ORDINANCE NO. 13 8 8
AN EMERGENCY ORDINANCE OF THE CITY OF NEWPORT
BEACH EXTENDING THE INTERIM ZONING REGULATIONS
IMPOSING A MAXIMUM BUILDING HEIGHT LIMIT WITHIN
THE AREA KNOWN AS THE PROPOSED LOWER NEWPORT BAY
CIVIC DISTRICT AS ENACTED BY ORDINANCE NO. 1372
WHEREAS, on the 22nd day of February, 1971, the City
Council of the City of Newport Beach adopted Ordinance No. 1372
establishing interim zoning regulations imposing a maximum
building height limit within the area known as the proposed
Lower Newport Bay Civic District; and
WHEREAS, said Ordinance No. 1372 was adopted pursuant
to the authority of Section 65858 of the California Government
Code, which authorizes the adoption of interim zoning ordinances
as emergency measures and.pursuant to the authority of .Section
412 of the City Charter which authorizes the Council to adopt
emergency measures; and
WHEREAS, Section 2 of Ordinance No. 1372.provides
that the maximum height limitation specified in Section 1 of
said ordinance shall be effective for a period of 90 days from
the date of its adoption, which effective period terminates
on May 22, 1971; and
WHEREAS, the special Civic District Committee which
is conducting a study concerning appropriate zoning regulations
for the territory comprised within the proposed Lower Newport
Bay Civic District has recommended to the City Council that it
extend the interim zoning regulations relating to maximum
building height limits as set forth in Ordinance No. 1372; and
WHEREAS, the City Council has held a public hearing
for the purpose of considering the proposed extension of
Ordinance No. 1372;
NOW, THEREFORE, the City Council of the City of
Newport Beach DOES ORDAIN as follows:

SECTION 1. No building permit shall be issued for
any structure or any portion thereof within the Lower Newport
Bay Civic District study area, as shown on the drawing desig-
nated Exhibit "A" which is attached hereto and incorporated
herein by reference, which structure exceeds 35 feet in height
from finish grade.
SECTION 2. This ordinance shall be effective for a
period of 180 days from the date of its adoption.
SECTION 3. This ordinance is declared by the City
Council to be necessary as an emergency measure for preserving
the public peace, health, safety and welfare, for the reasons
stated herein, and in Ordinance No. 1372. This ordinance shall
take effect immediately upon its adoption.
SECTION 4. Thi$ ordinance shall be published once
in the official newspaper of the City.
This ordinance was introduced and adopted as an
emergency ordinance at a regular meeting of the City Council
of the City of Newport Beach held on the 17th day of May ,
1971, by the following vote, to wit:
