Is AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING SECTION 12.66.010 OF THE NEWPORT
BEACH MUNICIPAL CODE TO SPECIFICALLY
INCLUDE THE APPLICATION OF THE PROVISIONS
OF TITLE 12 OF THE NEWPORT BEACH MUNICIPAL
CODE TO CERTAIN PRIVATELY OWNED AND MAIN-
TAINED ROADS
WHEREAS, Section 12.66.010 of the Newport Beach
Municipal Code presently provides that the California
Vehicle Code may be enforced on certain private roads, as
indicated by ordinance of the City Council; and
WHEREAS, Sections 21100 and 21107.7 of the California
Vehicle Code authorize the enforcement of local traffic
regulations on private roads; and
WHEREAS, the intent of Section 12.66.010 was to
include the enforcement of local traffic regulations, to wit,
Title 12 of the Newport Beach Municipal Code, upon certain
designated private streets; and
WHEREAS, this ordinance is intended to clarify the
purpose of existing Section 12.66.010,
NOW, THEREFORE, BE IT ORDAINED by the City Council
of the City of Newport Beach as follows:
SECTION 1. Section 12.66.010 of the Newport Beach
Municipal Code is amended to read as follows:
"12.66.010 Intent and Purpose. This Chapter
is designed to provide for the application of the
provisions of the California Vehicle Code to privately
owned and maintained raods that are not generally open
for use of the public for purpose of vehicular
travel by reason of their proximity to or connection with
highways, when it is determined that the interests of
any resident residing along such roads and the motoring

public will best be served by the application of
said provisions as authorized by Section 21107.7
of the California Vehicle Code. Whenever the
term 'California Vehicle Code' is used in this
Chapter, it shall be deemed to and shall include
traffic regulations adopted by the City Council
pursuant to any authorization of the California
Vehicle Code as codified in Title 12 of the
Newport Beach Municipal Code."
SECTION 2. This ordinance shall be published once
in the official newspaper of the City, and the same shall be
effective thirty (30) days after the date of its adoption.
This ordinance was introduced at a regular meeting
of the City Council of the City of Newport Beach held on the
29th day of May
