AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING SECTION 20.01.070, 20.80.090 AND
20.81.090 OF THE NEWPORT BEACH MUNICIPAL
CODE AND ADDING SECTION 20.82.090 TO THE
NEWPORT BEACH MUNICIPAL CODE TO EXTEND THE
EXPIRATION DATES FOR USE PERMIT, VARIANCE,
MODIFICATION, AND SITE PLAN REVIEW APPLI-
CATIONS
The City Council of the City of Newport Beach
DOES ORDAIN as follows:
SECTION 1. Section 20.01.070, subsection J, of
the Newport Beach Municipal code is amended to read:
"J. Expiration and Revocation of Site Plan
Review Approvals. (1) Expiration. Any Site Plan
Review granted in accordance with the terms of this
Title shall expire within 24 months from the date of
approval if a building permit has not been issued.
prior to the expiration date and subsequently con-

unless at the time of approval the Planning Commission
has specified a different period of time.
(2) Violation of Terms. Any Site Plan Review
granted in accordance with the terms of this Title
may be revoked if any of the conditions or terms of
such Site Plan Review are violated or if any law or
ordinance is violated in connection therewith.
(3) Hearing. The Planning Commission shall
hold a hearing on any proposed revocation after
giving written notice to the permittee at least
ten days prior to the hearing, and shall submit
its recommendations to the City Council. The City
Council shall act thereon within 60 days after receipt
of the recommendation of the Planning Commission."
SECTION 2.

the time of approval, the Planning Commission has speci-
fied a different period of time.
B. Violation of Terms. Any Zoning Permit or Use
Permit granted in accordance with the terms-of this
Title may be revoked if any of the conditions or terms
of such Permit are violated, or if any law or ordinance
0 is violated in connection therewith.
C. Hearing. The Planning Commission shall hold a
hearing on any proposed revocation after giving written
notice to the permittee at least ten days prior to the
hearing, and shall submit its recommendations to the
City Council. The City Council shall act thereon
within 60 days after receipt of the recommendation of
the Planning Commission."
SECTION 3. Section 20.81.090 of the Newport Beach
Municipal Code is amended to read:
"20.81.090 Expiration and Revocation of Modification
Approvals. A. Expiration. Any Modification granted in
accordance with the terms of this Title shall expire within
24 months from the date of approval if a building permit
has not been issued prior to the expiration date and
subsequently construction is diligently pursued until

completion, unless, at the time of approval, the
Modifications Committee has specified a different
period of time.
B. Violation of Terms. Any Modification granted
in accordance with the terms of this Title may be
revoked if any of the conditions or terms of such
Modification are violated, or if any law or ordinance
is violated in connection therewith.
C. Hearing. The Modifications Committee shall
hold a hearing on any proposed revocation for violation
of the terms and conditions of such Modification after
giving written notice to the permittee at least ten
days prior to the hearing."
SECTION 4. Section 20.82.090 is hereby added to
the Newport Beach Municipal Code to read:
"20.82.090 Expiration and Revocation of Variance
Approvals. A. Expiration. Any Variance granted in
accordance with the terms of this Title shall expire within
24 months from the date of approval-if a building permit
has not been issued prior to the expiration date and

subsequently construction is diligently pursued until
completion, unless, at the time of approval, the
Planning Commission has specified a different period
of time.
B. Violation of Terms. Any Variance granted in
accordance with the terms of this Title may be revoked
if any of the conditions or terms of such Variance are
violated, or if any law or ordinance is violated in
connection therewith.

to the hearing, and shall submit its recommendations to
the City Council. The City Council shall act thereon

SECTION 5. This ordinance shall be published once
in the official newspaper of the City and the same shall be
effective thirty (30) days after the date of its adoption.

of the City Council of the City of Newport Beach held on the
