AMENDING CHAPTER 15.08 OF THE NEWPORT BEACH
MUNICIPAL CODE TO ADOPT THE UNIFORM PLUMBING
CODE, 1979 EDITION
The City Council of the City of Newport Beach DOES

15.08.010 Adoption of Uniform Plumbing Code.
Subject to the particular additions, deletions, and
amendments hereinafter set forth in this Chapter, the rules,
regulations, provisions and conditions set forth in that certain
Code entitled "Uniform Plumbing Code, 1979 Edition," which Code
is promulgated and published by the International Associated of
Plumbing and Mechancial officials, including Chapters 1 through
13 and Appendices A, B, C, D; G and IAPMO Installation Standards,
three full printed copies of which, printed as a Code in book
form were, by the City Council, ordered filed, and which have
been actually filed in the office of the City Clerk and which, as
•' so on file are hereby referred to, adopted and made a part hereof
as fully and for all intents and purposes as though set forth

herein at length, shall be and the same are hereby established
• and adopted as the rules, regulations, provisions and conditions
to be observed and followed in the installation, alteration or
repair of plumbing and drainage systems and the inspection
thereof; and subject to said additions, deletions and, amendments
hereinafter set forth, said Code is hereby established and
adopted and the same shall be designated, known and referred to
as the "Plumbing Code" of and for the City of Newport Beach.
b5.08.020 Addition of Part 1 to the Plumbing Code. Part
1 is hereby added to the Plumbing Code, hereinbefore adopted by
Section 15.08.010 to read as follows:
Part 1, Administration
"This ordinance shall be known as the Uniform Plumbing
Code, may be cited as such and will be referred to in this ordi-
nance as "this Code."
Section 1.0 - Application and Scope
•
The provisions of this Code shall apply to all new con-
struction, relocated buildings, and to any alterations, repairs,
or reconstruction except as provided for otherwise in this Code.
Section 1.1 - Administrative Authority and Assistants
whenever the term 'administrative authority' is used in
this Code, it shall be construed to mean the Building Official of
the City of Newport Beach or his authorized representative.
Section 1.2 - Assistants
Whenever the term "assistants" is used in the Code, it
shall be construed to mean the duly authorized inspectors of the
Building Department.

Section 1.3 - Department Having Jurisdiction
• Unless otherwise provided for by .law the Office of the
Administrative Authority shall be a part of the Building Depart-
ment.
Section 1.4 - Duties of the Administrative Authority
The Administrative Authority shall maintain public
office hours necessary to efficiently administer the provisions
of the Code and amendments thereto and shall perform the follow-
ing duties:
(1) Require submission of, examine and check plans and
specifications, drawings, descriptions, and /or diagrams necessary
to show clearly the character, kind and extent of plumbing work
covered by applications for a permit and upon approval thereof
shall issue the permit applied for.
(2) Collect all fees for permits issued as provided in
• this Code, issue receipts therefor in duplicate, the duplicate
copy of which shall be maintained as a record of this office.
(3) Administer and enforce the provisions of this Code
in a manner consistent with the intent thereof and inspect all
plumbing and drainage work authorized by any permit to assure
compliance with provisions of this Code or amendments thereto,
approving or condeming said work in whole or in part as condi-
tions require.
(4) Issue upon request a certificate of approval for
any work approved by him.
(5) Condemn and reject all work done or being done or
materials used or being used which do not in all respects comply
with the provisions of this Code and amendments thereto.

(7) Investigate any construction or work regulated by
isthis Code and issue such notices and orders as provided in
Section 1.6.
(8) Keep a complete record of all the essential trans-
actions of his office.
(9) Transfer all fees collected by him to the proper
authority provided by law to receive such funds.
Section 1.5 - Right of Entry
(1) The Administrative Authority, or his duly authoriz-
ed representative, shall have the authority to enter any building
or premises for the purpose of investigating the existence of
suspected or reported damage or defects which consititute an
immediate danger to human life or an immediate hazard to public
safety or health.
(2) Except in emergency situations as defined in Sec-
tion 1.5(1) of this Code, the Administrative Authority, or his
authorized representative, shall not enter any building or pre-
mises without the consent of the owner or occupant thereof, un-
less he possesses a valid search warrant authorizing entry and
search of the premises.
(3) No person shall hinder or prevent the Administra-
tive Authority or his authorized representative, in the perfor-
mance of the duties hereinbefore decribed as emergency situations
or while in possession of a valid search warrant, from entering
upon and into any and all premises under his jurisdiction, at all
reasonable hours, for the purpose of inspecting the same to
determine whether or not the provisions of this Code and all
other applicable laws or ordinances pertaining to the protection
• of persons or property, are observed therein.

Section 1.6 - Dangerous and Insanitary Construction
(1) Any portion of a plumbing system found by the
Administrative Authority to be insanitary as defined herein de-
clared to be a nuisance.
(2) Whenever brought to the attention of the Department
having jurisdiction that any insanitary conditions exist or that
any construction or work regulated by this Code is dangerous,
unsafe, insanitary, a nuisance or a menace to life, health or
property or otherwise in violation of this Code, the said Depart-
ment may request an investigation by the Administrative Authority
who, upon determining such information to be fact, shall order
any person, firm or corporation using or maintaining any such
condition or responsible for the use or maintenance thereof to
discontinue the use or maintenance thereof or to repair, alter,
change, remove or demolish same as he may consider necessary for
isthe proper protection of life, health or property and in the case
of any gas piping or gas appliance may order any person, firm, or
corporation, supplying gas to such piping or appliance to dis-
continue supplying gas thereto until such piping or appliance is
made safe to life, health or property.
Every such order shall be in writing, addressed to the
owner, agent or person responsible for the premises in which such
condition exists and shall specify the date or time for com-
pliance with such order.
(3) Refusal, failure or neglect to comply with any such
notice or order shall be considered a violation of this Code.
(4) When any plumbing system is maintained in violation
of this Code and in violation of any notice issued pursuant to
the provisions of this section or where a nuisance exists in any
• building or on a lot on which a building is situated, the

Administrative Authority shall institute any appropriate action
• or proceeding in any court of competent jurisdiction to prevent,
restrain, correct, or abate the violation or nuisance.
Section 1.7 - Violations and Penalties
Any person, firm or corporation violating any of the
provisions of this Code shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be punishable by a fine not to
exceed five hundred dollars ($500.00) or by imprisonment in the
County jail for a period of not to exceed six (6) months, or by
both such fine and imprisonment. Each separate day or any por-
tion thereof during which any violation of this Code occurs or
continues shall be deemed to constitute a separate offense, and
upon conviction thereof shall be punishable as herein provided.
The issuance or granting of a permit, or approval of
plans and specifications, shall not be deemed or construed to be
• a permit for, or an approval of, any violation of any of the
provisions of this Code. No permit presuming to give authority
to violate or cancel the provisions of this Code shall be valid,
except insofar as the work or use which it authorizes is lawful..
The issuance or granting of a permit or approval of
plans shall not prevent the Administrative Authority from there-
after requiring the correction of errors in plans and specifica-
tions or from preventing construction operations being carried on
thereunder when in violation of this Code or of any other or-
dinance or from revoking any Certificate of Approval when issued
in error.
Every permit issued by the Administrative Authority
under the provisions of this Code shall expire by limitation and
become null and void if the work authorized by such permit is not
• commenced within one hundred eighty (180) days from the date of

issuance of such permit, or if the work authorized by such permit
Isis suspended or abandoned at any time after the work is commenced
for a period of one hundred eighty (180) days. Before such work
may be recommenced a new permit shall be first obtained to do so.
Section 1.8 - Permit Required
(1) It shall be unlawful for any person to install,
remove, alter, repair or replace or cause to be installed, remov-
ed, altered, repaired or replaced any plumbing, gas or drainage
piping work for any fixture or water heating or treating equip-
ment in a building or premises without first obtaining a permit
to do such work from the Administrative Authority.
(2) A separate permit shall be obtained for each build-
ing or structure.
(3)

Section 1.9 - Work Not Requiring Permit
•
No permit shall be be required in the case of any repair
work as follows: the stopping of leaks in drains, soil, waste or
vent pipe, provided, however, that should any trap, drain pipe,
soil, waste or vent pipe be or become defective and it becomes
necessary to remove and replace the same with new material in any
part or parts, the same shall be considered as such new work and
a permit shall be procured and inspection made as hereinbefore
provided. No permit shall be required for the clearing of stop-
pages or the repairing of leaks in pipes, valves or fixtures,
when such repairs do not involve or require the replacement of
rearrangement of valves, pipes, or fixtures.

Section 1.10 - Issuance or Permits
• (1) No permit shall be issued to any person to do or
cause to be done any construction or work regulated by this Code
unless such person is a duly registerd or licensed contractor as
required by this Code except, when and as provided herein.
(2) Any permit required by this Code may be issued to a
person to do any plumbing or drainage work regulated by this Code
in a single family dwelling used exclusively for living purposes,
including common accessory and minor poultry or agricultural
buildings in the event that such person is the owner of such
dwelling and accessory buildings and that the same are occupied
and used exclusively by said owner, provided that said owner
shall personally perform all labor in connection therewith.
(3) A permit may be issued to any responsible person
not acting in violation of Chapter 9, Division 3, of the Business
• and Professions Code of the State of California for the installa-
tion, alteration, or repair of water piping, water treatment
equipment, and for private sewage disposal systems and house
sewers connecting thereto. Permits may be issued for the instal-
lation, alteration, or repair of house sewers connecting with the
public sewers to owners as described in Subsection (b) of this
Section or to other persons properly registered or licensed as
required by this Code.
Section 1.11 - Applicant for Permit
Any person legally entitled to apply for and receive a
permit shall make such application on forms provided for that
purpose. He shall give a description of the character of the
work proposed to be done and the location, ownership, occupancy
and use of the premises in connection therewith. The
• Administrative Authority may require plans, specifications or

. drawings and such other information as he may deem necessary.
If the Administrative Authority determines that the
plans, specifications, drawings, descriptions or information
furnished by the applicant is in compliance with this code, he
shall issue the permit applied for upon payment of the required
fee as hereinafter fixed.
Section 1.12 - Permit Fees
(1) General.
Any person applying for a permit shall, at the time the
application is made, pay to the Administrative Authority the fees
set forth in this Section. - Except as provided herein, a plumbing
permit and a sewer or private sewage disposal permit shall be
required for each building or installation.
Exception: Where accessory buildings and/or
• appurtenances, such as laundry rooms, guest houses, bath houses
or swimming pools, are used in conjunction with a single family
residence, are located on the same lot and under the same owner-
ship, and are erected at the same time as the main building, all
plumbing items may be combined on one plumbing permit. All
buildings and appurtenances regardless of type, located on the
same lot and under the same ownership may, when being connected
at the same time to a common house sewer or to a common or mul-
tiple private sewage disposal system, be combined on one sewerage
permit.
Plumbing permit fees shall be as specified in Table
No. I. Sewer and private sewage disposal permit fees shall be as
specified in_ Table No. II. For the purpose of this Section, a
sanitary plumbing outlet on which or to which a plumbing fixture
• or appliance may be set or attached shall be construed to be a
fixture. Built -in dishwashers shall be construed fixtures wheth-

er individually trapped or not. Fees for reconnection and retest
• of existing plumbing systems in relocated buildings shall be
based on the number of plumbing fixtures, gas systems, water
•
heaters, and related systems involved. When interceptor traps or
house trailer site traps are installed at the same time as a
house sewer on any lot, no sewer permit shall be required for the
connection of any such trap to an appropriate inlet fitting
provided in the house sewer by the permittee constructing such
sewer.
When a permit has been obtained to connect an existing
building or existing work to the public sewer, or to connect to a
new private disposal facility, backfilling of private sewage
disposal facilities abandoned consequent to such connection is
included in the house sewer permit.

(2) Plan Check.
• Plans and specifications shall be submitted and approved
prior to the commencement of any work described in this section.
A plan checking fee shall be paid to the Administrative
Authority at the time of submitting the plans and specifications
for work described in this - Section.
Said fee shall be equal to one -half (1/2) the required
plumbing permit fee as set forth in Table I of this Chapter.
All plan checking fees shall be based on the aggregate
quantities required for the complete project:
(a) Building or premises containing over 180
drainage fixture units.
(b) Building or premises with a potable water
supply 4" or larger.
(c) Building or premises with fuel gas piping 4"
• or larger or containing medium or high pressue fuel gas.
(3) Special.
Whenever any work for which a permit is required under
the provisions of this Code has been commenced, constructed or
completed without the authorization of such permit, a special
investigation may be required before a permit will be issued for
such work in order to determine whether the work done complied
with Code Requirements. In addition to the regular permit fee,
an investigation fee shall be collected as follows:

• No permit shall be issued when an investigation fee is
due until such fee has been paid.

The payment of the investigation fee shall not exempt
• any person from compliance with the provisions of this Code nor
from any penalty prescribed by law.
The permit fee herein specified shall be doubled when
the work requiring a permit has been started or carried on prior
to obtaining said permit and the applicant has knowledge that a
permit was necessary as evidenced by the fact that at the time of
doing such work he held a license as required Section 1.10 of
this Code, or had previously applied for a permit as provided in
this Code, but payment of such double fee, provided the permit is
subsequently used, shall not relieve any person from fully
complying with the requirements of this Code in the execution of
the work nor from any other penalties prescribed herein.
(4) Conversion Inspection Fee.
A fee as set forth below shall be paid when a conversion
. inspection is required by the Administrative Authority. This fee
shall be at $.01 per square foot of affected floor area or $15.00
per hour, whichever is larger. The minimun fee for any conver-
sion inspection shall be $25.00.
NOTE: Above fees do not include the fees for the
building permit, nor fees for electrical, plumbing, or heating
and ventilating permits covering the alterations and/or repairs
of the conversion.
(5) Investigation Fee.
A fee of Twenty -Five ($25.00) may be charged by the
Administrative Authority for any investigation of building,
structure, work reports, certification or any other related work,
requested by an owner or authorized agent of such owner.
The provisions of this_Section shall not apply to emer-
gency work when it shall be proved to the satisfaction of the
Administrative Authority that such work was urgently required and
that it was not practical to obtain a permit therefor before
commencement of the work. In all such cases a permit must be

obtained as soon as it is practical to do so, and if there is an
unreasonable delay in obtaining such permit, an investigation fee
as herein provided shall be charged.
(6) Reinspecti on Fee.
Fifteen Dollars ($15.00) per inspection may be charged
for additional inspections necessary as a result of faulty work-
manship or material or both; or for any inspection requested be-
fore the work to be inspected has been completed and made ready
for inspection. Notice of completion of the work or of correct-
ing faulty workmanship or material shall be' given the Administra-
tive Authority and reinspection requested.
Section 1.13 - All Work to be Inspected
All plumbing and drainage systems shall be inspected by
the Administrative Authority to ensure compliance with all the
requirements of this Code.
• Section 1.14 - Notification.
It shall be the duty of the person doing the work auth-
orized by the permit to notify the Administrative Authority oral-
ly or in writing, that said work is ready for inspection. Such
notification shall be given not less then twenty -four (24) hours
before the work is to be inspected.
It shall be the duty of the person doing the work auth-
orized by the permit, to make sure that the work will stand the
test prescribed elsewhere in this Code, before giving the above
notification.
Section 1.15 - Surrender of Permit
If no portion of the work or construction covered by a'
permit issued by the Administrative Authority under the provi-
sions of this Code has been commenced, the person to whom such
ispermit has been issued may deliver such permit to the Administra-

tive Authority with the request that such permit be cancelled.
• The Administrative Authority shall thereupon stamp or write on
the face of such permit the words "Cancelled at the Request of
the Permittee." Thereupon such permit shall be void and of no
effect.
Section 1.16 - Suspension or Revocation of Permit
The Administrative Authority may suspend or revoke any
permit issued under the provision of this Code whenever such per-
mit is issued in error, or is issued on the basis of incorrect
information supplied, or has been obtained by falsification or
misrepresentation, or when work is being done thereunder in
violation of this or any other related ordinance or regulation.
Section 1.17 - Refund
In the event that any person shall have obtained a per-
mit and no portion of the work or construction covered by such
• permit shall have been commenced and such permit shall have been
cancelled without any work having been done, the permittee upon
presentation to the Building Official of a request therefor, in
writing, shall be entitled to a refund in an amount equal to 80
percent of the fee actually paid for such permit. There shall be
no refund of plan check fees.
The Administrative Authority will satisfy himself as to
the right of such applicant to such refund and each such refund
shall be paid as provided by law for the payment of claims
against the city. No refund shall be made when a permit has been
obtained by falsification or misrepresentation and has been
revoked for such case. No refund shall be made on permits more
than six months old.

Section 1.18 - Transfer
Permits are not transferable from one person to another
or from one location to another.
Section 1.19 - Exemption from Fee
The requirements for fees contained in this Chapter
shall not apply when the collection of such fees is legally pro-
hibited by other statutes.
15.08.030 Amendment to Section 401(a) of the Plumbing
Code.
Section 401(a) of the Plumbing Code, hereinbefore
adopted in Section 15.08.010 is amended to read:
Section 401 - Materials
401(a) Drainage piping shall be cast iron, galvanized
steel, galvanized wrought iron, lead, copper, brass, ABS, PVC or
other approved materials having a smooth and uniform bore,
isexcept:
1. That no galvanized steel pipe shall be used
underground and shall be kept at least six (6)
inches above the ground.
2. ABS and PVC DWV piping installations shall be
limited to those structures where combustible con-
struction is allowed.

15.08.040 Amendment to Section 503(a) of the Plumbing
Code
Section 503(a) of the Plumbing Code, hereinbefore adopt-
ed in Section 15.08.010 is amended to read:

Section 503 - Materials
• 503 (a) Vent pipe shall be cast iron, galvanized
steel, galvanized wrought iron, lead, copper, brass, ABS, PVC or
other approved materials, except:
1. That no galvanized wrought iron or galvanized

steel pipe shall be used underground and shall be
kept at least six (6) inches above ground.
2. ABS and PVC DWV piping installations shall be
limited to those structures where combustible con-
struction is allowed.
15.08.060 Amendment to Section 1009(h) of the Plumbing
Section 1009(h) of the Plumbing Code, hereinbefore
adopted in Section 15.08.010 is amended to read:
Section 1009 - Size of Potable Water Piping
• `(h) No building supply line shall be less than
three - quarter inch (3/4 ") in diameter and not less than one inch
(1 ") diameter for each single family residential structure. Each
main building shall have a minimum of two (2) three - quarter inch
(3/4 ") hose bibbs located one readily to the front yard and one
readily accessible to the rear yard.
15.08.070 Amendment to Table 10 -2 of the Plumbing Code
Table 10 -2 of the Plumbing Code, hereinbefore adopted in
Section 15.080.101 is amended to read:
"Building Supply - 3/4" minimum - 1" minimun for each
single family residential structure."
15.08.080 Amendment to Section 1310 of the Plumbing Code
Section 1310 of the Plumbing Code, hereinbefore adopted
in Section 15.08.010 is amended by adding subsection (d) to read:

Section 1310 - Protection from Damage
• (d) On new construction, water heaters which are locat-
ed within the habitable area of a building or when located where
damage may occur, shall be protected from water leakage. Such
protection shall consist of one of the following:
(1) A pan of gavanized sheet metal or other approved
material with two inches (2 ") minimum depth, two inch (2)"
minimum clearance on all sides from the water heater and a one
inch (1 ") bottom drain to the outside or other visible approved
receptor.
(2) If on an outside wall, a depression of the slab
of one and one -half (1 -1/211) inches which is sloped and drains
to the outside.
(3) Equivalent protection as approved by the
Adminsitrative Authority.
• 15.08.090 Amendment to Appendix D "1.0(a) of the Plumbing
Code.
Appendix D 1.0 (a) of the Plumbing Code, hereinbefore
adopted in Section 15.08.010 is amended to read:
Appendix D 1.0 Materials
D 1.0 (a) Rainwater piping placed within the in-
terior of a building or run within a vent or shaft shall be of
cast iron, galvanized steel, wrought iron, brass, copper, lead,
Schedule 40 ABS or PVC DWV, or other approved materials.
ABS and PVC DWV piping installations shall be limited to
those structures where combustible construction is allowed.
SECTION 2. This'Ordinance shall be published once in the
official newspaper of the City, and the same shall be effective
thirty (30) days after the date of its adoption.
