AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING SECTION 15.04.190 OF THE NEWPORT
BEACH MUNICIPAL CODE, AMENDING CHAPTER 70
• OF THE NEWPORT BEACH BUILDING CODE DEALING
WITH GRADING AND SILTATION
The City Council of the 'City of Newport Beach DOES
ORDAIN as follows:
SECTION 1. Section 15.04.190 of the Newport Beach
Municipal Code is hereby amended by amending Section 7006 of
Appendix Chapter 70 of the Building Code by adding thereto
paragraph (d) (5) and renumbering paragraph (d)(5) to (d)(6)
and (d) (6) to (d) (7) . Section 7006 (d) (5) shall read as follows:
"7006(d)(5). Detailed Plans for Temporary (during
construction) and /or Permanent Sediment and Pollution
Control Facilities. The building official may require
the inclusion of pollutant traps on the plans and
specifications to intercept pollutants from project
drainage unless construction on a building is on-
going,"
SECTION 2. Section 15.04.190 of the Newport Beach
Municipal Code is hereby amended by amending Section 7013 of
Appendix Chapter 70 of the Building Code by adding Subdivision
(b) thereto and renumbering paragraphs (b) through (f), (c)
through (g) respectively. Section 7013(b) is added to read
as follows:
"7013(b) Pads. Pads should be prepared and maintained
to control erosion in the same manner as required for
slopes. The building official may waive the re-
quirement for planting on pads when construction
has commenced within ten (10) days of the completion
of the grading."
SECTION 3. Section 15.04.190 of the Newport Beach

Municipal Code is hereby amended by amending Section 7017(c)
of Appendix Chapter 70 of the Building code to read as
follows:
"7017(c). Enviromental Effect, Mitigation. The
building official may require plans and specifications
to be modified in order to mitigate anticipated adverse
enviromental effects at proposed grading projects
and he may, under circumstances where significant
adverse effects of a proposed grading project cannot
be mitigated, deny the issuance of a grading permit.
When a categorical exemption is not appropriate for
a site. of proposed grading work, the City shall
cause to be prepared an initial study, which shall
be submitted to the building official. If the
initial study shows that no significant adverse
enviromental effects will result from the project,
a negative declaration may be issued. The building
official shall cause the site to be posted and the
members of the City Council notified regarding the
issuance of the negative declaration. Appeal of the
building official's determination to issue a
negative declarations shall be set forth in the
State EIR Guidelines, Title 14, Section 15000
et seq., California Administrative Code. The building
official may charge a fee to a permit applicant
for the preparation and processing of enviromental
documentation."
SECTION 4. This ordinance shall be published once
in the official newspaper of the City, and the same shall be
effective thirty (30) days after the date of its adoption.
This ordinance was introduced at a regular meeting
of the City Council of the City of Newport Beach held on the

10th day of December 19 79 and was
adopted on the 7th day of January 19 80 ,
by the following vote, to -wit:
