HomeMy WebLinkAbout84-24 - Approving a Development Agreement Between the City of Newport Beach and the Irvine CompanyORDINANCE NO. 04-24 AN ORDINANCE OF THE CITY OF NEWPORT BEACH APPROVING A DEVELOPMENT AGREEMENT • BETWEEN THE CITY OF NEWPORT BEACH AND THE IRVINE COMPANY. follows: The City Council of the City of Newport Beach DOES ORDAIN as SECTION 1. The City Council finds and declares as follows: A) That the State Legislature has directed all cities to consider identified community housing needs in reaching land use decisions and, where feasible, to facilitate the development of new housing opportunities to provide for the housing needs of all economic segments of the community; and B) that pursuant to its municipal rights and powers, and the direction of the State Legislature, the isCity of Newport Beach has adopted a Housing Element which establishes the housing goals of the community; and C) that Housing Element Program Objective #3 commits the City to promote the development of an increased level of new housing production; D) that it is the policy of the City to monitor constraints to housing production and increase allowable density, wherever possible; and E) that Housing Element Program Objective #4 commits the City to encouraging mixed use development; and F) that the increased residential use in North Ford will result in a mixed use development that is • • achieves a balance between residential and appropriate commercial activities; and G) that Housing Element Program Objective #5 commits the City to encouraging a balance between employment and housing; and H) that Housing Element Program Objective #6 commits the City to encourage the housing development industry to respond to the housing needs of the community; and I) that Housing Element Program Objective #7 commits the City to promote and assist in the development of housing for low and moderate income households; and J) that it is the policy of the City to provide incentives to the building industry to facilitate the provision of housing for low and moderate income households; and K) that the increased residential use in North Ford will promote and assist in the development of housing for low and moderate income households; and L) that Housing Element Program Objective #10 commits the City to promote housing opportunities for all persons regardless of race, religion, sex, marital status, ancestry, national origin, or color; and M) that Housing Element Program Objective #12 commits the City to provide for the development of a variety of housing types and products; and • • • N) that achievement of the program objectives contained in the City's Housing Element requires cooperation between the City and the housing development industry, as recognized in the Housing Element and state law; and O) that this Development Agreement, which is a product of "negotiated development" encouraged by the City's Housing Element, provides a vehicle for defining the extent of public participation in the provision of affordable housing, and the elements of a cohesive affordable housing program to more efficiently and sensitively meet and address identified community housing needs; and P) that this Development Agreement is a means to remove obstacles to the provisions of affordable housing by defining the conditions, terms, restrictions, requirements and criteria to be applied in future governmental review and approvals, thereby removing disincentives for the housing development industry to make early investments and commitments with respect to completion of master plan projects such as North Ford; and Q) that this Development Agreement can provide the City with the ability to ensure production of affordable housing in phase with other private construction and infrastructure needs; and R) that the City recognizes the unique opportunity to provide a substantial amount of affordable housing on the North Ford site, in a timely fashion; and • • • S) that the City recognizes that the use of Community Development Block Grant funds and mortgage revenue bond financing in conjunction with this project will contribute to the feasibility of providing affordable housing on the North Ford site. SECTION 2. Pursuant to City Council Ordinance No. 82 -30 establishing procedures and requirements for the consideration of development agreements, that the North Ford Development Agreement is hereby approved. SECTION 3. Copies of said Development Agreement are on file in the offices of the City Clerk and Planning Department of the City of Newport Beach and said Development Agreement is made a part hereof by this reference. SECTION 4. The City Council finds that said Development Agreement is in compliance with the provisions of the California Environmental Quality Act and guidelines promulgated thereunder. SECTION 5. This Ordinance shall be published once in the official newspaper of the City, and the same shall be effective thirty (30) days after the date of its adoption. This Ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach, held on the 77 day of October , 1984, and was adopted on the 13 day of November , 1984, by the following vote, to wit: AYES, COUNCIL MEMBERS AQee.
