AN ORDINANCE OF THE CITY OF NEWPORT BEACH
ADOPTING A SPECIFIC PLAN OF DEVELOPMENT FOR
THAT CERTAIN PROPERTY DESIGNATED AS "UPPER
HARBOR VIEW HILLS APARTMENT SITE 1B"
The City Council of the City of Newport Beach does
ordain as follows:
SECTION 1. Statement of Purpose
The City Council hereby finds and
determines that it is in the best interests of the City and its
residents that a specific plan be adopted for the development
of the property hereinafter described in this ordinance.
This ordinance is enacted pursuant to the
provisions of Article 8 of Title 7 of the California Government
Code, entitled "Authority For and Scope of Specific Plans" as
authorized by Section 200 of the City Charter.
41 SECTION 2. Description of Property
The real property subject to regulation
under the provisions of this ordinance is described as follows:
That portion of Block 96, Irvine's Subdivision, in the
City of Newport Beach, County of Orange, State of California,
as per map filed in Book 1, page 88, Miscellaneous Record
Maps in the office of the County Recorder of said County,
described as follows:
Beginning at the intersection of the center line of
Pacific View Drive with the center line of Marguerite
Avenue as shown on a map filed in Book 7, page 42, Parcel
Maps in the office of said County Recorder, thence along
the center line of said Marguerite Avenue, the following
courses and distances: South 14° 40' 55" West 55.00 feet
to the beginning of a curve concave Northwesterly having a
radius of 330.00 feet. Southwesterly 229.49 feet along 'said
curve through an angle of 39° 50' 41 "; South 54 °.31' 36"
West 209.83 feet to beginning of a curve concave Southeasterly
having a radius of 300.00 feet; Southwesterly 222.88 feet
along said curve through an angle of 420 33' 59 "; South.
110 57' 37" West 89.93 feet to a point on the center line
of San Joaquin Hills Road as shown on said map, said point
being on a curve concave Northerly having a radius of
2200.00 feet, a radial to said point bears South 120 30' 32"

Road as described in a deed recorded in Book 9060, page 934,
Official Records of said Count, through an angle of
10 °33'42 "; thence South 880 03 10" East 118.14 feet
continuing along said center line; thence North 1`16' 50 "
East 64.00 feet° thence North 14° 40' 55" East 582.82 feet;
thence North 75a 19' 05" West 226.54 feet to the point of
beginning.
SECTION 3. Adoption of Specific Plan
No buildings, structures or other improvements
shall be constructed on the real property described in Section 2
of this ordinance which do not conform to the regulations shown on
the Specific Plan which is attached hereto and designated "Specific
Plan No. 2 ". The regulations shown on said Specific Plan shall
supersede and replace the Zoning District regulations which would
otherwise be applicable, except that said Zoning District regula-
tions shall continue to control the use of land and buildings.
SECTION 4. Minor Deviations
The Planning Commission, without amending
this ordinance, may approve minor deviations, after public hearing,

This ordinance was introduced at a regular meeting of the
City Council of the City of Newport Beach held on the 24th day of
August , 1970, and was adopted on the 14th day of September,
1970, by the following vote, to wit:
