties set forth in
this Code. He shall be well versed in approved
methods of electrical construction for safety to
life and property, and in the statutes of the State
of California relating to electrical work, the
ordinances of the City of Newport Beach relative
thereto, the electrical rules and regulations issued
• under authority of the statutes governing industrial
installations and the National Electrical Code
approved by the United States of America Standards
Institute.
Whenever the term "Electrical Inspector" is
used in any section of this ordinance, such term
shall be construed to mean the Building Director
or his authorized representative.'
15.12.080 Amendment to Article 100. Article 100 of
the Nat ona Electrica Code, entitled 'Definitions',
hereinbefore adopted in Section 15.12.010, is amended to
add the definitions of the following terms only. All
words, phrases or terms not hereinafter defined shall
have the same meaning as set forth in Article 100 as
published.

more families living independently of each other
and doing their own cooking in the said building,
and shall include flats and apartments.
Building is any structure built for the
support or shelter of persons, animals, chattels
• or property of any kind.

Master Electrician is a person who is engaged
in the business of installing or repairing electrical
wiring or equipment, or who does, or who holds himself
out as willing to do personally or through his employees
any work or services in connection with the installation,
alteration or repair of any electrical wiring or equip-
ment or part thereof within the incorporated territory
of the City of Newport Beach and who possesses an
appropriate contractor's license pursuant to Chapter 9,
Division 3 of the Business and Professions Code.
Dwellina shall mean one or more rooms connected
together within a building but separated from all
other rooms in the same structure and constituting a
separate, independent housekeeping unit for the
permanent residential occupancy of one family.
Electric or electrical wiring means the installa-
tion or the alteration of any material, fixture,
device, appliance or equipment in or on any building,
structure or premises, used or designed or intended to
be used to generate, transmit, transform or utilize
electric energy.
Hotel is any building

Maintenance electrician is any electrician
regularly employed in accordance with the provisions
of Sections 15.12.110- 15.12.130 of this ordinance.
Person is an individual human being, a firm,
partnership or corporation, his or their heirs,
executors, administrators, assigns, officers or
agents; the City of Newport Beach and any local
agency as defined in Section 53090 of the Government
Code, or officer thereof.
Sign electrician is any person holding a valid
State Contractor license with a classification
of C -45 engaged in the business of installing or
maintaining the electrical wiring of a sign or of a
gas tube electrical sign whether fixed or portable
for which a permit is required by this Code.'
15.12.090 Addition of Article 105. The title of
Artic e3 IU5___oT the National Electrical Code, hereinbefore
adopted in Section 15.12.010, is added to read:
'Article 105 ADMINISTRATION.'
15.12.100 Addition of Section 105 -1. Section 105 -1
is added to the National Electrical Co e, hereinbefore
adopted in Section 15.12.010, to read:
'105 -1 Applications and Permits.
• (a) Applications. Applications for electrical
permits, describing the work to be done, shall be
made in writing by a master electrician, maintenance
electrician, or their authorized representative.
Where a license is required by the State of
California, a permit shall not be issued unless the

applicant has such a license. In the case of an owner,
such application shall be for a special owner's permit.
Applications shall give the location where such
work is to be done, either by street and house number,
• by lot, block and tract, or similar description that
will readily identify and definitely locate the
proposed work. A separate application shall be
required for each building.
EXCEPTION: Applications for single - family
dwellings may include all accessory buildings
such as garages, sheds, guest houses, and
the like that are located on the same lot,
erected at the same time, and supplied from
the same service as the main building. A
separate application shall be required for
any private dock installation.
Each such application shall be accompanied
by drawings or blueprints as required by the
Electrical Inspector. Application may be made
by a firm, partnership, or corporation, any
officer or member of which is an electrician,
sign electrician, master electrician, in the
event that all construction or work is done
under the direct personal supervision of such
officer or member.
(b) Special Owner's Permit. The Electrical
Inspector may issue to an in ividual a special owner's
permit authorizing said individual to install, alter,
• change, or repair electrical equipment in, on, or
about a single - family residence of which said individual
is owner, and in which he resides or intends to reside,
but not elsewhere; provided, that no electrical work
authorized under any such special owner's permit shall
be done, nor shall the owner holding any such permit
allow any such work to be done, except personally by
the owner to whom the permit is issued, or by a member
of his immediate family; and, if this or any other
provision hereof shall be violated by the holder of
such special owner's permit, such permit shall be
subject to immediate cancellation by the Electrical
Inspector, and the holder thereof shall be liable to
the penalty hereinafter provided for violation of
this Code.
(c) Permits. No alteration or addition shall
be made to any existing wiring, nor shall any wiring
for the placing or installation of any electric
light, power or heating device, or any apparatus
which generates, transmits, transforms or utilizes
electricity, operating at a voltage exceeding 25
volts between conductors or capable of supplying
more than 50 watts, be made without first obtaining
a permit therefor from the Electrical Inspector,
excepting minor repair work such as repairing flush
and snap switches, replacing fuses, changing lamp
sockets and receptacles, taping bare joints,
repairing drop cords and the like.
The application, plans and specifications
filed as required by this section, shall be checked
by the Electrical Inspector, and if found to be
in conformity with the requirements of this Code and
all other laws or ordinances applicable thereto, the
Electrical Inspector shall, upon receipt of the
required fee, issue a permit therefor. Every permit
• issued shall be valid only for the location described
on the application therefor.
(d) Expiration of Permit. Every permit issued
by the Electrical Inspector under the provisions of
this Code shall expire by limitation and become null
and void if the building or work authorized by such
permit be not commenced within 90 days from the date
of such permit, if the building or work authorized
by such permit be suspended or abandoned at any time
after the work is commenced for a period of 90 days,
or if the electrical work authorized by such permit
is not "completed within one year from date of issuance
of such permit. When an electrical permit expires,
no electrical work thereafter shall be done without
first obtaining a separate electrical permit from
the Electrical Inspector in the same manner as is
required herein for an original permit.
(e) Cancellation of Permit. If no portion of
the work or construction covered by a permit issued
by the Electrical Inspector under the provision of
this Code has been commenced, the person to whom
such permit has been issued may deliver such permit
to the Electrical Inspector with a request that such
permit be cancelled. The Electrical Inspector shall
thereupon stamp or write upon the face of such permit
• the words, "Cancelled at the request of the permittee."
Thereupon such permit shall be null and void and of
no effect.
(f) Additional Electrical Work after Final
Approval. After the Electrical Inspector has Finally
approved electrical work authorized under an electrical
permit, no additional electrical work shall be done
thereunder without first obtaining a separate electrical
permit authorizing such additional electrical work.'
15.12.110 Addition of Section 105 -2. Section 105 -2
is ad a to t e National Electrical Code, hereinbefore
adopted in Section 15.12.010,to read:
'105 -2 Maintenance Electrician. (a) A Maintenance
Electrician shall not install, alter, maintain or repair
electrical wiring or equipment in or on any building
owned or occupied by his employer without first having
obtained a Certificate of Competency as herein provided.
(b) The Electrical`-lnspector shall establish
minimum standards of electrical competency to be
used in determining whether any person is qualified
for a Certificate of Competency as a Maintenance
Electrician. The Electrical Inspector shall issue
such Certificate of Competency to any applicant
meeting such standards. If the Electrical Inspector
• determines that an applicant is not so qualified,
such applicant may appeal his determination in accord
with such procedures as may be set forth by the
City Council of the City of Newport Beach.

15.12.120 Addition of Section 105 -3. Section 105 -3 is
added to the Nat ona Electrical Code, hereinbefore adopted
in Section 15.12.010, to read:
'105 -3 Registration of Maintenance Electricians.
•
(aT--fihe Electrical Inspector shall register
each Maintenance Electrician to whom a Certificate
of Competency is issued. The business identity of
the Maintenance Electrician and his employer, their
business addresses, and the location and description
of buildings and premises in or on which the Maintenance
Electrician will be doing electrical work, shall be
included in such registration, and the Maintenance
Electrician shall notify the Electrical Inspector of
any changes in the information required under such
registration.
(b) Certificates of Competency shall expire
on the 30th day of June following their issuance,
and may thereafter be renewed on an annual basis.
(c) An applicant for such a Certificate of
Competency shall at the time of filing his applica-
tion pay an examination fee of Ten Dollars 10.00),
and at the time a Certificate of Competency is issued
pay a registration fee of Ten Dollars ($10.00). A
registration fee of Ten Dollars ($10.00) shall also
be paid at the time of each annual renewal of such
certificate.'
15.12.130 Addition of Section 105 -4. Section 105 -4 is
• added to the National Electrical Code, hereinbefore adopted
in Section 15.12.010, to reads
'105 -4 Revocation or Suspension of Certificates
of Com etenc . The Electrical Inspector, with t e
approva of the City Manager, may suspend or revoke
a Certificate of Competency when the Maintenance
Electrician holding such certificate has violated
any of the provisions of this Code or has engaged
in conduct constituting incompetency in connection
with his electrical work. Any such Maintenance
Electrician may appeal such suspension or revocation
in the same manner as set forth in Section 15.12.110
of this Code. No electrical work shall be done by
such Maintenance Electrician pending a decision by
such Board without the approval of the City Manager.'
15.12.140 Addition of Section 105 -5. Section 105 -5 is
added to the National Electrical Co e, ereinbefore adopted
in Section 15.12.010, to read:
1105 -5 Interpretations by Electrical inspector.
The El ctrical Inspector is here y empowered to make
interpretations of any of the provisions of this Code
wherever there is a reasonable question as to what
is required in the way of materials or methods or
manner in which the materials shall be installed.
Such interpretations shall be in writing filed in
• the office of the Electrical Ins ector and shall be
final unless an appeal is taken.

15.12.150 Addition of Section 105 -6. Section 105 -6 is
added to the National E ectrica Co e, ereinbefore adopted
in Section 15.12.110, to read:
'105 -6 Inspection.
• (a) Approval. Upon the completion of the
electrical wiring in or on any building or structure
of any nature, or tent, or premises, except as
otherwise exempted in this ordinance, the person,
firm or corporation installing the same shall notify
the Electrical Inspector, who shall inspect such
installation, and if it is found by him to be fully
in compliance with the provisions of this ordinance,
he shall issue, as provided for herein, the certificate
of inspection or approval tag authorizing connection
to the electrical service and the energizing of the
installation.
(b) Permission to Cover Work. It shall be
unlawful for any person to lath over, seal, cover or
conceal any electrical wiring or other electrical
equipment, for the installation of which a permit
is provided herein, until such electric wiring or
other electrical equipment shall have been inspected
and approved by the Electrical Inspector. Said
Electrical Inspector shall have the power to remove,
or to require the removal of any obstruction which
prevents proper inspection of any electrical equipment.
(c) Corrections. All defects shall be corrected
within 10 Tays after inspection and notification or
• within such other reasonable time as is permitted by
the Electrical Inspector.
(d) Connection. It shall be unlawful to energize
or cause or permit to be energized any electrical
wiring coming under the provisions of this ordinance,
until such electrical wiring shall have been inspected
and approved by the Electrical Inspector. Provided,
however, that the Electrical Inspector may give
written temporary permission to furnish electric
current to, or the use of electric current through
any electrical wiring for a length of time not
exceeding 30 days, if it appears to said Electrical
Inspector that such electrical wiring may be used
safely for such purpose, and that there exists an
urgent necessity for such use.
(e) Governmental Agencies. The provisions of
this ordinance shall cover, govern and control the
installation, alteration or repair of any electrical
wiring, connection, fixtures, sockets, appliances,
apparatus, machinery or other electrical device by
or on behalf of the City of Newport Beach or any
department or officer thereof or by or on behalf of
any school district or any quasi - public or political
corporation or governmental agency or body, on any
premises not owned by a public school district being
• constructed within said incorporated territory.
This paragraph does not apply to such electrical
wiring as is specifically exempt under the provisions
of Section 15.12.020.'
15.12.160 Addition of Section 105 -7. Section 105 =7 is
added to the National Electrical Code, hereinbefore adopted
in Section 15.12.010, to read:
1105 -7 Reins ection. The Electrical Inspector
• is hereby authorize and empowered to make at such
times and as often as in his discretion it may seem
necessary, a thorough reinspection of the installation
in or on any building, structure or premises of all
electrical wiring, electric devices and electrical
material now installed or that may hereafter be
installed within the incorporated territory of said
city and when the installation of any such wiring
device or material is found to be in a dangerous
or unsafe condition the person, firm, corporation or
governmental agency owning, using or operating the
same shall be notified in writing and shall make the
necessary repairs or changes required to place such
wiring, device or material in a safe condition and
to have such work completed within a period of 10
days after such notice, or within such other reasonable
period specified by the Electrical Inspector in said
notice and shall of such fees as are required by
the provisions of this ordinance.
The Electrical Inspector is hereby empowered to
disconnect or to order the discontinuance of electrical
service to wiring, devices or materials found to be
defective until the installation of such wiring
device or material has been made safe as directed by
the Electrical Inspector, and any person, firm,
corporation, political subdivision or governmental
• agency ordered to discontinue such electrical service
shall do so within 24 hours after the receipt of such
notice and shall not reconnect such service or allow
the same to be reconnected until notified so to do by
the Electrical Inspector.°
15.12.170 Addition of Section 105 -8. Section 105 -8 is
added to the National Electrical Code, hereinbefore adopted
in Section 15.12.010, to read:
1105 -8 Right of Entry.
1. The Electrical Inspector, or his duly
authorized representative, shall have the authority
to enter any building or premises for the purpose
of investigating the existence of suspected or
reported damage or defects which constitute an
immediate danger to human life or an immediate
hazard to public safety or health.
2. Except in emergency situations as defined
in Section 105 -8 -1 of this Code, the Electrical
Inspector, or his authorized representative, shall
not enter any building or premises without the
consent of the owner or occupant thereof, unless
he possesses a reasonable search warrant authorizing
entry and search of the premises.
• 3. No person shall hinder or prevent the
Electrical Inspector or his authorized representative,
while in the performance of the duties hereinbefore
described as emergency situations or while in
possession of a valid search.warrant from entering

upon and into any and all premises under his
jurisdiction, at all reasonable hours, for the
purpose of inspecting the same to determine whether
or not the provisions of this Code and all other
applicable laws or ordinances pertaining to the
• protection of persons or property, are observed
therein.'
15.12.180 Addition of Section 105 -9. Section 105 -9 is
added to the National Electrical Co e, hereinbefore adopted
in Section 15.12.010, to read:
1105 -9 Permits. (a) An electrical permit shall
be requireU whenever any electrical equipment is to
be installed within or on any building, structure,
premises, whether publicly or privately owned, and
shall also be required for any alteration, addition
to or repair of any existing electrical equipment
except as otherwise provided herein.
(b) No electrical permit shall be required for
the following classes of electrical work:
1. Minor repair work, such as the
replacement of lamps or the connection of portable
electrical equipment to suitable permanently
installed receptacles.
2. The installation, alteration, addition
to or repair of electrical equipment, installed by or
for an electricity supply agency for the use of such
agency in the generation, transmission, distribution
• or metering of electricity.
(c) Submission of any false statement in
connection with the issuance of any electrical permit
shall constitute sufficient cause for a revocation of
such electrical permit by the Electrical Inspector.'
15.12.190 Addition of Section 105 -10. Section 105 -10
is ad a to t e National Electrical Code, hereinbefore
adopted in Section 15.12.010, to read:
'105 -10 Monthly Permits for Maintenance
Electric ans. a In lieu of individual permits
oral work, a monthly permit may be issued
by the Electrical Inspector to any person regularly
employing one or more Maintenance Electricians. Such
permit shall be issued on a calendar month basis.
(b) Application for such a monthly permit shall
be on a form provided by the Electrical Inspector
and shall contain the name and registration number
of each Maintenance Electrician employed and a
description of the electrical work and the premises
on which the electrical work has been done under
such permit.
(c) Each such Maintenance Electrician shall
keep a current detailed and accurate record in
• duplicate of all electrical work which has been
done by him and such record shall be available for
inspection by the Electrical Inspector.

(d) Within fifteen (15) days after the end of
each calendar month, the person employing such
Maintenance Electrician shall file his application
for such monthly Maintenance Electrician permit
with the Electrical Inspector, to which shall be
.' attached one copy of such Maintenance Electrician's
record of electrical work done during the preceding
calendar month, and shall pay such fees as are
required for such work by this Code. The Electrical'
Inspector shall then issue the monthly Maintenance
Electrician permit.'
15.12.200 Addition of Section 105 -11. Section 105 -11
is added to the National Electrical Code, hereinbefore
adopted in Section 15.12.010, to read:
'105 -11 Fees. Fa ment of Fees. The fees
prescrib" Terein shall be paid to the Electrical
Inspector for the City of Newport Beach for each
electrical installation, alteration, addition or
repair for which an electrical permit is required.
The Electrical Inspector shall not issue an
electrical permit, until all such fees are paid
in full.'
15.12.210 Addition of Section 105 -12. Section 105 -12
is added to the National Electrical Code, hereinbefore
adopted in Section 15.12.010, to read:
'105 -12 Fees - New Construction - Com lete

construction include all electrical installations when
the formula is applied to the square footage of area.
1. One cent (10) per square foot, plus $1..00
for each lighting meter, plus $2.00 for
permit issuance.
2. One -half cent (1/2¢) per square foot for
detached or attached garages and carports
on the same service.
(b) Hotels and Motels: Use the regular fee
schedule be ow for all areas except garages.

15.12.230 Addition of Section 105 -14. Section 105 -14

'105 -14 Plan Checking Fee.
A plan checking fee shall be paid at the time of
submittin4 plans as required for all proposed
installations where one or more services or feeders
have a disconnecting means with a single or combined
total rating exceeding 600 amperes or having a .
capacity of 150 kilovolt - amperes (KVA). Said fee
shall be equal to one -half (1/2) the required
electrical permit fee as set forth in Sections
15.12.210 and 15.12.220 of this Code.'
15.12.240 Addition of Section 105 -15. Section 105 -15
is adde to the National Electrical Code, hereinbefore
adopted in Section 15.12.010, to read:
'105 -15 Penaltv Fee.
Any person who shall commence any electrical
work for which a permit is required by this
ordinance without first having obtained a permit
therefor shall, if subsequently permitted to obtain
a permit, pay double the permit fee fixed by this
section for such work provided that this provision
shall not apply to emergency work when it shall be
proved to the satisfaction of the Electrical

Inspector that such work was urgently necessary and
that it was not practical to obtain a permit therefor
before the commencement of work. In all such cases,
a permit must be obtained as soon as it is practical
• to do so, and if there be an unreasonable delay in
obtaining such a permit, a double fee as herein
provided shall be charged.'
15.12.250 Addition of Section 105 -16. Section 105 -16
is ad a to the National Electrical Code, hereinbefore
adopted in Section 15.12.010, to read:
'105 -16 Fees - Additional Electrical,Work Under
Electric Permit. Whenever additional wiring will
result in a deviation from the electrical work
authorized under an electrical permit and such
deviation has been approved by the Electrical
Inspector, an additional fee equal to the difference
between the fee paid when such permit was issued
and the fee required for the additional wiring,
plus` issuance of permit fee, shall be paid.'
15.12.260 Addition of Section 105 -17. Section 105 -17
is added to the National Electrical Code, hereinbefore
adopted in Section 15.12.010, to read:
'105 -17 Fees for Additional Ins ection. The
Electrical Inspector may charge an a itional fee of
$5.00 for each additional inspection that he is
required to make as a result of faulty workmanship
or material, or for any inspection requested before
the work inspected has been completed, made ready
for inspection or before an electrical permit has
been obtained.3
15.12.270 Addition of Section 105 -18. Section 105 -18
is adde t�fie National Electrical Code, hereinbefore
adopted in Section 15.12.010, to read:
'105 -18 Fees - Tem o Electrical Service.
Whenever E ectrical Inspector authorizes the
connection and use of a temporary electrical
installation, a fee of $5.00 shall be paid to the
Electrical Inspector for the City at the time such
connection and use is authorized.'
15.12.280 Addition of Section 105 -19. Section 105 -19
is ad ed� to the National Electrical Co e, hereinbefore
adopted in Section 15.12.010, to read-
'105-19 Fees - Refunds. In the event that
any person shall ve_o tained a building permit
and no portion of the work or construction covered
by such permit shall have been commenced and
such permit shall have been cancelled either as
provided for in Section 15.12.100, the permittee
upon presentation to said Electrical Inspector of
a request therefor, in writing on a special form,
shall be entitled to a refund in an amount equal
to 80 per cent of the permit fee actually paid for
• such permit.
The Electrical Inspector shall satisfy himself
as to the right of such applicant to such refund,
and each such refund shall be paid as provided by law
for the payment of claims against the City.

No portion of the plan checking fee shall be
refunded, unless no checking has been performed on a
set of plans, in which case 80 $er cent of the plan
checking fee shall be refunded.

15.12.290 Amendment to Section 210 -1. Section 210 -1
of the National Electrical Code, hereinbefore adopted in
Section 15.12.010', is amended to read:
®210 -1 Scope. The provisions of this section
shall appTy to branch circuits supplying lighting
or appliance loads or combinations of such loads.
Where motors, or motor - operated appliances, are
connected to any circuit supplying lighting or other
appliance loads, the provisions of both this Section
and Section 430 shall apply. Section 430 shall apply
where branch circuit supplies only motor loads.
(a) Accessory uses or other buildings, signs,
etc., separately located on the same lot or premises
shall have connecting conductors run underground.
(Agricultural areas excepted when approved by the
Electrical Inspector).
(b) Where spare circuit protective devices are
provided or space for future circuit protective
devices are provided on the buss in any flush or
semi -flush mounted panel, then raceways of sufficient
capacity to permit utilization of such spares or spaces
shall be provided to an approved accessible location.
Such accessible location is defined as follows:
Where sufficient attic space is available or under-
floor space is available, a raceway shall terminate
• . conveniently for future use in each such space. Where
this condition does not exist, then such terminations
shall be approved by the Electrical Inspector.°
15.12.300 Amendment to Section 210 -22. Section 210 -22
of the National Electrical Code, hereinbefore adopted in
Section 15.12.010, is amended to read:
°210 -22 Rece tacle Outlets Re uired. Receptacle
out letss sTaTl a H N ed as o ows:
(a) General. Where portable cords are used,
except where the attachment of cords by other means
is specifically permitted.
(b) Dwelling Type Occupancies. In every kitchen,
dining room, breakfast room, living room, parlor,
library, den, sun room, recreation room and.bedroom,
receptacle outlets shall be installed so that no
point along the floor line in any wall space is more
than six feet, measured horizontally, from an outlet
in that space including any wall space two feet wide
or greater and the wall space occupied by sliding
panels in exterior walls. The receptacle outlets
shall, insofar as practicable, be spaced equal
distances apart. Receptacle outlets in floor shall
not be counted as part of the required number of
receptacle outlets unless located close to the wall.
At least one outlet shall be installed for the laundry.
As limited elsewhere in this Code, a maximum of 12
outlets may be installed on any one circuit, and
overcurrent protection shall be 20 amperes.

Outlets in other sections of the dwelling for
special appliances such as laundry equipment, shall
be placed within 6 feet of the intended location of
the appliance.
(c) Guest rooms in hotels, motels, and similar
occupancies shall have receptacles installed in
accordance with Section 210- 22(b).
(d) Minimum Wire Size. For the supply of
current to general appliance and convenience
receptacle circuits, no conductor smaller than
No. 12 A.W.G. shall be installed. No convenience
receptacle or appliance receptacle shall be installed
or operated on a general lighting branch circuit at
any time in any occupancy.
EXCEPTION: As permitted by Section 210- 26(b).
(e) At least one receptacle shall be installed
in rooms containing one or more wash basins or
lavatories.'
15.12.310 Amendment to Section 210. Section 210 of the
National Electrical Code, erein efore adopted in Section
15.12.010, is amended by adding Section 210 -26 to read:
'210 -26 Lighting Outlets.
(a) Each single family dwelling and each
occupancy of a multi - family dwelling shall have not
less than one general lighting branch circuit with
• a maximum of 12 lighting outlets per circuit
installed, minimum wire size shall be No. 14 A.W.G.
(b) Every room shall have at least one
switched general lighting outlet. Living rooms,
bedrooms, family rooms and dens may be excepted,
provided at least one switched wall receptacle is
installed of the "Split Plug" variety and supplied
by a lighting branch circuit and a convenience
outlet circuit. NOTE: The intent of the above
is to provide two circuits per room.
(c) Entrance doorways providing access to
the premises from the exterior shall be provided
with exterior illumination suitably located. The
illuminating source shall be controlled by an
interior switch conveniently located near the
doorway. NOTE: The intent of the above is not to
provide a light and switch at every door but only
to provide adequate illumination for normal egress
and ingress at all doors.'
15.12.320 Amendment to Section 230 -44. Section 230 -44
of the National Electrical Code, hereinb e ore adopted in
Section 15.12.010, is amended to read:
0230 -44 Wiring Methods. Service- entrance
conductors extending along the exterior or entering
• buildings or other structures shall be enclosed in
rigid conduit, or, for circuits not exceeding 600
volts, in wireways, auxiliary gutters, or as busways.'
15.12.330 Amendment to Section 230- 70(a). Section
230 -7 a o t e National Electrical Co— ehereinbefore
adopted in Section 15.12.010, is amended to read:
'230 -70 (a) Disconnection from Service Conductors.
A main TJ=sconnect shall be provided for disconnecting
all conductors in the building or other structure from
the service entrance conductors.'
15.12.340 Deletion of Section 230- 70(g). Section
230 -7 g is here y delete from t e National Electrical
Code, hereinbefore adopted in Section 15.12.010.
15.12.350 Amendment to Section 230 -71. Section 230 -71
of the National Electrical Code, hereinbefore adopted in
Section 15.12.010, is amended to read:
'230 -71 Rating of Service Equipment.
(a) The service equipment shall have a rating
not less than the load to be carried determined in
accordance with Section 220. The service disconnecting
means shall have a rating of not less than 60 amperes
except:
EXCEPTION NO. 1. For single family residences
having a floor area of 1000 square feet or over, or
an initial load of 10 K.W. or more, computed in
accordance with Section 220 -4, the service equipment
shall have a rating of not less than 100 amperes,
230 volt, 3 wire.
• EXCEPTION NO. 2. For installations consisting
of not more than two 2 -wire branch circuits a
service equipment of 30- ampere minimum rating may
be used.
(b) Where multiple switches or circuit breakers
are used in accordance with Section 230 -70(g) the
combined rating shall not be less than required for
a single switch or breaker.'
15.12.360 Amendment to Section 240 -16. Section 240 -16
of thee aV�l Electrical Code, Fereinb efore adopted in
Section 15.12.010, is amended to read:
'240 -16 Location in Premises. Overcurrent
devices s a l be located where they will be:
(a) Readily accessible, except as provided in
Section 230 -91 and 230 -92 for service equipment and
Section 364 -11 for busways.
(b) Not exposed to physical damage.
(c) Not in the vicinity of easily ignitable
materials.
(d) Branch circuit protective devices shall
be installed in and for each occupancy.
• EXCEPTION NO. 1. When remodeling existing
occupancies if changed to a different classification
as defined by "Table of Groups of Occupancy ", then
the said protective devices may be located at one
central point.

EXCEPTION NO. 2. Branch circuit protective devices
for single family residence.
NOTE: Nothing contained in this Code shall be
deemed or construed to permit the installation of
• any electrical device outlet or circuit in any
occupancy, the control of or the protection of
which is not accessible to the occupant at all times.'
15.12.370 Amendment to Section 250 -83. Section 250 -83
of the ational Electrical Code, Fiereinbe ore adopted in
Section 15.12.010, is amended to read-
'250-83 Made Electrodes. Where electrodes
descriece� Section 250- and 250 -82 are not
available, the grounding electrode shall consist of:
A number 4 steel reinforcing bar or approved equal,
a minimum of 20 feet long embedded in the building
concrete foundation. The bar shall be located in
the bottom of the footing with a minimum concrete
covering of 3 inches, measured from the underside.
One end of the bar shall extend out of the foundation
adjacent to the equipment to be grounded to permit
the grounding conductor to be secured by an approved
method.
EXCEPTION: Where the above method is not
practical, the following electrodes may be used upon
approval of the enforcing authority of this Code.
(a) Plate Electrodes. Each plate electrode
shall present not less than 2 square feet of surface
• to exterior soil. Electrodes of iron or steel plates
shall be at least 1/4 inch in thickness. Electrodes
of nonferrous metal shall be at least 0.06 inch in
thickness.
(b) Pipe Electrodes. Electrodes of pipe or
conduit shall be not smaller than of the 3/4 inch
trade size and where of iron or steel, shall have
the outer surface galvanized or otherwise metal
coated for corrosion protection.
(c) Rod Electrodes. Electrodes of rods of
steel or iron shall be at least 5/8 inch in diameter.
Approved rods of nonferrous materials or their
approved equivalent used for electrodes shall be
not less than 1/2 inch-in diameter.'
15.12.380 Amendment to Section 334 -6. Section 334 -6
of the National Electrical Code, hereinbe ore adopted in
Section 15.12.010, is amended to read:
'334 -6 Use. Except where otherwise specified
elsewhere in this Code, and where not subject to
physical damage, metal clad cable may be installed
for branch circuits and feeders in concealed work
as follows:
(a) Type MC. This type of power cable may be
.` used in partially protected areas, such as in
continuous rigid cable supports and the like in
dry locations and when any of the following con-
ditions are met it may be used in wet locations:

1. The metallic covering is impervious
to moisture.
2. A lead sheath or moisture impervious
jacket is provided under the metal covering.
3. The insulated conductors under the
metallic covering are approved for use in wet
locations. (See Section 300 -5)
(b) Type AC. Metal -clad cable of the AC type
may be used in dry locations; for under plaster
extensions as provided in Article 344; and embedded
in plaster finish on brick or other masonry, except
in damp or wet locations. This cable may be run or
fished in the air voids of masonry block or tile
walls; where such walls are exposed or subject to
excessive moisture or dampness or are below grade line,
Type ACL cable shall be used. This cable shall
contain lead covered conductors (Type ACL), if used
where exposed to the weather or to continuous
moisture, for underground runs and embedded in
masonry, concrete or fill in buildings in course of
construction, or where exposed to oil, or other
conditions having a deteriorating effect on the
insulation. Type AC metal -clad cable.shall not be
used where prohibited elsewhere in this Code,
including (1) in theatres, except as provided in
Section 520 -4; (2) in motion picture studios;
(3) in any hazardous locations; (4) where exposed
to corrosive fumes or vapors or to weather;
(5) on cranes or hoists, except as provided in
• Section 610 -11 Exception No. 3; (6) in storage
battery rooms; (7) in hoistways or on elevators,
except as provided in Section 620 -21; or
(8) commercial garages where prohibited in
Section 511; (9) Type AC or ACL metal -clad cable
may.only be used in single family and duplex
dwellings and their accessory buildings.
15.12.390 Amendment to Section 336 -3. Section 336 -3
of the National Electrical Code,- herein a ore adopted in
Section 15.12.010, is amended to read:
'336 -3 Use. Non - metallic sheathed cable shall
not be used for exposed wiring and shall only be used
for concealed wiring on single family or duplex
dwellings as follows:
(a) Type NM. This type of non - metallic sheathed
cable may be installed for concealed work in normally
dry locations. It may be installed or fished in air
voids in masonry block or tile walls where such
walls are not exposed or subject to excessive
moisture or dampness. Type NM cable shall not be
installed where exposed to corrosive fumes or vapors;
nor shall it be embedded in masonry or concrete and
covered with plaster of similar finish.
(b) Moisture and Corrosion - Resistant Type NMC.
.` This type of non - metallic sheathed cable may be
installed for concealed work in dry, moist, damp
or corrosive locations, and in outside and inside
walls of masonry block or tile. Where embedded in
plaster or run in a shallow chase in masonry walls
and covered with plaster within 2 inches of the
finished surface, it shall be protected against

damage from nails by a cover of corrosion - resistant
coated steel at least 1/1611 in thickness and 3/411
wide in the chase or under the final surface finish.
15.12.400 Deletion of Section 336 -6. Section 336 -6

15.12.410 Amendment to Section 346 -1. Section 346 -1
of the Nall Electrical Code, hereinbefore adopted in
Section 15.12.010, is amended to read:
'346 -1 Use. Rigid metal conduit may be used
under a atmospheric conditions and occupancies,
except that ferrous raceways and fittings protected
from corrosion solely by enamel may be used only
indoors and in occupancies not subject to severe
corrosive influences. Where practicable dissimilar
metals in contact anywhere in the system shall be
avoided to eliminate the possibility of galvanic
action. (See Section 300 -5 for limitation in the
use of ferrous raceways and fittings protected from
corrosion solely by enamel).
Unless made of a material judged suitable for
the condition, or unless corrosion protection
approved for the condition is provided, ferrous or
non - ferrous metallic conduit, elbows, couplings,
and fittings shall not be installed in concrete or
in direct contact with the earth, or in areas
subject to severe corrosive influences. Rigid
metal conduit installed underground shall be
buried a minimum of one foot under grade level
unless protected by an approved method.'
15.12.420 Amendment to Section 348 -1. Section 348 -1
of the National Electrical Code, hereinbefore adopted in
Section 15.12.010, is amended to read:
'348 -1 Use. Electrical metallic tubing may be
used for nth exposed and concealed work. Electrical
metallic tubing protected from corrosion solely by
enamel shall not be used. Electrical metallic
tubing shall not be used (1) where during in-
stallation or afterwards, it will be subject to
severe physical damage; (2) for installations
underground, in concrete or where exposed to the
weather, or excessive moisture. Where practicable
the use of dissimilar metals throughout the system
shall be avoided to eliminate the possibility of
galvanic action. (See Section 300 -5 for limitation
in the use of ferrous raceways and fittings pro-
tected from corrosion solely by enamel.)'
15.12.430 Amendment to Section 350 -2. Section 350 -2
of the National Electrical Code, hereinbefore adopted in
Section 15.12.010, is amended to read;
'350 -2 Use. Flexible metal conduit shall not
be uses —(f) in wet locations, unless conductors are
of the lead- covered type or of other type specifically
approved for the conditions; (2) in hoistways, except
as provided in Section 260 -21; (3) in storage
battery rooms; (4) in any hazardous location except
as permitted in Section 501 -4(b), 502 -4 and 503 -3;

(5) where rubber - covered conductors are exposed to
oil, gasoline, or other materials having a deteriorating
effect on rubber; (6) for installation underground,
exposed to the weather, embedded in masonry, concrete,
adobe, plaster or similar finish; (7) where exposed
to physical damage.'
15.12.440 Addition of Section 370 -6 1/2. Section
370 -6 is adde to the National Electrical Code, herein -
before adopted in Section 15.12.010, to read:
'370 -6 1 2 Equipment Groundin Conductors.
Notwithstanding any provisions of Section -6 of
this Code, conductors used solely for equipment
grounding shall not be counted in determining the
maximum number of conductors permitted in a box.'
15.12.450 Amendment to Section 410 -8. Section 410 -8
of the National Electrical Code, herein a ore adopted in
Section 15.12.010, is amended to read:
'410 -8. Fixtures in Clothes Closets.
(a) A fixture in a clothes closet shall be
installed:
1. On the wall above the closet door,
provided the clearance from the fixture to a storage
area where combustible material may be stored within
the closet is not less than 18 inches, or
2. On the ceiling or wall over an area
• which is unobstructed to the floor, maintaining an
18 -inch clearance upward and horizontally from the
fixture to a storage area where combustible material
may be stored within the closet.
NOTE: A flush recessed fixture equipped with a
solid lens is considered to be outside the closet.area.
(b) Pendants shall not be installed in clothes
closets.
(c) All lighting outlets shall be operated by
a wall or door switch (no pull chain lighting
fixtures permitted).'
15.12.460 Amendment to Section 410 -29. Section 410 -29
of the National Electrical Code, hereinbe ore adopted in
Section 15.12.010, is amended to reads
'410 -29 Fixture Ratin
(a) All fixtures requiring ballasts or trans-
formers shall be plainly marked with their electrical
rating and the manufacturer's name, trademark or
other suitable means of identification.
(b) The electrical rating shall include the
voltage and frequency, and shall indicate the
current rating of the unit including the ballast,
transformer or auto - transformer.
(c) No such equipment shall be installed in
which the power factor is less than 90 per cent.'

