ORDINANCE NO. 85-8
AN ORDINANCE OF THE CITY OF NEWPORT BEACH
MODIFYING SECTION 14.24.065 OF THE NEWPORT
BEACH MUNICIPAL CODE BY INCREASING THE SEWER
USE CHARGE EFFECTIVE JULY 1, 1985
WHEREAS, Section 14.24.065 of the Newport Beach
Municipal Code provides for a basic sewer use charge of $2.90 per
month and a monthly charge of $1.40 assessed for each additional
living unit; and
WHEREAS, due to sulfide gas deterioration and
aggressive street tree root growth, sewer mains located on Balboa
Peninsula require replacement; and
WHEREAS, City wishes to participate in a joint
replacement project with Orange County Sanitation District No. 5
for replacement of the Balboa Peninsula Point sewer, and the
related replacement costs add to the need for an increase in user
rates; and
WHEREAS, to maintain an aggressive program of sewer
main replacement in older areas of the City and to offset the
cost of inflation, the Utilities Director has recommended that
the basic use fees be increased proportionately; and
WHEREAS, the City Council has considered the fees
recommended by the City Manager and finds them to be fair,
equitable and reasonable.
NOW, THEREFORE, the City Council of the City of Newport
Beach DOES ORDAIN as follows:
SECTION 1. Section 14.24.065 of the Newport Beach
Municipal Code is amended to read as follows:
14.24.065 Sewer Use Charge.
(a) A basic sewer use charge of $3.15 per month shall
be assessed for each use connection to the public sewer system;
and
(b) A monthly charge of $1.50 shall be assessed for
• each additional living unit served by the same sewer connection,
except that the assessment shall be $0.70 per month for each
hospital or hotel living unit.
SECTION 2. This Ordinance shall be published at least
once in the official newspaper of the City, within fifteen days
after adoption.
SECTION 3. This Ordinance was introduced at a regular
meeting of the City Council of the City of Newport Beach held on
the 8th day of April , 1985, and was adopted on the 22nd day
of April , 1985 by the following vote, to wit:
