ORDINANCE NO. 13 71
AN ORDINANCE OF THE CITY OF NEWPORT BEACH
ADOPTING A SPECIFIC PLAN TO ESTABLISH A
SIGHT PLANE DEFINING THE MAXIMUM'PERMITTED
HEIGHT OF STRUCTURES ON A PORTION OF THE
PROPOSED NEWPORT BEACH CIVIC CENTER SITE
The City Council of the City of Newport.Beach does
ordain as follows:
SECTION 1. Statement of Purpose
The City Council hereby finds.and determines
that it is in the best interests of the City..and__.its.r.esidents that
a specific plan be adopted for the development.of..the property
hereinafter described in this ordinance.
This ordinance is enacted..pursuant to the
provisions of Article 8 of Title 7 of the California. Government
Code, entitled "Authority For and Scope of S.peci£ic. Plans ".as
authorized by Section 200 of the City Charter.
SECTION 2. Description of Property
The real property subject to regulation under
the provisions of this ordinance is described as follows:
That portion of Parcel 1 as shown on the Parcel Map filed
in Book 27, page 17 of Parcel Maps, Records of Orange
County, on February 5, 1970.
SECTION 3. Adoption of Specific Plan
No buildings, structures or other improvements
shall be constructed on the real property described in Section 2 of
this ordinance which do not conform to the height limit as shown on
the Specific Plan which is attached hereto and designated "Specific
Plan No. 3 ", entitled Civic Center Sight Plane, Exhibit "B ", except
the following minor penetrations:
1. Elevator penthouses
2. Required stair shaft enclosures

3. Antennae
4. Structural appurtenances included in Section
20.08.130 of the Newport Beach Municipal Code
ior other applicable codes, excepting parapet
walls and mechanical appurtenances..--.,
The sight plane established by this ordinance is a
uniform slope defined by contour lines of elevation..above.mean
sea level as shown on Specific Plan No. 3 and shall supersede
all other limitations on height of structures which would other-
wise be applicable under zoning district regulations of the
Newport Beach Municipal Code.
SECTION 4. This ordinance shall be published once in the
official newspaper of the City, and the same shall,be effective
30 days after the date of its adoption.
This ordinance Was introduced at a regular meeting of
the City Council of the City of Newport Beach held on the 11th
day of January , 1971, and was adopted on the 8th day
of March , 1971, by the following vote, to wit:
