AN ORDINANCE OF THE CITY OF NEWPORT BEACH
ADDING CHAPTER 5.09 TO TITLE 5 OF THE
NEWPORT BEACH MUNICIPAL CODE, ENTITLED
"REGISTRATION OF SOLICITORS AND PEDDLERS"
The City Council of the City of Newport Beach, does
ordain as follows:
SECTION 1. Chapter 5.09 is added to the Newport
Beach Municipal Code to read:
"CHAPTER 5.09
REGISTRATION OF
SOLICITORS AND PEDDLERS

5.09.010 Registration Required. All persons
operating as solicitors, peddlers, hawkers, salesmen, or
vendors, who go from house to house or upon any street,
sidewalk, alley, park or public place in the City of
Newport Beach, for the purpose of soliciting the purchase
of or distributing goods, wares, merchandise, services,
magazines, periodicals or other publications, or subscrip-
tions for the same, except regularly published newspapers,
shall make application to the License Division of the City
for identification cards. Such persons, when so operating,
shall carry their identification cards on their persons
and shall exhibit such cards, upon request, to any person
solicited, or, upon demand, to any peace officer. No
person shall engage in any of the above described activities
without first having obtained said identification card.

5.09.020 Application Requirements. Upon receiving
.
an application for a solicitor's registration card, the
License Supervisor shall refer the application to the Police
Department for investigation. Applicants for registration
cards pursuant to this Chapter may be required to:
(a) Answer all reasonable questions
concerning their personal background and moral character
and proposed method of operation, and the product or mer-
chandise to be sold or distributed;
(b) Furnish two (2) passport -sized photo-
graphs of themselves;
(c) Allow the Police Department to take
their fingerprints.
5.09.030 Issuance of Registration Cards, The License
Supervisor shall issue identification cards to all applicants
who have paid the license fee required under Section 5,08.110,
unless the Chief of Police shall recommend denial of the
application on one or more of the following grounds:
(a) The applicant has made a material
misrepresentation of fact in his application;
(b) The applicant is not a person of good
moral character, based upon his record of criminal activities
or other reliable evidence;
(c) The proposed solicitation activity
would lend itself to trickery, fraud or deceit.
Any person whose application for an indenti-
fication card has been denied shall be notified in writing
of the denial and the reasons therefor by the License Super-
visor, by certified mail, directed to the address shown on
the application. The applicant shall have the right of
appeal to the City Council, which right may be exercised by

filing a written notice of appeal with the City Clerk
within fifteen (15) days following the date upon which the
notice of the denial was mailed to him.
5.09.040 Interstate Commerce Exemption. Any person
who is engaged in, or acting as an agent for, any business
entitled to an exemption from local taxation by reason of
its being engaged in interstate commerce, shall be required
to make application for an identification card in accordance
with the requirements of this Chapter, but shall be exempt
from the license fee as provided in Section 5.08.110, upon
satisfactory evidence being presented to the License Super-
visor of his right to an exemption."
SECTION 2. This ordinance shall be published once in