15.12.470 Amendment to Section 422 -5. Section 422 -5
of the National Electrical Code, herein a ore adopted in
Section 15.12.010, is amended to read:
'422 -5 Branch Circuit Am acit . The provisions
of this section specify sizes of conductors capable
of carrying appliance current without overheating
under the conditions specified (see Article 210).
They are not intended to apply to conductors which
form an integral part of the appliance.
(a) The branch circuit ampacity of an individual
branch circuit shall not be less than the marked
ampere rating of the appliance or the marked ampacity
rating of an appliance having.combined loads (see
Section 422 -32).
EXCEPTION NO. 1. For household cooking
appliances, see Table 220 -5.
EXCEPTION NO. 2. For motor- operated appliances
not having a marked ampacity rating the branch circuit
ampacity shall be in accordance with Part B of
Section 430.
EXCEPTION NO. 3. Except as noted in Section
210- 23(b), Exception No. 1, an appliance, other than
a motor- operated appliance, which is continuously
loaded, the branch circuit ampacity shall not be
less than 125 per cent of the marked rating.
(b) For branch circuits supplying appliance
and other loads, the ampacity rating shall be
determined in accordance with Section 210 -24.
(c) Every appliance shall be supplied by a
branch circuit of one of the types specified in
Section 210. Motor - operated appliances shall also
conform to the requirements of Section 430. In
every dwelling unit fixed appliances, such as food
grinders, dishwashers, washing machines, dryers,
laundry tray locations, built -in refrigerators,
built -in freezers, furnaces, air conditioners and
built -in heaters, or any other fixed appliances with
motors 1/4 H.P. or larger shall be on a separate
branch circuit supplied by a minimum No. 12 A.W.G.
wire. Each dwelling unit shall have installed
therein an individual food waste grinder branch
circuit. Said circuit shall be supplied with a
minimum No. 12 A.W.G. wire and a 15 ampere
indicating type switch. Said switch shall be
located in the wall adjacent to the sink. Food
waste grinder shall be wired with a minimum of
No. 16 A.W.G. 3 -wire S.P.T. -3 thermoplastic hard
finish cord or equal and an approved grounding
type, cord grip cap must be used.'
15.12.480 Amendment to Section 424 -9. Section 424 -9
of the National Electrical Code, hereinbe ore adopted in
Section 15.12.010, is amended to read:
'424 -9 General.
(a) Equipment for use with electrical space
heating system shall be of a type approved for

such service.
(b) Electrical space heating systems employing
methods of installation other than covered.by this
section may be used only by special permission.'
15.12.490 Amendment to Section 424 -23. Section 424 -23
of the National Electrical Co e, hereinbefore adopted in
Section 15.12.010, is amended to read:
'424 -23 Overcurrent Protection.
(a) Heating equipment, other than such motor -
operated equipment as required by Section 430 to
have additional overcurrent protection, shall be
considered as protected against overcurrent when
supplied by one of the circuits of Section 210 and
in accordance with the requirements therein specified.
(b) Infrared heating equipment shall have
overcurrent protection not exceeding 50 amperes.
(c) Space heating equipment employing
resistance type heating elements rated more than
48 amperes shall have the heating elements subdivided.
Each subdivided circuit shall not exceed 48 amperes
and shall be protected at not more than 60 amperes.
Where protection is within or on the heater
enclosure, overcurrent protection shall be suitable
for branch circuit protection meeting accessibility
requirements of Section 424 -65 but not meeting
readily accessibility requirements of branch
circuit protection.
(d) Approved recessed ceiling heaters using
not more than one (1) 250 watts infrared lamp may
be installed on a lighting branch circuit by
reducing the allowable number of lighting
outlets by two (2), for each single lamp device
used. However, not more than two (2) such devices
shall be connected to any one (1) lighting branch
circuit. Any number of multiple lamp and single
lamp heaters, the total wattage not exceeding 1500
watts or the total number of 250 watt lamps not
exceeding six (6), may be connected to a separate
20 ampere branch circuit.'
15.12.500 Addition of Section 512 -4. Section 512 -4
is ad a to t e National Electrical Code, hereinbefore
adopted in Section 15.12.010, to read:
1512 -4 General. Garages or carports accessory
to dwelling units shall be wired with a minimum
of one switched light outlet, and one receptacle
per each two auto stalls and /or fraction thereof.
Said wiring, if exposed, shall be in approved
metal raceways. All wiring to detached accessory
buildings shall be run underground.
EXCEPTION: Group H Occupancy, receptacle
may be omitted.'

15.12.510 Amendment to Section 600 -1. Section 600 -1
• of the National Electrical Code, hereinbefore adopted in
Section 15.12.010, is amended to read-
'600 -1 Scope. The provisions of.this
section shall apply to the installation of
conductors and equipment for electric signs
and outline lighting as defined in Article 100.
A sign circuit shall be provided and installed
to an accessible location at the front of all
commercial and store buildings.'
15.12.520 Amendment to Section 600 -2. Section 600 -2
of the National Electrical Code, hereinbe ore adopted in
Section 15.12.010, is amended to read-
'600 -2 Disconnect Required. Each outline
lighting instal. ation, and each sign of other
than the portable type, shall be controlled
by an externally operable switch or breaker
which will open all ungrounded conductors and
shall be suitable for conditions of installation,
such as exposure to the weather.
(a) Disconnecting Means Required. An
accessible disconnecting means consisting of
one or more plug fuses, or a suitable switch
shall be installed in or on each fixed sign
• and in or on a transformer enclosure of each
electric discharge outline lighting system to
provide means for disconnecting all ungrounded
conductors supplying such equipment.
(b) Control Switch Rating. Switches,
flashers, and similar devices controlling
transformers shall be either of a type approved
for the purpose, or have a current rating
not less than twice the current rating of
the transformers. On alternating- current
circuits, general use alternating- current
snap switches may be used to control inductive
loads other than motors, not exceeding the
ampere rating of switch. (See Section
380 -14)'
15.12.530 Amendment to Chapter 9 - Table 1. Footnote
No. 1 is added to Table 1 of Chapter 9 of the National
Electrical Code, hereinbefore adopted in Section 15.12.010,
to read-
'A conductor used only for equipment grounding
shall not be counted.'
SECTION 3. This ordinance shall be published once in
the official newspaper of the City, and the same shall be
• effective 30 days after the date of its adoption.
